Book excerpt: "Patent litigation has assumed a pivotal role in today's global economy. In response to the increased prominence of patents, the Complex Litigation Committee of the prestigious American College of Trial Lawyers (ACTL) has authored a manual that provides a balanced view of the issues in each phase of a patent case for judges and lawyers. [This book]...covers all steps required to bring a patent case to trial, and the key elements that make such litigation unique. [This edition] specifically addresses the complex technical, procedural, and legal issues inherent in a patent lawsuit that are not usually found in other types of civil litigation. It is limited to the unique characteristics of patent litigation and has been added to the Federal Judicial Center's resource library for district court judges and their law clerks. The handbook provides concise coverage of the fundamentals, effective lessons from the most significant cases, and essential insights from leading experts and judges. The new third edition includes: a brand-new chapter 15, patent office inter partes review (IPR) and other AIA trial proceedings...addressing key features of PTAB trials and the impact of PTAB trials on patent litigation in federal courts; the impact of changes in the law resulting from numerous decisions from the Supreme Court, as well as the Federal Circuit Court of Appeals, including, what subject matter is eligible for patent protection, how the all-important claim construction determination is to be made and when attorneys fees should be granted; amendments to the Federal Rules of Civil Procedure that alter pleading requirements; and much more."--

Book excerpt: From Pulitzer Prize winner Raymond Bonner, the gripping story of a grievously mishandled murder case that put a twenty-three-year-old man on death row. In January 1982, an elderly white widow was found brutally murdered in the small town of Greenwood, South Carolina. Police immediately arrested Edward Lee Elmore, a semiliterate, mentally retarded black man with no previous felony record. His only connection to the victim was having cleaned her gutters and windows, but barely ninety days after the victim's body was found, he was tried, convicted, and sentenced to death. Elmore had been on death row for eleven years when a young attorney named Diana Holt first learned of his case. With the exemplary moral commitment and tenacious investigation that have distinguished his reporting career, Bonner follows Holt's battle to save Elmore's life and shows us how his case is a textbook example of what can go wrong in the American justice system. Moving, enraging, suspenseful, and enlightening, Anatomy of Injustice is a vital contribution to our nation's ongoing, increasingly important debate about inequality and the death penalty.

Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to further our understanding of the nature of administrative law doctrine and adjudication. It has three main aims. The first is to improve understanding of administrative law's 'anatomy' by pulling the subject apart and exploring the nature of the legal structures at play in adjudication. In doing so, the book emphasises three main ways in which administrative law's anatomy is both complex and diverse, namely: - administrative law doctrine interacts with a broad array of legislative frameworks; - administrative law adjudication seeks to accommodate a variety of legal values; and, - administrative law is concerned with legal relationships of different kinds. The second aim is to illustrate the importance of recognising the complexity and variety of administrative law's anatomy in three particular doctrinal contexts: procedural review, legitimate expectations and standing. The third and final aim is to raise an important but under-explored question: is it plausible and useful to attempt to make sense of administrative law doctrine by reference to a singular organising concept or principle? The overarching message of the book is one of cynicism. The complexity and variety of administrative law's legal structures probably means that attempts to explain the field 'monistically', while they may capture important themes, will be unhelpfully reductionist. Ambitious and thought-provoking, this is an important new statement on administrative law.

Book excerpt: An Anatomy of Louisiana Evidence Law is the first of its kind in Louisiana, representing a new trend in law school casebooks across the country. Much more than just a compilation of cases and notes, this book is a complete coursebook. It presents a detailed, thorough, and comprehensive examination of the law of evidence through the use of concise commentary and a number of pedagogical elements designed to both reinforce legal principles and to help bridge the ever-widening gap between law school theory and practice. This exceptionally organized casebook covers the entire Louisiana Code of Evidence with a treatise-like explanation of the legal principles, written in a reader friendly style. The casebook includes both Louisiana cases and select U.S. Supreme Court cases directly affecting Louisiana law with discussion questions to assist students in understanding the cases and concepts in each section. Reinforced by a summary of key points, students are presented with a straightforward presentation of the law, designed to better equip them to more fully engage in classroom lectures and discussion. This style of presentation of the law is coupled with numerous opportunities for application with over 400 original problems and practical application exercises. Throughout the book are comparisons of major distinctions between the Louisiana Code of Evidence and the Federal Rules of Evidence and a discussion of public policy concerns underlying the evidentiary principles to serve as a guide to understanding how the law should be applied and to better understand many of the distinctions in the state and federal laws.

The three stories play out simultaneously on stage, the dialogue from one scene overlapping with the other two in a manner that borders on the choral... Birch has provided a text that explores these ideas in a formally invigorating way." The Stage Three generations of women. For each, the chaos of what has come before brings with it a painful legacy. A powerful, unflinching look at a family afflicted with severe depression and mental illness. Presented as a triptych of plays performed side by side, this groundbreaking play reverberates with audiences and readers. Available in PDF, EPUB and Kindle. Book excerpt: This book is the result of forty years of teaching a course in Evidence at the law school level, and serving as a trial attorney and district judge and as a leader in Evidence studies with other lawyers and judges. It is based on the premise - often overlooked at the law school level - that the key generally is a recognition of how an evidentiary rule applies to a particular fact situation, and, usually, to make that recognition almost instantly and without any brotherly (or sisterly) help. It also is a recognition that evidence is part of the larger issue of proof, which encompasses much of the procedural rules in the federal and state jurisdictions. This book is not a substitute for a treatise on evidence law. What is attempted here is to provide materials that will help familiarize the student with the general rules of evidence and proof and to provide him or her with an opportunity to recognize the application of those rules to fact situations. Thus, after one familiarizes oneself with the basic rules of evidence and proof, problems are provided to give the user the opportunity to apply those rules in a trial-oriented fact situation. The book begins with a syllabus which outlines the anatomy of litigation from the selection of a cause of action through trial on the merits. The syllabus contains many valuable citations, but is not intended as an exhaustive treatment of the law. That work is left to the treatises. About the author: Professor Maraist joined the LSU Law Center faculty in 1974 after practicing law in Louisiana for ten years and teaching at multiple law schools across the country. He has served as a Louisiana Judge pro tem, authored numerous books and law review articles, and served as executive director of the Louisiana Judicial College and the Louisiana Association of Defense Counsel.
