Available in PDF, EPUB and Kindle. Book excerpt: This book critically examines U.S. attempts to establish a nuclear deterrent against the Soviet Union and offers new approaches to dealing with the changing strategic environment. Dr. Payne maintains that the most influential theories of nuclear deterrence--Assured Vulnerability and Flexible Targeting—are unrealistic, given Soviet foreign policy and attitudes toward nuclear war, and no longer adequately meet the requirements of U.S. national security. Identifying an approach compatible with U.S. security commitments, he argues that future U.S. policy should focus on defeating the "Soviet theory of victory"--on threatening Soviet military forces and domestic and external political control assets, while also defending the U.S. against nuclear attack. The discussion covers recent developments, among them the "new nuclear strategy" of the Carter administration and President Reagan's new weapons program.

Book excerpt: Striking a balance between the philosophical and the pragmatic, these original essays examine the moral and strategic paradoxes found in the policy of nuclear deterrence, how uncertainty and fear can become a source of strength and how increased power of destruction might make us safer. The essays analyze the logical structure of mutually assured destruction theory and of nuclear use theory, the moral arguments of the Pastoral Letter on Deterrence of the National Conference of Catholic Bishops, the nuclear freeze movement and the role of experts in the formulation of nuclear policy. The authors stress the need for responsible public involvement and the obligation of citizens to be informed on these questions. ISBN 0-8476-7329-4 : $29.95.

Available in PDF, EPUB and Kindle. Book excerpt: This two-volume book provides a comprehensive analysis of the lawfulness of the use of nuclear weapons, based on existing international law, established facts as to nuclear weapons and their effects, and nuclear weapons policies and plans of the United States. Based on detailed analysis of the facts and law, Professor Moxley shows that the United States’ arguments that uses of nuclear weapons, including low-yield nuclear weapons, could be lawful do not withstand analysis. Moxley opens by examining established rules of international law governing the use of nuclear weapons, first analyzing this body of law based on the United States’ own statements of the matter and then extending the analysis to include requirements of international law that the United States overlooks in its assessment of the lawfulness of potential nuclear weapons uses. He then develops in detail the known facts as to nuclear weapons and their consequences and U.S. policies and plans concerning such matters. He describes the risks of deterrence and the existential nature of the effects of nuclear war on human life and civilization. He proceeds to pull it all together, applying the law to the facts and demonstrating that known nuclear weapons effects cannot comply with such legal requirements as those of distinction, proportionality, necessity, precaution, the corollary requirement of controllability, and the law of reprisal. Moxley shows that, when the United States goes to apply international law to potential nuclear weapons uses, it distorts the law as it has itself articulated it, overlooks law in such areas as causation, risk analysis, mens rea, and per se rules, and disregards known risks as to nuclear weapons effects, including radioactive fallout, nuclear winter, electromagnetic pulses, and potential escalation. He then shows that the policy of deterrence is unlawful because the use of such weapons would be unlawful. Moxley urges that the United States and other nuclear weapons States take heed of the requirements of international law as to nuclear weapons threat and use. He argues that law can be a positive force in society’s addressing existential risks posed by nuclear weapons and the policy of nuclear deterrence.

Available in PDF, EPUB and Kindle. Book excerpt: With the passing of the Cold War, a chapter in the history of nuclear deterrence has come to an end. Nuclear weapons remain, however, and nuclear deterrence will again be practiced. Rather than simply assume that the policy of deterrence has worked we need to learn the proper lessons from history in order to ensure that its mistakes are not repeated. Professor Lee furnishes us with the kind of analysis that will enable us to learn those lessons. This book is the first post Cold War assessment of nuclear deterrence. It provides a comprehensive normative understanding of nuclear deterrence policy, examining both its ethical and strategic dimensions. The book poses the question: What kind of nuclear policy, if any, deserves both moral and prudential endorsement?
