Book excerpt: "The Federal Communications Commission ("FCC"), in its landmark and controversial "network neutrality" 2015 Open Internet Order, prohibited internet service providers, such as Comcast and Verizon, from discriminating against non-affiliated content-providers. In doing so, the FCC relied upon the Communications Act of 1934's section 201's "common carrier" jurisdiction. Whle section 201 gives the FCC vast power to curb anti-competitive network practics, section 201 also permits the FCC to regulate common carriers' privacy policies. Specifically, section 201 allows imposition of the duty not to disclose the content of messages entrusted to carriers and gives individuals rights to recover upon breach. This Article is the first modern examination of section 201 privacy obligations - which have been largely forgotten since the late nineteenth century. Recent court decistions have ruled that the FCC's common carrier jurisdiction preempts the Federal Trade Commission's ("FTC's") jurisdiction over internet firms, giving common carrier privacy sudden policy prominence. Because common carrier privacy gives individuals the option to protect the confidentiality of messages and the right to recover damages upon breach, common carriage privacy contrasts with dominant top-down approaches to privacy, such as the Health Insurance Portability and Accountability Act ("HIPAA") and the Fair Credit Reporting Act ("FCRA"), in which regulators determine what information receives protection and on what terms. Studies consistently show that consumers typically neither nor appreciate their rights under these privacy regimes. In this way, forgotten common carrier privacy offers a new set of both practical and theoretical tools."

Updated as of May 29, 2018 In this document, the Federal Communications Commission (Commission) adopts final rules based on public comments applying the privacy requirements of the Communications Act of 1934, as amended, to broadband Internet access service (BIAS) and other telecommunications services. In adopting these rules the Commission implements the statutory requirement that telecommunications carriers protect the confidentiality of customer proprietary information. The privacy framework in these rules focuses on transparency, choice, and data security, and provides heightened protection for sensitive customer information, consistent with customer expectations. The rules require carriers to provide privacy notices that clearly and accurately inform customers; obtain opt-in or opt-out customer approval to use and share sensitive or non-sensitive customer proprietary information, respectively; take reasonable measures to secure customer proprietary information; provide notification to customers, the Commission, and law enforcement in the event of data breaches that could result in harm; not condition provision of service on the surrender of privacy rights; and provide heightened notice and obtain affirmative consent when offering financial incentives in exchange for the right to use a customer's confidential information. The Commission also revises its current telecommunications privacy rules to harmonize today's privacy rules for all telecommunications carriers, and provides a tailored exemption from these rules for enterprise customers of telecommunications services other than BIAS. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law.
