Board of Education, was part of one of the most extensive and tumultuous social/legal movements in the nation's history. The authors of this study employ the school desegregation movement to examine the role of social scientists, and social science, in the litigation process. Covering seventeen desegregation cases in litigation after 1970, they bring together the perspectives of judges, lawyers, and social scientists in a work sure to be of interest to all concerned with the court process, public policy, applied social science, conflict resolution, and the continuing process of school integration. The authors focus not only on the legal issues but also on the broader issues of conflict resolution, managed social change, and the public role of social science. They first provide a chronicle of the events leading up to the Brown case, and then a thorough and detailed analysis of the social science expert witnesses called upon to testify in the desegregation cases that followed. In the course of their research, they interviewed 90 scientists who appeared as witnesses, 70 lawyers who tried these cases for both plaintiff and defense groups, and 10 trial judges who presided in the cases. No other study has been so broadly encompassing, both in the number of cases and in the span of time involved.

Armor concludes by proposing a new policy of "equity choice" which draws on the best features of both the desegregation and choice movements.

From 1976 to 1981, the team observed the progress of school desegregation in metropolitan Wil mington, Delaware, which encompasses New Castle County. The project was made possible by a grant from the Rockefeller Foundation, Division of Social Sciences. Metropolitan desegregation is a strategy deserving of national attention because this country's black population has become increasingly concentrated within central cities. Desegregation solutions must be found that encompass America's white suburbs as well as its urban areas. In a 1977 statement, the U. S. Commission on Civil Rights called metro politan school desegregation "the last frontier to be crossed in the long judicial effort to make equal educational opportunity . . . a living reality. " Moreover, the National Task Force on Desegregation Strategies concluded in 1979, The simple demographic fact is that many large city school districts cannot desegregate by themselves. For children in such districts, the best hope for attending a desegregated school lies in the implementation of metropolitan desegregation strat egies--i. e. , desegregation plans which do not stop at the city line, but rather encom pass at least some of the surrounding suburban areas. (p. 1) The Michigan State University research team began its investigation in New Castle County, Delaware, after a three-judge federal district court ruled that area schools were illegally segregated between districts.

I Each of them touches on a different dimension of the situation: the historical, the temporal, the spatial. But the reader, perusing the essays with the situation in mind, should remember that the desegregation situation should not be inter preted literally. Authorities and adults certainly, school-age children probably, are influenced by their awareness of a sequence of past and future situations. Some may even operate with William James's (1890, p. 608) notion of "the specious present" that "has melted in our grasp, fled ere we could touch it, gone in the instant of becoming," thus reducing the potency of the present situation. Others may be dancing to a slower tempo of change, thus becoming more responsive to the present situation. Whatever the perceived tempo, many must share the view that the future may reverse the direction of the past. Some may see that new future direction as unswerving, unending, or long-lasting; others may see it as short-lived. And it is through attention to the phenomenological description of desegregation that these issues can be explored; a theme that is considered in several of the following chapters.

Board of Education case was the start of a long period of desegregation, but Brown did not give a roadmap for how to achieve this lofty goal—it only provided the destination. In the years that followed, the path toward the fulfillment of this vision for school integration was worked out in the courts through the efforts of the NAACP Legal Defense organization and the Civil Rights Division of the US Department of Justice. One of the major cases on this path was Lee v. Macon County Board of Education (1967). Revolution by Law traces the growth of Lee v. Macon County from a case to desegregate a single school district in rural Alabama to a decision that paved the way for ending state-imposed racial segregation of the schools in the Deep South. Author Brian Landsberg began his career as a young attorney working for the Civil Rights Division of the DOJ in 1964, the year after the lawsuit that would lead to the Lee decision was filed. As someone personally involved in the legal struggle for civil rights, Landsberg writes with first-hand knowledge of the case. His carefully researched study of this important case argues that private plaintiffs, the executive branch, the federal courts, and eventually Congress each played important roles in transforming the South from the most segregated to the least segregated region of the United States. The Lee case played a central role in dismantling Alabama’s official racial caste system, and the decision became the model both for other statewide school desegregation cases and for cases challenging conditions in prisons and institutions for mentally ill people. Revolution by Law gives readers a deep understanding of the methods used by the federal government to desegregate the schools of the Deep South.
