Book excerpt: "In its attempt to further mitigate global climate change, the European Union recently included aviation activity into its carbon emissions trading scheme (the 'EU ETS'). This thesis examines the impact of the inclusion of aviation into the EU ETS on Caribbean island states and, additionally, offers recommendation on how these Caribbean island states can deal with the issues that are expected to arise from the inclusion of aviation into the EU ETS. By firstly determining the deficiencies in the EU ETS relevant to Caribbean island states as compared to the UNFCCC and Kyoto Protocol and, secondly, analyzing the legal and economic impact of the inclusion of aviation into the EU ETS on both airlines worldwide as well as Caribbean island states, this thesis finds that there is great uncertainty in the airline industry on the impact of the inclusion of aviation into the EU ETS. Nevertheless, the current EU ETS regime was not anticipated to have a significantly detrimental impact on the Caribbean economy. However, any reduction in the numbers of tourist arrivals and expenditures is economically disadvantageous to the Caribbean island states. Therefore, Caribbean island states should create a stronger and more independent position for themselves within the global climate change framework of the UNFCCC by having all 31 Caribbean island states become party to the UNFCCC and Kyoto Protocol and by working together to create a regional Caribbean ETS." --

Book excerpt: In February 2009, the European Union Directive 2008/101/EC was approved, clarifying how emissions from the aviation sector will be included in the European Union Emissions Trading Scheme (EU ETS). According to this directive, starting from 1st January 2012, all aircraft operators (nearly 4000), flying to or from any airport in EU territory will be included in EU ETS. This dissertation aims to provide qualitative and quantitative information about the consequences for aviation industry to be included in European Union Emissions Trading Scheme (EU ETS) for the first trading period (2012). In this study, with empirical data, a scenario approach has also been used to quantify the potential 2012 CO2 emissions from aviation industry. So that, a scale of the possible total financial burden that aviation sector will be under for their CO2 emissions in the first trading period of EU ETS (2012) is calculated. According to the calculations, 2012 CO2 emissions of the flights covered under EU ETS can vary from 231.242 million tonne of CO2 to 277.036 million tonne of CO2 and the cost of 2012 CO2 emissions for the aviation sector can be between 967.47 million Euro and 2.54 billion Euro.

Airlines will have to acquire and 'surrender' allowances for the carbon emissions produced by their flights. The scheme is comprehensive: it applies to EU and non-EU airlines (subject to a potential exemption), to passenger and cargo flights, and to flights between EU airports and between EU and non-EU airports. An airline that fails to surrender allowances is fined €100 per allowance and must make up the shortfall the following year. The EU's scheme has already given rise to legal action in connection with the EU's international civil aviation obligations. But, due to its impacts on trade in goods and services, the scheme also has implications for the EU's obligations under the WTO law: specifically, under the General Agreement on Tariffs and Trade (GATT) and the General Agreement on Trade in Services (GATS). In particular, this raises the question of the scope of application of the GATS Annex on Air Transport Services. As this article shows, it is challenging to design a carbon scheme that is both administratively feasible and justifiable under WTO law.

We find that the Scheme would only have a small impact on US airlines and emissions, and that aviation operations would continue to grow. If carriers pass on all additional costs, including the opportunity costs associated with free allowances, to consumers, profits for US carriers will increase. Windfall gains from free allowances may be substantial because, under current allocation rules, airlines would only have to purchase about a third of the required allowances. However, an increase in the proportion of allowances auctioned would reduce windfall gains and profits for US airlines may decline.

This inquiry examines the prospects for a global carbon market and the implications of this for further development of the European Union Emissions Trading System (EU ETS). It reviews the impact and future prospects for the EU ETS in meeting the Government's twin objectives of reducing emissions at lowest cost and setting a carbon price that delivers investment in low-carbon technologies. The EU ETS has emissions caps set too high to force emitters to make the often costly investment decisions which would reduce emissions. The recession has only served to loosen what little constraint the cap provided. The carbon price has been too low to encourage the necessary investment in low-carbon processes and infrastructure. The cap mechanism therefore needs to be significantly tightened. This should be supported by cancelling 'new entrant reserve' allowances and auctioning as many allowances as possible, rather than giving them away for free (with the revenues possibly hypothecated to climate change measures). The Government should explore the possible use of a carbon tax. It should also encourage more use of allowance auctions with reserve prices, more use of incentives for low-carbon power generation and emissions performance standards for electricity generation. The emphasis should also be on harmonising the approach internationally, and on extending effective emissions trading systems. The Committee lists 19 conclusions and recommendations.
