Book excerpt: The Retirement Series documents Jefferson's written legacy between his return to private life on 4 March 1809 and his death on 4 July 1826. During this period Jefferson founded the University of Virginia and sold his extraordinary library to the nation, but his greatest legacy from these years is the astonishing depth and breadth of his correspondence with statesmen, inventors, scientists, philosophers, and ordinary citizens on topics spanning virtually every field of human endeavor.--From publisher description.

Book excerpt: What if racialized mass incarceration is not a perversion of our criminal justice system's liberal ideals, but rather a natural conclusion? Adam Malka raises this disturbing possibility through a gripping look at the origins of modern policing in the influential hub of Baltimore during and after slavery's final decades. He argues that America's new professional police forces and prisons were developed to expand, not curb, the reach of white vigilantes, and are best understood as a uniformed wing of the gangs that controlled free black people by branding them—and treating them—as criminals. The post–Civil War triumph of liberal ideals thus also marked a triumph of an institutionalized belief in black criminality. Mass incarceration may be a recent phenomenon, but the problems that undergird the "new Jim Crow" are very, very old. As Malka makes clear, a real reckoning with this national calamity requires not easy reforms but a deeper, more radical effort to overcome the racial legacies encoded into the very DNA of our police institutions.

Available in PDF, EPUB and Kindle. Book excerpt: A stereotypical image of manumission is that of a benign plantation owner freeing his slaves on his deathbed. But as Stephen Whitman demonstrates, the truth was far more complex, especially in border states where manumission was much more common. Whitman analyzes the economic and social history of Baltimore to show how the vigorous growth of the city required the exploitation of rural slaves. To prevent them from escaping and to spur higher production, owners entered into arrangements with their slaves, promising eventual freedom in return for many years' hard work. The Price of Freedom reveals how blacks played a critical role in freeing themselves from slavery. Yet it was an imperfect victory. Once Baltimore's economic growth began to slow, freed blacks were virtually excluded from craft apprenticeships, and European immigrants supplanted them as a trained labor force.

Available in PDF, EPUB and Kindle. Book excerpt: The modern effort to locate American liberties, it turns out, began in the mud at the bottom of Baltimore harbor. John Barron Jr. and John Craig sued the city for damages after Baltimore’s rebuilt drainage system diverted water and sediment into the harbor, preventing large ships from tying up at Barron and Craig’s wharf. By the time the case reached the U.S. Supreme Court in 1833, the issue had become whether the city’s actions constituted a taking of property by the state without just compensation, a violation of the Fifth Amendment to the U.S. Constitution. The high court’s decision in Barron v. Baltimore marked a critical step in the rapid evolution of law and constitutional rights during the first half of the nineteenth century. Diminishing the Bill of Rights examines the backstory and context of this decision as a turning point in the development of our current conception of individual rights. Since the colonial period, Americans had viewed their rights as springing from multiple sources, including the common law, natural right, and English legal tradition. Despite this rich heritage and a prohibition grounded in the Magna Carta against uncompensated state takings of property, the Court ruled against Barron’s claim. The Bill of Rights, Chief Justice John Marshall declared in his opinion for the majority, restrained only the federal government, not the states. The Fifth Amendment, accordingly, did not apply to Maryland or any of the cities it chartered. In explaining how the Court came to reject a multisourced view of human liberties—a position seemingly inconsistent with its previous decisions—William Davenport Mercer helps explain why we now envision the Constitution as essential to guaranteeing our rights. Marshall’s view of rights in Barron, Mercer argues, helped him navigate the Court through the precarious political currents of the time. While the chief justice may have effected a shrewd political maneuver, the decision helped hasten a reconceptualization of rights as located in documents. Its legacy, as Mercer’s work makes clear, is among the Jacksonian era’s significant democratic reforms and marks the emergence of a distinctly American constitutionalism.

Book excerpt: The definitive edition of Thomas Jefferson's papers from the end of his presidency until his death continues with Volume Two, which covers the period from 16 November 1809 to 11 August 1810. Both incoming and outgoing letters are included, totaling 518 documents printed in full. General themes include Jefferson's financial troubles, which eventually led him to loan himself a large sum of money he was managing for Tadeusz Kosciuszko; his preparations to face a lawsuit stemming from his decision as president to remove Edward Livingston from a valuable property in New Orleans; other legal complications involving his landholdings and the settlement of estates he had inherited long before; his plans to breed merino sheep and share them gratis with his fellow Virginians; and his ongoing interest in the Republican party's success. Highlights include a long list of books on agriculture that Jefferson probably compiled to guide the Library of Congress in its purchases; descriptions of inventions by Robert Fulton and more obscure figures such as the New Orleans engineer Godefroi Du Jareau; Jefferson's draft letter criticizing the Quakers as unpatriotic, much of which he later deleted; the letter in which he ordered a set of silver tumblers that have become known as the Jefferson Cups; and an important treatise on taxation by the distinguished French political economist Pierre Samuel Du Pont de Nemours, published here for the first time.

This study covers a wide cross-section of topics, individuals, groups, and musical practices representing various regions and cities. The subjects discussed reflect the religious, ethnic, and social plurality of the American musical experience as well as the impact on cultural society provided by the arrival of new musical immigrants and the internal movements of musicians and musical practices. The essays are arranged principally on the basis of the historical chronology of the cultural practices and subjects discussed. Each article helps to shed additional light on cultural expressions through music in eighteenth- and nineteenth-century America.

Book excerpt: Volume Eight of the project documenting Thomas Jefferson's last years presents 591 documents dated from 1 October 1814 to 31 August 1815. Jefferson is overjoyed by American victories late in the War of 1812 and highly interested in the treaty negotiations that ultimately end the conflict. Following Congress's decision to purchase his library, he oversees the counting, packing, and transportation of his books to Washington. Jefferson uses most of the funds from the sale to pay old debts but spends some of the proceeds on new titles. He resigns from the presidency of the American Philosophical Society, revises draft chapters of Louis H. Girardin's history of Virginia, and advises William Wirt on revolutionary-era Stamp Act resolutions. Jefferson criticizes those who discuss politics from the pulpit, and he drafts a bill to transform the Albemarle Academy into Central College. Monticello visitors Francis W. Gilmer, Francis C. Gray, and George Ticknor describe the mountaintop and its inhabitants, and Gray's visit leads to an exchange with Jefferson about how many generations of white interbreeding it takes to clear Negro blood. Finally, although death takes his nephew Peter Carr and brother Randolph Jefferson, the marriage of his grandson Thomas Jefferson Randolph is a continuing source of great happiness. Some images inside the book are unavailable due to digital copyright restrictions.
