Book excerpt: Witnessing Stalin's Justice brings together contemporary American reactions to the Moscow show trials and analyses them to understand their impact on US-Soviet relations. Held between 1936 and 1938, the show trials made false charges such as espionage, sabotage and counter-revolutionary plotting at the behest of the exiled Leon Trotsky to condemn the veteran Party leaders who had founded the Communist Party and led the Russian Revolution. Using eyewitness accounts by American diplomats and foreign correspondents for the American press as well as official US government sources, this book highlights the wildly different reactions seen from liberals, radicals, intellectuals and mainstream media. Evans and Welch show how fractures of opinion ran through every level of US society and divided political groups, especially between the American Communist party and other left-wing organisations. Covering the closed trials of the Soviet military, the Soviet anti-foreigner campaign and the Dewey Commission as well as the show trials themselves, Witnessing Stalin's Justice uncovers and brings together American reactions to the Soviet Union's Great Purge.

Available in PDF, EPUB and Kindle. Book excerpt: During Stalin's Great Terror, accusations of treason struck fear in the hearts of Soviet citizens-and lengthy imprisonment or firing squads often followed. Many of the accused sealed their fates by agreeing to confessions after torture or interrogation by the NKVD. Some, however, gave up without a fight. In Stalinist Confessions, Igal Halfin investigates the phenomenon of a mass surrender to the will of the state. He deciphers the skillfully rendered discourse through which Stalin defined his cult of personality and consolidated his power by building a grassroots base of support and instilling a collective psyche in every citizen. By rooting out evil (opposition) wherever it hid, good communists could realize purity, morality, and their place in the greatest society in history. Confessing to trumped-up charges, comrades made willing sacrifices to their belief in socialism and the necessity of finding and making examples of its enemies.Halfin focuses his study on Leningrad Communist University as a microcosm of Soviet society. Here, eager students proved their loyalty to the new socialism by uncovering opposition within the University. Through their meetings and self-reports, students sought to become Stalin's New Man. Using his exhaustive research in Soviet archives including NKVD records, party materials, student and instructor journals, letters, and newspapers, Halfin examines the transformation in the language of Stalinist socialism. From an initial attitude that dismissed dissent as an error in judgment and redeemable through contrition to a doctrine where members of the opposition became innately wicked and their reform impossible, Stalin's socialism now defined loyalty in strictly black and white terms. Collusion or allegiance (real or contrived, now or in the past) with "enemies of the people" (Trotsky, Zinoviev, Bukharin, Germans, capitalists) was unforgivable. The party now took to the task of purging itself with ever-increasing zeal.

Available in PDF, EPUB and Kindle. Book excerpt: From the 'show' trials of the 1920s and 1930s to the London Conference, this book examines the Soviet role in the Nuremberg IMT trial through the prism of the ideas and practices of earlier Soviet legal history, detailing the evolution of Stalin's ideas about the trail of Nazi war criminals. Stalin believed that an international trial for Nazi war criminals was the best way to show the world the sacrifices his country had made to defeat Hitler, and he, together with his legal mouthpiece Andrei Vyshinsky, maintained tight control over Soviet representatives during talks leading up to the creation of the Nuremberg IMT trial in 1945, and the trial itself. But Soviet prosecutors at Nuremberg were unable to deal comfortably with the complexities of an open, western-style legal proceeding, which undercut their effectiveness throughout the trial. However, they were able to present a significant body of evidence that underscored the brutal nature of Hitler's racial war in Russia from 1941-45, a theme which became central to Stalin's efforts to redefine international criminal law after the war. Stalin's Soviet Justice provides a nuanced analysis of the Soviet justice system at a crucial turning point in European history and it will be vital reading for scholars and advanced students of the legal history of the Soviet Union, the history of war crimes and the aftermath of the Second World War.

Book excerpt: This book is concerned with the commercial exploitation of armed conflict; it is about money, war, atrocities and economic actors, about the connections between them, and about responsibility. It aims to clarify the legal framework that defines these connections and gives rise to criminal or, in some instances, civil responsibility, referring both to mechanisms for international criminal justice, such as the International Criminal Court, and domestic systems. It considers which economic actors among individuals, businesses, governments and States should be held accountable and before which forum. Additionally, it addresses the question of how to recover illegally acquired profits and redirect them to benefit the victims of war. The chapters shine a critical light on the options provided by a network of laws to ensure that the 'great industrialists' of our time, who find economic opportunities in the war-ravaged lives of others, are unable to pursue those opportunities with impunity.

Available in PDF, EPUB and Kindle. Book excerpt: An unusually large number of court cases against art, artists, and curators have taken place in Russia since the turn of the century. In reference to two of the most prominent, against the organizers of the exhibitions 'Caution, Religion!' and 'Forbidden Art 2006', the author examines the ways in which the meaning of art and its socio-political effects are argued in court: How do these trials attempt to establish a normative concept of art, and furthermore a binding juridical understanding of art? How is the discussion of what is permissible in art being framed in Russia today? Research into the post-Soviet art trials has been mainly journal-driven until today. Only the fairly recent trials of the Pussy Riot activists and Pyotr Pavlensky provoked lengthy publications, but these are mostly concerned with explicitly political and activist art rather than its particular discourse when on trial. This book, however, takes a scholarly approach towards (Russian) art on trial. It puts the cases in a national-historical context, which is compared from international perspectives, and particularly focuses on the way in which these proceedings have intensified juridical power over artistic freedom (of speech) in the production of art in Russia. This book will appeal to academics and students in the areas of art history, cultural science, sociology, and Slavic studies, as well as jurists, curators and museum specialists, researchers and employees in cultural institutions.
