There is considerable anxiety, however, about these changes amongst practitioners, advisers and students alike of immigration law." "This Guide provides a detailed background to this legislation, discusses the context in which its various provisions are set, and explains how the law will now work. Book excerpt: FIRST PRIZE WINNER OF THE SLS BIRKS PRIZE FOR OUTSTANDING LEGAL SCHOLARSHIP 2011 How are we to assess and evaluate the quality of the tribunal systems that do the day-to-day work of adjudicating upon the disputes individuals have with government? This book examines how the idea of adjudicative quality works in practice by presenting a detailed case-study of the tribunal system responsible for determining appeals lodged by foreign nationals who claim that they will be at risk of persecution or ill-treatment on return to their country of origin. Over recent years, the asylum appeal process has become a major area of judicial decision-making and the most frequently restructured tribunal system. Asylum adjudication is also one of the most difficult areas of decision-making in the modern legal system. Integrating empirical research with legal analysis, this book provides an in-depth study of the development and operation of this tribunal system and of asylum decision-making. The book examines how this particular appeal process seeks to mediate the tension between the competing values under which it operates. There are chapters examining the organisation of the tribunal system, its procedures, the nature of fact-finding in asylum cases and the operation of onward rights of challenge. An examination as to how the tensions inherent in the idea of administrative justice are manifested in the context of a tribunal system responsible for making potentially life or death decisions, this book fills a gap in the literature and will be of value to those interested in administrative law and asylum adjudication.

Available in PDF, EPUB and Kindle. Book excerpt: This book is about the lives of refugee women in Britain and France. Who are they? Where do they come from? What happens to them when they arrive, while they wait for a decision on their claim for asylum, and after the decision, whether positive or negative? It shows how laws and processes designed to meet the needs of men fleeing political persecution often fail to protect women from persecution in their home countries and fail to meet their needs during and after the decision-making process. It portrays refugee women as resilient, resourceful and potentially active participants in British and French social, political and cultural life. It exposes the obstacles that make active participation difficult. The book is an authoritative and thorough synthesis of all available material on refugee women in Britain and France. The style is accessible and highly readable, making this an ideal book for academics, students and interested readers.

Available in PDF, EPUB and Kindle. Book excerpt: In 1998 a bloody war erupted in The Horn of Africa between Ethiopia and Eritrea. During the war Ethiopia arrested and expelled 70,000 of its citizens, and stripped another 50,000-plus of their citzenship on the basis of their presumed ethnicity. Nationalism, Law and Statelessness: Grand Illusions in the Horn of Africa examines the events which led up to the war, documents the expulsions and denationalisations that took place and follows the flight of these stateless Ethiopians out of the Horn into Europe. The core issue examined is the link between sovereignty and statelessness as this plays out in The Horn of Africa and in the West. The book provides a valuable insight into how nations create and perpetuate statelessness, the failure of law, both national and international, to protect and address the plight of stateless persons, and the illusory nature of nationalism, citizenship and human rights in the modern age. The study is one of a very few which examines the problem of statelessness through the accounts of stateless persons themselves. This book will be of great interest to students and researchers in anthropology, law, politics, African studies and refugee studies as well as professionals and all those interested in stateless persons in the West, including Eritreans, who continue to be denied basic rights.

This book was released on 2013-10-11 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: The asylum system is overburdened and under severe pressure. The backlog of asylum cases that should have been cleared by 2011 has reached 32,600, with some people waiting up to 16 years for a decision. Thousands appear to be living in a sub-standard level of housing as part of the COMPASS contract supplied by the private contractors G4S, Serco and Clearel. These companies must be held accountable. The quality of decision making is also of great concern as 30% of appeals against initial decisions were allowed in 2012. The impact of decisions are grave - if asylum is not granted when it should be then the UK is failing to protect a vulnerable person. If asylum is granted when it is not deserved then the UK may well end up harbouring war criminals and terrorists. Those who apply for asylum should be checked against national and international law enforcement agency and security databases to ensure that we are not harbouring those who intend us harm. The Home Secretary has to give assurance that any anomalies in the process, which have allowed decisions such as this to take place, are addressed immediately. The are also oncerns about the level of support available to those who seek asylum in the UK. The Immigration and Asylum Act 1999 section 4, which provides a reduced support system for asylum seekers who had had their claim refused but were unable to return to their country of origin through reasons that were no fault of theirs, is not a solution.
