Book excerpt: Excerpt from The Development of International Law After the World War In accordance with its original character, this book offers only a survey of the future problems of international law. In this work I have given merely some directing outlines. I have been obliged to forgo entering upon the individual problems here, since this would have claimed materially more space and also more time. But I also believe that m the present hour it 18 above all necessary to call to mind once more the fundamental tendencies in the development of international law. The problems to be solved for international law in the future are neither simple nor small in number. We may rejoice if, upon the conclusion of peace, we succeed in obtaining an agreement on the basic principles. The future work will, however, take decades. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from International Law and the Great War My aim in the present work is to give a systematic account, from the point of view of international law, of most of the questions and incidents that have so far arisen in the Great War. Since the beginning of last August international law has been subjected to severe trials. I have endeavoured to ascertain to what extent it has emerged from its ordeals inviolate, to what extent homage has been honourably paid to it, in what respects it has suffered hurt and its behests have been disregarded. The number of violations that we have to examine is large. Indeed, so many have been committed, that it seems as though the whole fabric of international law has been demolished, and the sacred law of humanity - to which it is indissolubly joined - rejected and spurned. But, happily, not all the belligerents have contributed to bring about this deplorable result. For we shall find that nearly all the infractions of law are to be laid to the account of Germany. It is obvious, therefore, that in an undertaking of this kind I must necessarily pay considerable attention to the theories of the law of war and of international law in general advanced by German writers, to the views held in German military circles, and, especially, to the practices of the German forces in this unparalleled conflict. Book excerpt: Excerpt from International Law, Vol. 2: A Treatise; War and Neutrality Oppenheim's work upon the revision of this volume was unfinished when he died; but most of the material had already been collected, and many passages rewritten. He intended, as he once told me, to introduce the events of the war when they illustrated, extended, or challenged general principles hitherto accepted. But for the history of the war he would have relied on his friend Garner's International Law and the World War, which he had already read in manuscript. By kindly lending me the proofs of that book (since published). Professor Gamer has enabled me to make frequent references to it according to the author's plan. The war has involved changes in this volume; yet they are surely fewer than might have been expected. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from International Law and the World War, Vol. 1 The preparation of this treatise was undertaken by me at the request of the late Dr. L. Oppenheim, Whewell Professor of International Law at Cambridge University. Like most international jurists, he was deeply stirred by the numerous and shocking violations of that law which he justly regarded as one of the most notable achievements of modern civilization and to the understanding of which he had contributed so much by his researches and writings. It was his desire that I should review the conduct of the belligerents in respect to their interpretation and application of the rules of international law, compare it with the opinion of the authorities and the practice in former wars and wherever infractions appeared, to endeavor to determine the responsibility and to place it where it properly belonged. I fully shared his view that the latter task was one which jurists and text writers, who are in a sense the guardians and defenders of the law of nations, could not neglect without ignoring their duty to the law and to the cause of justice which it was designed to promote. With this view of my duty I have made a conscientious effort to evaluate the evidence so far as it was available, and wherever possible to arrive at conclusions as to the truth or falsity of the charges and counter-charges in respect to infractions. Naturally, the task of preparing a work of this kind during the progress of the war was beset by many difficulties. With the archives of foreign offices closed to historians and investigators, and with newspapers and books published in enemy countries shut out by blockades and censorships, important sources of information were necessarily inaccessible to me. After the United States become a belligerent not even technical and scientific publications were admitted from enemy countries. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Binding Force of International Law This manner of looking at International Law is not confined to any one class of the community. International lawyers are told often enough that the rules they expound have none of the requirements of Positive Law, that apart from rules based on treaties, the rest are merely moral aspirations, and as for the treaties themselves, there is no permanence in them and no power to enforce their observance. Now it may be as well at once to admit that viewing International Law from the standpoint of students adopting the principles of Hobbes and Austin it lacks the marks of Positive Law which they predicate. There is no superior lawgiver (but Hague Conferences contain the embryo of a possible International legislature), no International Court (though that deficiency is gradually being made good), no International policeman, no definite punishment for breaches of the rules, self-help is the only remedy .
