Book excerpt: With a Foreword by Dr Ralf-René Weingärtner, Director for Youth and Sport, Council of Europe, Strasbourg The Council of Europe is unquestionably the body that has made the most substantial contribution to paving the way for a European sports model. The Council of Europe was the first international intergovernmental organisation to take initiatives to establish legal instruments, and to offer an institutional framework for the development of sport at European level. The first stage of the Council of Europe’s work in this field was marked by the adoption of the Committee of Ministers’ Resolution on Doping of Athletes (1967). The extensive work of the Council of Europe on sport is evident through its main instruments on sport, such as the European Sports Charter, the Code of Sports Ethics, the European Convention on Spectator Violence, and the Anti-Doping Convention. Sport co-operation within the Council of Europe is organised in partnership with national governmental and non-governmental bodies. The Council of Europe and Sport: Basic Documents is the second volume in the Asser series of collections of documents on international sports law, containing material on the intergovernmental (inter-state) part of international sports law. The European Union and Sport: Legal and Policy Documents was the first volume devoted to the European Union. In previous other publications, non-governmental materials, i.e. statutes and constitutions, doping rules and regulations, arbitral and disciplinary rules and regulations of the international sports organisations were published. The book provides an invaluable source of reference for governmental and sports officials, legal practitioners and the academic world. With the increasing public interest in the legal aspects of sports, this collection of documents is a timely and welcome contribution to enhancing the accessibility of basic texts on international sports law and policy.

Book excerpt: Given the impact that successive court rulings have had on the organisation of the sports movement in the past 15 years, the autonomy of non-governmental sports organisations has become a highly topical concern in Europe. It is also closely related to the issue of governance, the subject of previous Council of Europe studies. The Enlarged Partial Agreement on Sport (EPAS) decided to explore the concept of autonomy in greater depth by studying the conceptual, political, legal, economic and psycho-sociological aspects of the subject. This study was carried out at the request of the EPAS by the Swiss Graduate School of Public Administration (IDHEAP) on the basis of a questionnaire sent to public authorities in charge of sport and to national and international umbrella sports organisations. In addition to an analysis of the data obtained, documents produced by public authorities and sports organisations on this emerging issue are presented. This study contributes to a better understanding of the concept of autonomy and offers a clear picture of the issues involved.

Available in PDF, EPUB and Kindle. Book excerpt: The Council of Europe, the oldest European organisation, was founded in 1949 with the aim of unifying the continent as a whole. The decision to establish its headquarters in Strasbourg was, moreover, symbolic of the desire for reconciliation between peoples. From the outset the Council of Europe adopted an institutional structure comprising a committee of ministers and a parliamentary assembly - the first in Europe. This book retraces the history of the Organisation. Consisting initially of Western European states, the Council of Europe was destined to embrace all the continent's countries, but the Cold War delayed its enlargement. It is only since 1989 that the Council of Europe has become a truly pan-European organisation, now comprising 47 member states. Its mission is based on three major goals: protecting human rights, promoting democratic values and guaranteeing the rule of law. The Council of Europe is also very active in fostering co-operation in all areas of life: education, sport, culture, etc. Starting in 1959, the European Court of Human Rights grew to become the Organisation's flagship institution: its judgments are binding on the member states. As an intergovernmental organisation, the Council of Europe has had to contend with the growth of the European Union and has sought constantly to redefine its role in international relations. In these early years of the 21st century, will it succeed in securing a key position in the European institutional architecture?

Available in PDF, EPUB and Kindle. Book excerpt: Since its foundation, the Council of Europe has established a common legal system for European states, based on democracy, the rule of law and human rights. Its standard-setting texts have helped its members meet the challenges of changing societies and now apply all over Europe given the organisation¿s unprecedented geographical enlargement since 1989. In this connection, the Council of Europe has played a key role in the accession of the new member states to the European Union. The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. It covers the 1949 Statute, which, along with related texts, lays down the Council¿s aims and determines its membership and operating methods. The second section concerns the role played by the Council of Europe - which has always been very active in standard-setting - in the harmonisation of European states¿ domestic law. The third section situates Council of Europe law in the European context. For instance, it studies the extent to which Council of Europe conventions have been incorporated in domestic law and how Council of Europe law and European Union law co-exist.

Available in PDF, EPUB and Kindle. Book excerpt: Sport is often seen as an indicator of the civic maturity of a community, an aspect of the rights of citizens to health, education and social integration. This book examines the relationships between participation in sport and physical activity, and welfare policies across Europe. It argues that the success of campaigns for the promotion of sport depend on the existence of dedicated welfare policies promoted by the European states and explores variations in cultural models and structures of governance across Europe. Addressing the function of supranational institutions such as the EU as well as voluntary networks, the book illuminates key issues in European societies such as migration, financial austerity and Brexit as they relate to sport policy. This is important reading for scholars and students in the fields of European sport and physical activity, sociology, political science and organisational analysis, as well as operators and managers of the sport systems involved in advanced training programmes.
