Book excerpt: Excerpt from The Constitution of the United States: Three Lectures Delivered Before the University Law School of Washington It gives me great pleasure, gentlemen, to spend three evenings of the little recess, or holiday, that our court takes from its labors, in communing with gentlemen who are in pursuit of the law. As I had occasion to say to the Bar Association of the city of New York, last fall was a year, when I delivered the address before it, "We are all lawyers, and judges do not cease to be layers by becoming judges; in fact, they would be very poor judges if they were not lawyers." The subject with which I propose to occupy your attention in the three discourses that I shall have the pleasure of delivering before you, is "The Constitution of the United Stales." I have adopted that subject not because there is anything in it new or fresh to you, or to any other well-read class of gentlemen, but because, owing to my situation on the bench of the Supreme Court of the United States, I have been compelled to give it very close attention, and to look at it in aspects which required the best powers that I had to give. Available in PDF, EPUB and Kindle. Book excerpt: A leading legal scholar explores how the constitutional right to seek justice has been restricted by the Supreme Court The Supreme Court s decisions on constitutional rights are well known and much talked about. But individuals who want to defend those rights need something else as well: access to courts that can rule on their complaints. And on matters of access, the Court s record over the past generation has been almost uniformly hostile to the enforcement of individual citizens constitutional rights. The Court has restricted who has standing to sue, expanded the immunity of governments and government workers, limited the kinds of cases the federal courts can hear, and restricted the right of habeas corpus. Closing the Courthouse Door, by the distinguished legal scholar Erwin Chemerinsky, is the first book to show the effect of these decisions: taken together, they add up to a growing limitation on citizens ability to defend their rights under the Constitution. Using many stories of people whose rights have been trampled yet who had no legal recourse, Chemerinsky argues that enforcing the Constitution should be the federal courts primary purpose, and they should not be barred from considering any constitutional question.

Available in PDF, EPUB and Kindle. Book excerpt: This is the untold story of the most celebrated part of the Constitution. Until the twentieth century, few Americans called the first ten constitutional amendments drafted by James Madison in 1789 and ratified by the states in 1791 the Bill of Rights. Even more surprising, when people finally started doing so between the Spanish-American War and World War II, the Bill of Rights was usually invoked to justify increasing rather than restricting the authority of the federal government. President Franklin D. Roosevelt played a key role in that development, first by using the Bill of Rights to justify the expansion of national regulation under the New Deal, and then by transforming the Bill of Rights into a patriotic rallying cry against Nazi Germany. It was only after the Cold War began that the Bill of Rights took on its modern form as the most powerful symbol of the limits on government power. These are just some of the revelations about the Bill of Rights in Gerard Magliocca's The Heart of the Constitution. For example, we are accustomed to seeing the Bill of Rights at the end of the Constitution, but Madison wanted to put them in the middle of the document. Why was his plan rejected and what impact did that have on constitutional law? Today we also venerate the first ten amendments as the Bill of Rights, but many Supreme Court opinions say that only the first eight or first nine amendments. Why was that and why did that change? The Bill of Rights that emerges from Magliocca's fresh historical examination is a living text that means something different for each generation and reflects the great ideas of the Constitution--individual freedom, democracy, states' rights, judicial review, and national power in time of crisis.

Book excerpt: Excerpt from Lectures on the Constitution of the United States The late Mr. Justice Miller, at his death, left a carefully prepared manuscript of ten lectures upon the Constitution of the United States, which had been read by him before the students of the Law School of the National University, in the city of Washington, during the winter of 1889 and early spring of 1890. These lectures were accompanied by a series of notes, prepared under his direction. This material, and two other papers by him on cognate subjects - the first an address before the Alumni of the Law Department of the University of Michigan on the 29th day of June, 1887, entitled, "The Constitution and the Supreme Court of the United States"; the other "An Oration delivered at the one hundredth anniversary of the framing and promulgation of the Constitution in Independence Square, Philadelphia, on the 17th day of September, 1887" - have been placed in my hands for arrangement and publication. The address and the oration were published together under Mr. Justice Miller's supervision during his lifetime. The ten lectures are now published for the first time.
