Mais do que ferramentas auxiliares dos tradicionais processos de trabalho do Poder Judiciário, essas tecnologias são verdadeiros instrumentos de transformação digital. Elas impulsionam a substituição das antigas tecnologias judiciais por novas formas de funcionamento da Justiça, mais alinhadas às demandas da sociedade do século XXI por eficiência, transparência, responsabilidade, celeridade, dinamismo, flexibilidade, acesso igualitário e tratamento isonômico. A tecnologia deve alcançar os meios autocompositivos, servindo ao reforço do sistema multiportas de solução de controvérsias e à efetividade dos preceitos de nosso ordenamento que preconizam a autocomposição. A inovação tecnológica precisa ser colocada a serviço da almejada transição da cultura do conflito para a cultura da pacificação. (...) Um estudo mais apurado mostra, contudo, a partir dos Relatórios da Justiça em Números (CNJ), os efeitos nos últimos 12 anos na construção de uma cultura de pacificação de conflitos, reunindo pontos favoráveis e pontos a aperfeiçoar da Política Pública com claros de privilegiar sempre a garantia de acesso à Ordem Jurídica Justa como Direito Fundamental. As legislações promulgadas no ano de 2015, Lei de Mediação e Código de Processo Civil, trazem a ratificação da utilização do Sistema Multiportas para a abordagem qualificada dos conflitos de interesses, seja no âmbito do Poder Judiciário, seja no âmbito de Instituições privadas de resolu-ção de conflitos, bem como trazem em suas linhas a possibilidade da utilização das tecnologias da informação e comunicação como forma de resolver conflitos, em especial a conciliação e a mediação online. A Pandemia Global da COVID-19 do ano de 2020 "acordou" os sistemas de resolução de conflitos por meio das tecnologias. De uma hora para outra, a potencialização da mediação online evoluiu rapidamente em todo país. Diversas plataformas, sistemas, métodos digitais foram paulatina-mente permeando os usuários como forma de resolver conflitos, transformando a mediação online em opção fundamental e segura de abordagem dos conflitos. A Política Pública e as legislações específicas e esparsas evoluem a cada momento agregando as tecnologias como forma de resolver conflitos, com a observância de todos os cuidados necessá¬rios sobre segurança das informações e dados sensíveis. Contudo, é um caminho sem volta, pois a sociedade, cada dia mais conectada e dependente de sistemas digitalizados, aplicativos, plata¬formas, inteligências artificiais, entre outros, necessita de formas ampliadas de resolver conflitos.

In light of recent uprisings around the world against the neoliberal capitalist order, Saul Newman argues that anarchism - or as he calls it postanarchism - forms our contemporary political horizon. In this book, Newman develops an original political theory of postanarchism; a form of anti-authoritarian politics which starts, rather than finishes, with anarchy. He does this by asking four central questions: who are we as subjects; how do we resist; what is our relationship to violence; and, why do we obey? By drawing on a range of heterodox thinkers including La Boétie, Sorel, Benjamin, Stirner and Foucault, the author not only investigates the current conditions for radical political thought and action, but proposes a new form of politics based on what he calls ontological anarchy and the desire for autonomous life. Book excerpt: Duane Cady views warism and pacifism as polar extremes on a continuum that embraces a full spectrum of ethical positions on the morality of war and peace. Realizing that he could not intellectually defend the notions of just-war theory, he found that he was a reluctant pacifist, a discovery that spurred this exploration of a position that is simultaneously admired and discounted as naive. From Warism to Pacifism exposes the pervasive, subconscious warism that is the dominant ideology in modern Western culture. Like racism and sexism, this uncritical presumption that war is morally justifiable, even morally required, misguides our attitudes and institutions. In its place, Cady proposes the development of a positive concept of peace, a vision that is distinct from the mere absence of war.Citing common objections to pacifist values, he describes peace as something more than the mere absence of war and demonstrates that pacifism is a defensible position. The major difficulty of the peace movement, he suggests, is the absence of a positive peace vision. The peace movement will continue to fail if its sole focus is anti-war. A challenge is issued: to transform our national "insecurity policy" into a civilian-based nonviolent defense. Author note: Duane L.
