The references to those articles have since been added, with the permission of the authorities. The writer's indebtedness to Mr Justice Holmes' work on The Common Law will probably be manifest to any one who takes the trouble to read his essay; but he would deem himself wanting in gratitude did he not here make a formal and personal acknowledgment of it. The only other thing which it seems necessary to say is, that the rules of the University on the subject of the Yorke Prize compel the publication of the successful essay in a permanent form. Book excerpt: Excerpt from A Treatise on the Doctrines of Res Adjudicata and Stare Decisis I have purposely confined myself to the American decisions, and have only incidentally quoted English authorities now and then for the sake of clearer illustration. In my judgment the American system of jurisprudence has acquired sufficient consistency to stand alone in general, and is not now as formerly in leading strings humbly following without question the authority of English precedents. However, the English system being the origin of ours, there must always remain similarities in the two whereby one will readily lend illustration to the other upon almost any legal topic - so that there is no impropriety in mingling both in discussions of principles entering into the composition of legal text books. The two topics of Res Adjudicata and Stare Decisis may properly be treated together. Being of a cognate character, the former controlling parties, the latter more especially furnishing a rule for courts themselves, in those matters which have been judicially considered, and are afterward again brought forward to be passed upon. In general, however, there is this distinction likewise, that the former more usually relates to determinations on questions of fact, the latter to decisions on questions of law. But this distinction does not destroy the classification which renders the two topics capable of being considered together logically and systematically. Hoping my labors herein may not prove unacceptable to the profession, I commend the work to their favor and indulgence. Book excerpt: Excerpt from The Doctrine of Judicial Review, Its Legal and Historical Basis, and Other Essays In the preparation of another volume, not yet published, I have encountered a number of questions involving controversies important to the student of American Constitutional History, an extended consideration of which however in those pages I felt to be out place. The following studies present my conclusions with regard to these questions, and the grounds of them. In the principal essay, I have endeavored to present judicial review as the outcome of a view of legislative power which arose in consequence of the astonishing abuse of their powers by the early State legislatures but which was first appreciated for its full worth by the Convention that framed the Constitution of the United States. Incidentally I have, I trust, laid to rest that most inconclusive "explanation" of judicial review which dwells on the idea that a legislative measure contrary to the constitution is not law and never was. The alleged explanation totally ignores the crucial question, which is, Why is it the judicial view of the constitution that legislative measures have to conform to? The article on the Dred Scott Decision treats of the most dramatic episode in the history of judicial review, though one that is by no means the best illustrative of the spirit of the institution.
