Book excerpt: The Soul of the Deal effortlessly teaches unconventional transactional strategies that are radically changing the approach of business buyers and sellers, investors, CEOs, and entrepreneurs. Their origin? Selling encyclopedias door-to-door, following the Grateful Dead for a lifetime, and closing 400+ successful deals. His music-fueled philosophy that people (not spreadsheets) are the epicenter of every business interaction took Marc from Silicon Valley to Shanghai as principal, advisor, or counsel, as well as to the Board of the Rock and Roll Hall of Fame. Tangible takeaways--captured as “Morgenstern’s Maxims” -- punctuate every chapter and are woven into vivid stories as much thriller as business book. This entertaining and accessible book addresses the unchanging human, emotional, and tactical aspects of negotiating; stressing humor, real-time spontaneity and flexibility, empathy, and engaged listening as pathways to expanded negotiating and operating success.

Book excerpt: Surviving incarceration at the infamous Trois-Rivers prison was no small accomplishment. Built in 1822, it was one of the harshest institutions in the province of Quebec, a foreboding limestone fortress where prisoners lived in grayish light, each in a single cell with a wooden bucket for the elimination of human waste. Inmates there were systematically dehumanized, and only the strongest maintained their sanity. The most effective way to survive years at Trois–Rivers was by receiving and inflicting pain, and one man was better at that than any other. His name was Robert LaRue, a well-known Montréal loan shark with unattractive facial features and a darkly evil demeanor. He left Trois-Rivers thirsty for revenge.

Book excerpt: 2020 Wall Street Journal Holiday Gift Books Selection Today the salary cap is an NBA institution, something fans take for granted as part of the fabric of the league or an obstacle to their favorite team's chances to win a championship. In the early 1980s, however, a salary cap was not only novel but nonexistent. The Cap tells the fascinating, behind-the-scenes story of the deal between the NBA and the National Basketball Players Association that created the salary cap in 1983, the first in all of sports, against the backdrop of a looming players' strike on one side and threatened economic collapse on the other. Joshua Mendelsohn illustrates how the salary cap was more than just professional basketball's economic foundation--it was a grand bargain, a compromise meant to end the chaos that had gripped the sport since the early 1960s. The NBA had spent decades in a vulnerable position financially and legally, unique in professional sports. It entered the 1980s badly battered, something no one knew better than a few legendary NBA figures: Larry Fleisher, general counsel and negotiator for the National Basketball Players Association; Larry O'Brien, the commissioner; and David Stern, who led negotiations for the NBA and would be named the commissioner a few months after the salary cap deal was reached. As a result, in 1983 the NBA and its players made a novel settlement. The players gave up infinite pay increases, but they gained a guaranteed piece of the league's revenue and free agency to play where they wished--a combination that did not exist before in professional sports but as a result became standard for the NBA, NFL, and NHL as well. The Cap explores in detail not only the high-stakes negotiations in the early 1980s but all the twists and turns through the decades that led the parties to reach a salary cap compromise. It is a compelling story that involves notable players, colorful owners, visionary league and union officials, and a sport trying to solidify a bright future despite a turbulent past and present. This is a story missing from the landscape of basketball history.

Virginia was ranked the best-managed state in the nation, the best state for business and the best state for educational opportunity. When Warner began his term in 2002, the commonwealth was in the midst of its worst fiscal crisis in forty years, and partisan bickering had brought political discourse in Richmond to a standstill. An entrepreneur from a young age, Warner became the world's first cellular industry broker and later co-founded Nextel. The conservative Democrat came in with a plan to turn Virginia around and restore the public's trust in state government, winning the support of battle-hardened Republican legislators. This is the story of how Mark Warner entered the governor's office a hands-on dealmaker and emerged a statesman.

Trump lays out his professional and personal worldview in this classic work—a firsthand account of the rise of America’s foremost deal-maker. “I like thinking big. I always have. To me it’s very simple: If you’re going to be thinking anyway, you might as well think big.”—Donald J. Trump Here is Trump in action—how he runs his organization and how he runs his life—as he meets the people he needs to meet, chats with family and friends, clashes with enemies, and challenges conventional thinking. But even a maverick plays by rules, and Trump has formulated time-tested guidelines for success. He isolates the common elements in his greatest accomplishments; he shatters myths; he names names, spells out the zeros, and fully reveals the deal-maker’s art. And throughout, Trump talks—really talks—about how he does it. Trump: The Art of the Deal is an unguarded look at the mind of a brilliant entrepreneur—the ultimate read for anyone interested in the man behind the spotlight. Praise for Trump: The Art of the Deal “Trump makes one believe for a moment in the American dream again.”—The New York Times “Donald Trump is a deal maker. He is a deal maker the way lions are carnivores and water is wet.”—Chicago Tribune “Fascinating . . . wholly absorbing . . . conveys Trump’s larger-than-life demeanor so vibrantly that the reader’s attention is instantly and fully claimed.”—Boston Herald “A chatty, generous, chutzpa-filled autobiography.”—New York Post

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the organization of creative industries, including the visual and performing arts, movies, theater, sound recordings, and book publishing. In each, artistic inputs are combined with other, "humdrum" inputs. But the deals that bring these inputs together are inherently problematic: artists have strong views; the muse whispers erratically; and consumer approval remains highly uncertain until all costs have been incurred. To assemble, distribute, and store creative products, business firms are organized, some employing creative personnel on long-term contracts, others dealing with them as outside contractors; agents emerge as intermediaries, negotiating contracts and matching creative talents with employers. Firms in creative industries are either small-scale pickers that concentrate on the selection and development of new creative talents or large-scale promoters that undertake the packaging and widespread distribution of established creative goods. In some activities, such as the performing arts, creative ventures facing high fixed costs turn to nonprofit firms. To explain the logic of these arrangements, the author draws on the analytical resources of industrial economics and the theory of contracts. He addresses the winner-take-all character of many creative activities that brings wealth and renown to some artists while dooming others to frustration; why the "option" form of contract is so prevalent; and why even savvy producers get sucked into making "ten-ton turkeys," such as Heaven's Gate. However different their superficial organization and aesthetic properties, whether high or low in cultural ranking, creative industries share the same underlying organizational logic.
