Book excerpt: This particular NAO report examines the compensation scheme to former Icelandic water trawlermen, and follows an earlier report from the Parliamentary Commissioner for Administration (HCP 313, session 2006-07, ISBN 9780102944471). The Commissioner's report had highlighted three areas of maladministration. This NAO report looks at the value for money issues. The background to both reports is that the UK Government made agreements in the 1970s to end the "Cod Wars" with Iceland. UK vessels could no longer fish in Icelandic waters, which led to the decline of distant water fishing. Trawlermen were not entitled to compensation according to the interpretation of employment law at that time, but this decision was challenged in 1993. In response, the Department of Employment set up an ex gratia scheme to compensate former trawlermen who had not sought redundancy at the time of their original dismissal. This scheme was further challenged by trawlermen, because it did not take account of the fact that many trawlermen often changed vessels and employers. In July 2000, the DTI announced a compensation scheme to compensate former UK-based trawlermen who had worked in Icelandic waters. By March 2007, the Department had paid just under £43 million in respect of 4,400 claims out of about 7,000 former trawlermen. The NAO's main findings and conclusions include: that the compensation scheme had significant shortcomings which inhibited efficient and effective delivery of the scheme objectives; the Department had not known enough about the fishing industry, particularly its structure and working practices to draw up workable scheme rules; the scheme required a clear plan of implementation, with targets and risk assessment; the scheme cost £18 million more than the initial estimate of £25 million; some claims took a long time to process due to problems with quality and availability of evidence and the interpretation of the scheme rules, the Department did allocate extra resources to deal with this; out of a sample of 100 claims, 11 cases were found where former trawlermen were overpaid and underpaid, and such problems stemmed from the Department's lack of evidence when assessing whether claims were eligible for payment under the scheme rules.

The Committee took evidence from the Department for Business, Enterprise and Regulatory Reform on administration of the compensation scheme. The Scheme was set up to compensate former trawlermen who had lost their jobs when the distant water fishing industry collapsed in the 1970s. At the time of the collapse most trawlermen did not receive compensation. The Scheme itself ran between October 2000 and October 2002, with some 7,000 claimants and a sum of £42 million having been paid to 4,400 former trawlermen. Findings in the two earlier reports indicated the then Department of Trade and Industry had problems in verifying claims for the scheme and further that it lacked an understanding of the working practices of the 1970s fishing industry. The Parliamentary and Health Service Ombudsman found maladministration of the Scheme especially in delivering it in an effective manner. The Committee of Public Accounts has set out a number of conclusions and recommendations, including: that the Department should learn lessons from this and the previous reports when administering future schemes; that it is important for the Department to test the availability of evidence on real cases before launching new compensation schemes; that a clear understanding of the industry needs to be in place before setting the terms of any grant schemes; that the Department failed to test the impact of the scheme's rules on different types of applicant before the scheme's launch; in 25 of 100 cases, there was insufficient evidence to say whether payments made by the Department accorded with the scheme's rules; the Department did not employ proper project planning and risk management.

The scheme to provide compensation for the livelihoods that were lost as a result was a welcomed initiative by the Government to remedy the effects of the collapse of the industry. The operation of the scheme though led to many complaints as a result of perceived administrative shortcomings in the way that the scheme had been devised and announced and as to the way that application for compensation was handled. This report sets out a number of findings and recommendations, with the Government's response to them. The Ombudsman's findings, include: that the scheme had been devised overly quickly, which led to a lack of clarity about eligibility for compensation; that the announcement of the scheme had been unclear and imprecise; that when problems arose, no review took place on the impact of new eligibility criteria for applicants whose cases had already been decided; that applicants had not been given sufficient information when new eligibility rules were enforced. The Ombudsman has set out a number of recommendations, which include: that ex gratia compensation schemes should be devised with due regard to the need to give proper examination to all relevant issues; any changes to such schemes, should be properly publicised and explained; and where any complaints occur regarding such schemes, it would be good administrative practice to initiate a review. Furthermore, that scheme rules should be clearly articulated.

Book excerpt: The Single Payment Scheme replaced previous European Union production-based agricultural subsidy schemes from 2005. The Department for Environment, Food and Rural Affairs, through the Rural Payments Agency, had chosen to implement the most complex option for reform in the shortest possible timescale, and the Agency had badly underestimated the scale of the task. This led to delays in making payments to farmers, erroneous payments and additional project and administrative costs, as reported in the Committee's earlier report (55th report session 2006-07, HC 893, ISBN 9780215036179). The Agency has estimated that there were £20 million of overpayments for the 2005 Scheme, and £17.4 million for the 2006 Scheme. The Agency has taken little action to recover the identified overpayments, with the risk that farmers may have unknowingly spent the money in the interim. Of 19 overpayments in excess of £50,000 paid in August 2006, the Agency had started the recovery process with only two of the farmers affected. Major changes made to the Agency's IT systems have enabled most farmers to receive payments earlier under the 2006 Scheme than for the 2005 Scheme. There has been a substantial impact on the costs of the business change programme to improve the Agency's efficiency, and the total project cost is now likely to exceed £300 million. In mid 2007, staff numbers in the Agency peaked at 4,600 and are not expected to reduce to 3,500 until 2010. The Agency is still not able to offer adequate advice to farmers on the progress of their claim. It was reluctant to specify targets by when such information would be available and when payments would be made under the 2008 Scheme.

Book excerpt: In 2006-07, Her Majesty's Revenue & Customs (the Department) raised a total of £23.8 billion in Corporation Tax from large businesses. There are some 700 of these businesses, and in 2005-06, just 50 of them paid 67 per cent of the large business Corporation Tax, whilst 181 businesses paid none. Two-thirds of the tax comes from the banking, oil and gas and insurance sectors. Businesses pay little or no Corporation Tax because, for example, they have made a loss, or had losses in previous years, or they are using tax reliefs, or engaging in tax avoidance. In 2006-07, the Department's large business Corporation Tax enquiry programme raised nearly £2.7 billion. Many of these enquiries were poorly targeted, with nearly 60 per cent producing less than 1 per cent of the additional tax raised. The enquiries also take too long: in January 2008, 42 per cent of its enquiries were over two years old, and 10 per cent over four years old. In February 2007, based on initial review of tax returns from the previous 12 months, the Department estimated that the potential Corporation Tax at risk was £8.5 billion. The tax assessments are very complicated and there has been a widening gap between the skill set of large business tax staff and that of the Large Business Service. The Department is bringing in external recruits, including retired tax advisors, to help to train its staff and to deal with the more complicated technical work.

Book excerpt: Between 2002 and 2008 the Department for Work and Pension replaced over 1,500 jobcentres and social security offices across Great Britain with a network of just over 800 modernised Jobcentre Plus offices. The aim was to improve significantly the job-seeking experience and the delivery of benefits by providing a service similar to that offered by a bank or modern retailer. To achieve such a radical shift the Department merged the Employment Service and the Benefits Agency into a new integrated service Jobcentre Plus. This roll-out was one of the largest public sector construction programmes undertaken in the UK in recent years. Having learnt lessons from early difficulties, the project was successful in delivering nearly all the planned offices, while making savings against the original budget of £2.2 billion. The estate rationalisation generated savings of £135 million a year, and the Department estimates that the roll-out will ultimately lead to cumulative benefits of £6 billion. The successful delivery of the programme can be attributed to sound governance, intelligent use of existing guidance and external advice, strong support from the leadership of the organisation and, critically, the consistent senior management team. The successful implementation of the project has important lessons for other major government programmes.

Strong and competent financial resources management is central to departments meeting their objectives cost effectively and delivering public services which represent value for money. Since the Committee's last report on this topic (HC 181, 25th report of session 2003-04, ISBN 9780215023636) the number of qualified finance directors with a seat on the departmental board has increased, enhancing the focus on financial performance at senior management level, but the lack of financial skills and awareness amongst non-finance staff remains a barrier to improving financial management more generally across government. Accruals-based accounting and budgeting systems are helping some departments identify under-utilised assets and dispose of those no longer required. Departments need to improve their forecasting capabilities to strengthen budgetary control and to avoid underspends not being identified early enough to reallocate resources to other priorities. Departments are continuing to spend less money than they forecast, particularly on capital projects, increasing the risk that resources are not being allocated across government in the most effective way. Few departmental boards are presented with accurate, timely and integrated financial and operational performance information to enable them to take sufficiently informed decisions on the use of resources and to review performance. Although the Treasury and Cabinet Office have a number of initiative to improve resource management, there is some way to go before financial management is fully embedded within departmental cultures.

Book excerpt: In 2007-08, the Department for Environment, Food and Rural Affairs (the Department) received £3,617 million from the Treasury. The Accounting Officer is expected to manage these resources efficiently and effectively to deliver a range of services and operations within the funding provided by Parliament. The Department failed to allocate final budgets to each of its business areas until five months into the 2007-08 financial year because: (a) planned expenditure was in excess of funds provided; (b) budget holders did not declare all financial commitments from the outset; and (c) the costs of unforeseen floods and the outbreaks of animal disease had to be managed. A similar situation had arisen in 2006-07 when the Department had to make mid-year budget reductions of £170 million to avoid the risk of overspending. The late notification of the reductions had an adverse impact on performance. In part the problems arise from the difficulties faced in sponsoring 31 delivery bodies, each with its own administrative functions and with different approaches to setting budgets and monitoring progress. Obtaining timely and realistic financial reports from delivery bodies was also difficult. A lack of awareness amongst the Department's Board Members of good financial management practice, together with cultural issues which did not prioritise financial management at a corporate level, added to the challenges. The Department's Management Board has since put in place more rigorous financial and outcome monitoring systems. Having agreed budgets for 2008-09 that accord with the Department's allocation from the Comprehensive Spending Review 2007, the problems of 2006-07 and 2007-08 are not expected to recur in 2008-09.

Book excerpt: Giving offenders opportunities to improve their basic and vocational skills can enhance their prospects of getting a job and is a major part of the Government's policy for reducing re-offending. In 2003, Ministers decided that the Learning and Skills Council (the LSC) should take over responsibility for a new Offenders' Learning and Skills Service which, after piloting, the LSC rolled out across England in July 2006. Delivering learning and skills to offenders is challenging, because the operational requirements of the Criminal Justice System takes priority, and because offenders often have other problems such as mental health difficulties and dependence on alcohol or drugs. Nevertheless, the new Service set out to overcome many of these longstanding problems. In practice it has not succeeded. The National Audit Office's examination of prisoners' learning records showed that there was not record of assessment for a quarter of prisoners. Learning plans are frequently deficient and not recording progress. Also, although enrolment is voluntary, more could be done to motivate offenders to take up opportunities. There is currently no core curriculum and inconsistencies make continuation difficult when prisoners transfer between prisons or into probation. The prison service and education providers are not working adequately together and there is insufficient research to allow informed changes. The Committee has set out a number of conclusions and recommendations, including: that only since 2007 has it been mandatory for the police to record the presence of a knife at the scene of a crime; that the majority of victims of violent crime treated in A & E units did not report their injuries to the police; that the Committee believes that the Home Office and the Department of Health should jointly establish a national system for the automatic sharing of depersonalised violent crime data between hospitals, police and the Crime & Disorder Reduction Partnerships; that the Department has made little progress since 2005 in managing to distribute funding for tackling violent crime to the Crime & Disorder Reduction Partnerships; that the Home Office has a limited understanding of the nature of gang membership and activity and how such activity has changed over time; that only one third of the Crime & Disorder Reduction Partnerships had developed written strategies to tackle violent crime and that they also lacked the analytical capacity needed to assess the data they collect on violent crime in their locality.

The Nuclear Decommissioning Authority (NDA) was established in April 2005 with the aim of decommissioning the UK's civil public sector nuclear sites. By December 2007, 14 of its 19 sites had already shut down and were being decommissioned, with parts of Sellafield being cleaned-up. The NDA discharges its responsibilities through contracts with licensed operators at each site. The sites are managed by site licensees, including preparation of decommissioning plans and performing and sub-contracting work. The licensees are owned by four parent bodies. The NDA aims to improve site performance by putting the right to be the parent body out to tender. There is uncertainty over the costs of decommissioning, with an estimate of £73 billion prepared in 2007, up 30% since 2003. The Committee accepts that the legacy of deferred decision making over a period of 50 years is in part responsible for the cost increases, but believes that some of the escalating costs should be avoidable, including short-term changes to the decommissioning programme and the scale of site support costs. Further, the NDA's work has been hampered by the uncertainty in the level of commercial income earned from ageing and unreliable facilities, with the NDA cutting, at short notice, the levels of funding it projected to provide in the 2007-08 period of decommissioning. This has imposed additional costs on the taxpayer, with the NDA providing £31.6 million to cover costs of early contract closure, staff training and redundancy.
