Book excerpt: A PEN Translates Award-winning collection of short stories about life in North Korea under Kim Jong-Il, written in secret by a dissident author. The Accusation is a revelatory work of fiction that exposes the truth of the North Korean regime. Set during the period of Kim Jong-Il’s leadership, the seven stories that make up The Accusation throw light on different aspects of life in this most bizarre and horrifying of dictatorships. One story, “Life of a Swift Seed,” tells of a war hero and former ardent Communist who plants an elm tree in his back garden to commemorate one of his brothers-in-arms. When the tree is to be cut down to make way for a power line, the man is ready to defend it with his life, leaving a family friend to decide whether to intercede. In another story, “City of Specters,” a Pyongyang mother’s young son misbehaves during a party rally, crying out when he sees a portrait of Karl Marx, whom he thinks is a monster of Korean myth known as the Eobi. In one other story, a mother attempts to feed her husband during the worst years of North Korea’s famine, and in another, a woman in a perilous situation meets the Dear Leader himself. As a whole, The Accusation is a vivid and frightening portrait of what it means to live in a completely closed-off society, and a heartbreaking yet hopeful portrayal of the humanity that persists even in such dire circumstances. “Searing fiction by an anonymous dissident . . . A fierce indictment of life in the totalitarian North.”—New York Times

Book excerpt: A chilling investigation of America’s only alleged case of blood libel, and what it reveals about antisemitism in the United States and Europe. On Saturday, September 22, 1928, Barbara Griffiths, age four, strayed into the woods surrounding the upstate village of Massena, New York. Hundreds of people looked everywhere for the child but could not find her. At one point, someone suggested that Barbara had been kidnapped and killed by Jews, and as the search continued, policemen and townspeople alike gave credence to the quickly spreading rumors. The allegation of ritual murder, known to Jews as “blood libel,” took hold. To believe in the accusation seems bizarre at first glance—blood libel was essentially unknown in the United States. But a great many of Massena’s inhabitants, both Christians and Jews, had emigrated recently from Central and Eastern Europe, where it was all too common. Historian Edward Berenson, himself a native of Massena, sheds light on the cross-cultural forces that ignited America’s only known instance of blood libel, and traces its roots in Old World prejudice, homegrown antisemitism, and the resurgence of the Ku Klux Klan in the 1920s. Residues of all three have persisted until the present day. More than just the disturbing story of one town’s embrace of an insidious anti-Jewish myth, The Accusation is a shocking and perceptive exploration of American and European responses to antisemitism.

Available in PDF, EPUB and Kindle. Book excerpt: A Wall Street Journal bestseller! Alan Dershowitz, one of America’s most respected legal scholars and a New York Times bestselling author proves—with incontrovertible evidence—that he is entirely innocent of the sexual misconduct accusations against him, while suggesting a roadmap for how such allegations should be handled in a just society. “Maybe the question isn’t what happened to Alan Dershowitz. Maybe it’s what happened to everyone else.”—Politico Alan Dershowitz has been called “one of the most prominent and consistent defenders of civil liberties in America” by Politico and “the nation’s most peripatetic civil liberties lawyer and one of its most distinguished defenders of individual rights” by Newsweek. Yet he has come under intense criticism for applying those same principles, and his famed “shoe‑on‑the‑other‑foot test,” to those accused of sexual misconduct. In Guilt by Accusation, Dershowitz provides an in‑depth analysis of the false accusations against him, alongside a full presentation of the exculpatory evidence that proves his account, including emails from his accuser and an admission of his innocence from her lawyer, David Boies. Additionally, he examines current attitudes toward accusations of sexual misconduct, which are today, in the age of #MeToo, accepted as implicit truth without giving the accused a fair chance to defend themselves and their innocence, and suggests possible pathways back to a society and legal system in which due process is respected above public opinion and the whims of social media mobs. This book is Alan Dershowitz’s plea for fairness for both accuser and accused, his principled stand for due process no matter the allegation, and his compelling assertion of his own innocence. It is essential reading for anyone who wants to know the inside story behind the accusations against him or who cares about the current societal debate over how we should handle accusations of sexual misconduct. The #MeToo movement has generally been a force for good, but as with many good movements, it is being exploited by some bad people for personal profit. Supporters of the #MeToo movement must not allow false accusers to hurt real victims by hiding behind its virtuous shield, turning it into an exploitive sword against innocent people.

'Corporate Wrongdoing and the Art of the Accusation' is an exploration of accusations of wrongdoing, and the revelations these accusations expose about the dark side of capitalism and modern corporations, and their relationships with suppliers, buyers, peers, investment banks and state regulators. The study explores data gathered from the past twenty years, including over a thousand accusations of economic wrongdoing in corporate America. The research traces exchange paths or structural routes; cultural recipes or ideas about wrongdoing; and interactions between the culture and structure of transgression in economic in markets. Repertoires of accusation, and the three-way associations between accused, accuser and accusation, reveal the moral order of the market. The tools provided in this data collection and analysis provide a template for the study of the three-way relationship between the following: cultural items or types (i.e., accusation types), structural locations or paths (i.e., market interfaces) and time (i.e., temporal locations of types and paths, or recipes and routes). Repertoires unlock the moral order of the modern market and other institutions (family, politics, education, religion, science) as revealed in accusations of transgression.

Book excerpt: This book examines how the functioning of the International Criminal Court has become a forum of convergence between the common law and civil law criminal justice systems. Four countries were selected as primary examples of these two legal traditions: the United States, England and Wales, Germany and Poland. The first layer of analysis focuses on selected elements of the model of accusation that are crucial to the model adopted by the ICC. These are: development of the notion of the prosecutor’s independence in view of their ties to the countries and the Security Council; the nature and limits of the prosecutor’s discretional powers to initiate proceedings before the ICC; the reasons behind the prosecutor’s choice of both defendants and charges; the role the prosecutor plays in the procedure of disclosure of evidence and consensual termination of proceedings; and the determinants of the model of accusation used during trial and appeal proceedings. The second layer of the book consists in an analysis of the motives behind applying particular solutions to create the model of accusation before the ICC. It also shows how the model of accusation gradually evolved in proceedings before the military and ad hoc tribunals: ICTY and ICTR. Moreover, the question of compatibility of procedural institutions is addressed: In what ways does adopting a certain element of criminal procedure, e.g. discretional powers of the prosecutor to initiate criminal proceedings, influence the remaining procedural elements, e.g. the existence of the dossier of a case or the powers of a judge to change the legal classification of the criminal behavior appearing in the indictment?

Book excerpt: In this book ethnographic, historical and epidemiologic data are brought to bear on the subject of the Acquired Immune Deficiency Syndrome (AIDS) in Haiti. The forces that have helped to determine rates and pattern of spread of Human Immunodeficiency Virus (HIV) are examined, as are social responses to AIDS in rural and urban Haiti, and in parts of North America. History and its calculus of economic and symbolic power also help to explain why residents of a small village in rural Haiti came to understand AIDS in the manner that they did. Drawing on several years of fieldwork, the evolution of a cultural model of AIDS is traced. In a small village in rural Haiti, it was possible to document first the lack of such a model, and then the elaboration over time of a widely shared representation of AIDS. The experience of three villagers who died of complications of AIDS is examined in detail, and the importance of their suffering to the evolution of a cultural model is demonstrated. Epidemiologic and ethnographic studies are prefaced by a geographically broad historical analysis, which suggests the outlines of relations between a powerful center (the United States) and a peripheral client state (Haiti). These relations constitute an important part of a political-economic network termed the "West Atlantic system." The epidemiology of HIV and AIDS in Haiti and elsewhere in the Caribbean is reviewed, and the relation between the degree of involvement in the West Atlantic system and the prevalence of HIV is suggested. It is further suggested that the history of HIV in the Dominican Republic, Jamaica, Trinidad and Tobago, and the Bahamas is similar to that documented here for Haiti.

Available in PDF, EPUB and Kindle. Book excerpt: Sexual harassment is an issue in which feminists are usually thought to be on the plaintiff's side. But in 1993--amid considerable attention from the national academic community--Jane Gallop, a prominent feminist professor of literature, was accused of sexual harassment by two of her women graduate students. In Feminist Accused of Sexual Harassment, Gallop tells the story of how and why she was charged with sexual harassment and what resulted from the accusations. Weaving together memoir and theoretical reflections, Gallop uses her dramatic personal experience to offer a vivid analysis of current trends in sexual harassment policy and to pose difficult questions regarding teaching and sex, feminism and knowledge. Comparing "still new" feminism--as she first encountered it in the early 1970s--with the more established academic discipline that women's studies has become, Gallop makes a case for the intertwining of learning and pleasure. Refusing to acquiesce to an imperative of silence that surrounds such issues, Gallop acknowledges--and describes--her experiences with the eroticism of learning and teaching. She argues that antiharassment activism has turned away from the feminism that created it and suggests that accusations of harassment are taking aim at the inherent sexuality of professional and pedagogic activity rather than indicting discrimination based on gender--that antiharassment has been transformed into a sensationalist campaign against sexuality itself. Feminist Accused of Sexual Harassment offers a direct and challenging perspective on the complex and charged issues surrounding the intersection of politics, sexuality, feminism, and power. Gallop's story and her characteristically bold way of telling it will be compelling reading for anyone interested in these issues and particularly to anyone interested in the ways they pertain to the university.

Book excerpt: In No Crueler Tyrannies, Pulitzer Prize-winning journalist Dorothy Rabinowitz re-frames the facts, reconsiders the evidence, and demystifies the proceedings of some of America's most harrowing cases of failed justice. Recalling the hysteria that accompanied the child sex-abuse witch-hunts of the 1980s and 1990s, Rabinowitz's investigative study brings to life such alarming examples of prosecutorial terrors as the case against New Jersey nursery school worker Kelly Michaels, absurdly accused of 280 counts of sexual assault; the as-yet-unfinished story of Gerald Amirault's involvement in the Fells Acres scandal; Patrick Griffin, a respected physician whose life and reputation were destroyed by one false accusation of molestation; and Miami policeman Grant Snowden's sentencing of five consecutive life terms for a crime that, as proved in court eleven years later, he did not commit. By turns a shocking exposé, a much-needed postmortem, and a required-reading assignment for prosecutors and judges alike, No Crueler Tyrannies is ultimately an inspiring book about the courage of ordinary citizens who believe in the American judicial system enough to fight for due process.

Book excerpt: The Long-Awaited, Enormously Entertaining Memoir by One of the Great Artists of Our Time—Now a New York Times, USA Today, Los Angeles Times, and Publisher’s Weekly Bestseller. In this candid and often hilarious memoir, the celebrated director, comedian, writer, and actor offers a comprehensive, personal look at his tumultuous life. Beginning with his Brooklyn childhood and his stint as a writer for the Sid Caesar variety show in the early days of television, working alongside comedy greats, Allen tells of his difficult early days doing standup before he achieved recognition and success. With his unique storytelling pizzazz, he recounts his departure into moviemaking, with such slapstick comedies as Take the Money and Run, and revisits his entire, sixty-year-long, and enormously productive career as a writer and director, from his classics Annie Hall, Manhattan, and Annie and Her Sisters to his most recent films, including Midnight in Paris. Along the way, he discusses his marriages, his romances and famous friendships, his jazz playing, and his books and plays. We learn about his demons, his mistakes, his successes, and those he loved, worked with, and learned from in equal measure. This is a hugely entertaining, deeply honest, rich and brilliant self-portrait of a celebrated artist who is ranked among the greatest filmmakers of our time.

Book excerpt: This is the true story of a woman who prevailed against the most heinous accusations imaginable. Tonya Craft, a Georgia kindergarten teacher and loving mother of two, never expected a knock on her door to change her life forever. But in May 2008, false accusations of child molestation turned her world upside down. The trial that followed dragged her reputation through the mud and lent nationwide notoriety to her name. Tonya's life spiraled into a witch-trial nightmare in which she was deemed guilty before her innocence could be determined by a jury. Her children were taken away without even a goodbye, and her own daughter was forced to take the stand against her in a courtroom. The situation seemed hopeless, and Tonya was shell-shocked and heartbroken. But that didn't keep her from finding the strength to fight. Over the course of two terrifying years, Tonya rallied to take charge of her own defense, flying across the country and knocking on doors on a desperate quest for answers, and defying her own lawyers on more than one occasion. Tonya's goal was not only to avoid conviction; it was to clear her name, and, most of all, regain custody of her children. Accused is about more than Tonya's shocking trial and fight for justice. It is the story of a mother's extraordinary love, the faith that sees her through it all, and the forgiveness that sets her free.
