Available in PDF, EPUB and Kindle. Book excerpt: All legal texts tell us stories in many ways. What stories, what narratives, can be found in the case law of the Court of Justice of the European Union? This book invites the reader to think of the world of EU law as a creative process. From such a perspective, the adjudicative praxis of the Court is an intellectual, cultural, literary activity, in which the reader can imagine him- or herself participating. The author develops a novel hermeneutic methodology to examine the textual performance of the Court, by combining the work of American 'Law and Literature' scholar James Boyd White with the work of French philosopher Paul Ricoeur. This methodology allows for an analysis of the role played by the Court in its legal reasoning and the vision of humanity it demonstrates: narratives of 'self' and 'other.' The synthesis of two case studies (on economically inactive EU citizens' access to social benefits, and on data protection and privacy) results in an open-ended and self-reflective examination of the narratives about human agency and human responsibility in the case law of the Court of Justice European Union.

Available in PDF, EPUB and Kindle. Book excerpt: In this open access book, experts on integration processes, integration policies, transnationalism, and the migration and development framework provide an academic assessment of the 2011 European Agenda for the Integration of Third-Country Nationals, which calls for integration policies in the EU to involve not only immigrants and their society of settlement, but also actors in their country of origin. Moreover, a heuristic model is developed for the non-normative, analytical study of integration processes and policies based on conceptual, demographic, and historical accounts. The volume addresses three interconnected issues: What does research have to say on (the study of) integration processes in general and on the relevance of actors in origin countries in particular? What is the state of the art of the study of integration policies in Europe and the use of the concept of integration in policy formulation and practice? Does the proposal to include actors in origin countries as important players in integration policies find legitimation in empirical research? A few general conclusions are drawn. First, integration policies have developed at many levels of government: nationally, locally, regionally, and at the supra-national level of the EU. Second, a multitude of stakeholders has become involved in integration as policy designers and implementers. Finally, a logic of policymaking—and not an evidence-based scientific argument—can be said to underlie the European Commission’s redefinition of integration as a three-way process. This book will appeal to academics and policymakers at international, European, national, regional, and local levels. It will also be of interest to graduate and master-level students of political science, sociology, social anthropology, international relations, criminology, geography, and history.

Book excerpt: This book outlines the development of the Bologna Process, reviewing how it came into existence and the milestones reached over the past decade. It provides a critical examination of the state of implementation of its main policy action lines - such as comparable degree structures and quality assurance systems - and assesses its impact in fostering greater student mobility, widening participation in higher education, and developing lifelong learning. The impact of the Bologna Process as a driver of reform is set against challenges in implementing agreed goals. And the authors point to the diversity of results across the 47 signatory countries, highlighting problems with the use of instruments at the institutional level. The book also discusses how the Bologna Process has become a focus of attention for higher education policy-making around the world, presenting examples of the policy initiatives it has inspired. Finally, it considers the lessons to be learned from this European experience, and the challenges to be met in the future.

Available in PDF, EPUB and Kindle. Book excerpt: This book fills an existing academic literature gap by providing a sound and synthetic analysis on the process of European Territorial Cooperation over the last 30 years. This follows from the support from the former EU INTERREG Community Initiative, since 1989, later transformed into the second main goal of EU Cohesion Policy, by 2007: European Territorial Cooperation - ECT. In order to present the ECT process in a more comprehensive manner, and to be the main literature reference regarding this process in the decades to come, this book is divided into four different sections and 12 chapters. The first section summarizes the main impacts and added-value from ETC experiences while proposing the elevation of the ETC goals within EU Cohesion Policies. The second section addresses the process of cross-border cooperation, and namely its impact in reducing border obstacles and supporting ever growing number of cross-border entities. The third section elaborates on the second most important ETC process (transnational cooperation) with a similar approach. Finally, a last section debates the future scenarios for this process in Europe.

Available in PDF, EPUB and Kindle. Book excerpt: Despite, or perhaps because of, the rejection of the EU Constitutional Treaty eventually leading to the adoption of the Lisbon Treaty, the debates concerning the European Union's constitutional framework continue. This book builds on the discourse in European Union constitutionalism in order to offer a novel analysis of the EU's constitutional developments. The book considers the constitutional trends of the process of EU integration before applying a transdisciplinary concept of complexity developed in the work of Edgar Morin to the EU. In doing this Giuseppe Martinico sets out a unique account of EU constitutionalism which argues that the EU legal order is a complex entity which shares some features with complex natural systems. The book then goes on to explore the methodological implications of such constitutional complexity for the study of EU law.

Available in PDF, EPUB and Kindle. Book excerpt: The book advances the state of the European Union?s policy theory by taking stock of seven promising frameworks of the policy process, systematically comparing their limitations and strengths, and offering a strategy to develop robust research agendas. Frameworks may constitute competing policy explanations depending on assumptions they make about EU institutional and issue complexity. The frameworks include detailed analyses of multi-level governance, advocacy coalitions, punctuated equilibrium, multiple streams, policy learning, normative power Europe, and constructivism. Besides generating a fertile dialogue that transcends the narrow confines of EU policy, contributions highlight the value of intellectual pluralism and the need for clear and rigorous explanations of the policy process. This book was published as a special issue of the Journal of European Public Policy.

Book excerpt: In Due Process and Fair Trial in EU Competition Law, Cristina Teleki addresses the complex relationship between Articles 101 and 102 of the Treaty on the Functioning of the European Union and Article 6 of the European Convention on Human Rights. The book is built around the idea that big business can threaten democracy. Due process and fair trial should be central to the process of addressing bigness through competition law, by safeguarding independent decision-making and judicial review and by preventing competition authorities from growing into administrative behemoths threatening democracy from inside. To show this, the book combines a comprehensive review of the case-law of the European Court of Human Rights with insight from economics, psychology and systems theory.

The ESCAPE series serves as a forum for engineers, scientists, researchers, managers and students to present and discuss progress being made in the area of computer aided process engineering (CAPE). European industries large and small are bringing innovations into our lives, whether in the form of new technologies to address environmental problems, new products to make our homes more comfortable and energy efficient or new therapies to improve the health and well being of European citizens. Moreover, the European Industry needs to undertake research and technological initiatives in response to humanity's "Grand Challenges," described in the declaration of Lund, namely, Global Warming, Tightening Supplies of Energy, Water and Food, Ageing Societies, Public Health, Pandemics and Security. Thus, the Technical Theme of ESCAPE 21 will be "Process Systems Approaches for Addressing Grand Challenges in Energy, Environment, Health, Bioprocessing & Nanotechnologies."
