What beginning and end pages do you use? What do you do with the exhibits? When you're a new reporter, especially, you may be terrified if something out of the ordinary happens. This book attempts to provide answers to questions I receive frequently from court reporters about a variety of topics from how to correctly fill out a jobsheet to how to handle a particular type of situation to where to find information on something. This is a how-to manual for new and old reporters alike. Watch for an upcoming summer of 2010 workshop near you.

Excerpt: ...ground that the predicate was not sufficiently laid; that is, that suflicient search had not been made for the original in the places where it might be found, before resort was had to secondary evi-' dence. It appears from the bill that search and inquiry was made in the clerk's oflice and among his papers. The bill also makes it appear that the former district attorney, C. D. Spann, was the last person seen in possession of said mortgage during the former trial of the case; and Spann was not brought before the court, and no inquiry was made of him as to the whereabouts of said. original mortgage. In lieu of having Spann before the court, the State was permitted to prove by a witness that at a former trial of the case, said Spann, then district attorney, when on the witness stand made a statement in regard to the mortgage; that said Spann, at-a previous trial of the case, had the mortgage, which was the last time witness saw it; that Spann was present and represented the State at the second trial; and pending the proving up of the loss of the mortgage, Spann was put on the wit _ness stand, and the State inquired of Spann for the mortgage. The mortgage was not found at said second trial. The last time witness heard of Spann he was alive and well and in this State. This was an adroit method of getting before the court and jury the fact that Spann did not have the mortgage, but the testimony was hearsay. If the State could prove what it did, it could have gone further and proved all that Spann said about the loss of the mortgage at the trial. Witness was within the jurisdiction of the court and should have been produced. Williams v. State, 38 Texas Crim. Rep., 128. Appellant objected to the testimony of W. T. Powers in regard to a...

Excerpt: ...of the failure on the part of the trustees to perform such contract in whole or in part, so that neither the trustees nor the shareholders, present or future, in this trust shall be personally liable therefor." That in pursuance of this clause there was incorporated in the original lease contract the following clause: "It is further distinctly understood that the party of the first part is a joint stock association without personal liability of its stockholders and that for any debt, demand or damage arising under this instrument against the party of the first part, the party of the second part or other party in whose behalf such demand may arise shall look exclusively to' the trust property in the hands of the trustees of the party of the first part and upon no account and in no event shall there be any individual liability of the shareholders, party of the first part, or its trustees." The large amount of lands and other property in Texas owned by the Association is specifically set out and described in the petition. It is alleged that the Association owned all the lands for miles around the sawmill site so that in no event could plaintiff have operated the sawmill after the sale of its property by the Association. That, as above stated, plaintiff had agreed in set terms not to hold the members of the Association personally lia _ ble, but to look alone to the trust property for the satisfaction of its demands and that as a result it has no remedy except against the property and funds of the concern. That the contract of lease itself evinces a purpose on the part of the parties thereto to charge the property with a lien, and that if that does not do so an equitable lien clearly arises in favor of plaintiff by...
