Available in PDF, EPUB and Kindle. Book excerpt: This book explores the legal culture of the Parsis, or Zoroastrians, an ethnoreligious community unusually invested in the colonial legal system of British India and Burma. Rather than trying to maintain collective autonomy and integrity by avoiding interaction with the state, the Parsis sank deep into the colonial legal system itself. From the late eighteenth century until India's independence in 1947, they became heavy users of colonial law, acting as lawyers, judges, litigants, lobbyists, and legislators. They de-Anglicized the law that governed them and enshrined in law their own distinctive models of the family and community by two routes: frequent intra-group litigation often managed by Parsi legal professionals in the areas of marriage, inheritance, religious trusts, and libel, and the creation of legislation that would become Parsi personal law. Other South Asian communities also turned to law, but none seems to have done so earlier or in more pronounced ways than the Parsis.

Book excerpt: This new edition of a classic feminist book explains how one of the great historical revolutions - the ongoing movement toward equality between the sexes - has come about. Its origins are to be found, not in changing ideas, but in the economic developments that have made women's labour too valuable to be spent exclusively in domestic pursuits. The revolution is unfinished; new arrangements are needed to fight still-prevalent discrimination in the workplace, to achieve a more just sharing of housework and childcare between women and men, and, with the weakening of the institution of marriage, to re-erect a firm economic basis for the raising of children.

Focusing on the realm of political discourse, Ayalon looks at a wide array of evidence--local chronicles, travel accounts, translations of European writings, Arab political treatises, newspapers and periodicals, and dictionaries--to show how shifts in the color, tone, and meaning of the Arab vocabulary reflected a new socio-political and cultural reality.

Available in PDF, EPUB and Kindle. Book excerpt: 'Since the partition of India in 1947, Jammu & Kashmir has been a site of frequent unrest and violence. In Unravelling the Kashmir Knot, author and senior advocate Aman Hingorani applies a legal lens to ongoing debates surrounding the national identity of the region and its people, recounting how decades of misconceived policies have culminated in its current state of affairs. The book decrypts major milestones in the history of J&K, from the signing of the Instrument of Accession in 1947 and the Reference to the United Nations in 1948 to the Abrogation of Article 370 in 2023, critically examining their stipulations and impact on global opinion on the Kashmir issue. Drawing from personal correspondences and official documentation, Hingorani explores the role that larger-than-life figures like Jawaharlal Nehru, Mohammad Ali Jinnah and Louis Mountbatten played in shaping the Kashmir policies of their nations. He discusses the influence of Pakistan and China in J&K in the context of geo-political and strategic realities, and the possible depoliticization of the Kashmir issue through the International Court of Justice. Comprehensive yet accessible, Unravelling the Kashmir Knot plucks lesser-known details about J&K’s history from obscurity and emphasizes the importance of charting a realistic path forward to resolve the Kashmir issue.

Available in PDF, EPUB and Kindle. Book excerpt: During the last decade Europe has undertaken an active and broad process of harmonisation of choice-of-law rules within the EU. However, this drastic movement towards a harmonised system has so far left aside a highly relevant issue: the application by judicial and non-judicial authorities of the foreign law. In full contrast to the little attention so far paid to it in the EU, this issue is said to be the crux of the conflict of laws. It violates legal certainty and contradicts the objective of ensuring full access to justice to all European citizens within the EU. This book provides a comparative study of the existing situation in all EU member states and drafts some basic principles for a future European instrument. It will become a highly useful tool for lawyers, judges, notaries, land registries, academics, prosecutors etc.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, the authors propose a set of improved and modernised provisions expressing the general principles of criminal responsibility. This set of principles will comprise a 'General Part' which, it is proposed, will form part of Singapore's Penal Code. The key objective of devising and enacting the General Part is to significantly revitalise the Penal Code and restore many of its original technical attributes. Each chapter of this book comprises: (a) a carefully considered and drafted provision on a general principle of criminal responsibility; (b) a summary of the existing law in Singapore pertaining to that principle; (c) a selection of recent formulations of that principle from other jurisdictions to benchmark Singapore's law (both current and proposed) with international best practices; and (d) a comparison of these formulations with the provision proposed in this book for inclusion as a General Part in Singapore's Penal Code.
