In this paper, we will discuss the value of strong IPR enforcement to mature economies vs. developing nations and where China lies on the economic maturity scale. While the legal frameworks are improving with China’s entry into the WTO, effective enforcement is far from satisfactory. The challenges focus around protectionism, corruption and cultural issues amongst others. The evidence shows an economy in transition that currently has little domestic motivation to enforce IPR rigorously. China faces significant international pressure to reform its practices surrounding IPR. The differing perspectives on IPR reflect the relative maturity of a nation’s economy. Developed countries rely heavily upon individuals, educational systems and commercial enterprises to continuously innovate. It is therefore natural for these nations to seek protection, preserving their competitive advantage and maximizing the value they can extract from the resulting innovation. China is a vast country trying to balance the prosperity and relative wealth of its 500 million coastal dwellers against the poverty of the 800 million living in the interior. This represents a great challenge for the government in balancing their long-term objective of transforming the economy vs. the short-term priorities of social equality, employment and the avoidance of civil un-rest. The rate of reform exhibited on IPR issues will be directly tied to the speed of emergence of Chinese firms capable of patentable innovation. A new generation of technology companies, entrepreneurs and designers will increasingly demand protection for their own IPR. We explore IPR issues in China across two broad industry groupings: “Research oriented” and “Design oriented”. Research oriented industries require high level of skills and tend to be capital intensive. Design oriented industries while requiring high skills, are not capital intensive and reveal rampant counterfeiting & piracy. Foreign firms try to protect their goods through security, quality & bundling service components with products, making them hard to replicate. Success is varied and in these sectors it appears as if counterfeiting and piracy is a price for market access and a low cost manufacturing base.

While there are extreme views on this, holding that, IPR is not at all a barrier, and, IPR is really a barrier, the debate has moved beyond such polarized positions. Scholars have come up with nuanced positions, supported by empirical research. There have been suggestions on using alternative models like Open Innovation that go beyond traditional approaches on innovation and IPR, to facilitate TT. This paper examines how Open Innovation and Open Source Models can be used to facilitate TT. It discusses Open Innovation and Open Source Models, and the various options like patent pools, and clearinghouses. It points out the scope and limitations of these models and the options in facilitating TT. Through a hypothetical example the application of Open Innovation Model to develop and transfer a technology relevant in mitigation, i.e. development of rice varieties with enhanced nitrogen use efficiency, is illustrated and IPR issues are examined. The paper suggests that Open Innovation Models can play an important role in facilitating TT in the context of climate change mitigation.

Book excerpt: Thirty years ago federal policy underwent a major change through the Bayh-Dole Act of 1980, which fostered greater uniformity in the way research agencies treat inventions arising from the work they sponsor. Before the Act, if government agencies funded university research, the funding agency retained ownership of the knowledge and technologies that resulted. However, very little federally funded research was actually commercialized. As a result of the Act's passage, patenting and licensing activity from such research has accelerated. Although the system created by the Act has remained stable, it has generated debate about whether it might impede other forms of knowledge transfer. Concerns have also arisen that universities might prioritize commercialization at the expense of their traditional mission to pursue fundamental knowledge-for example, by steering research away from curiosity-driven topics toward applications that could yield financial returns. To address these concerns, the National Research Council convened a committee of experts from universities, industry, foundations, and similar organizations, as well as scholars of the subject, to review experience and evidence of the technology transfer system's effects and to recommend improvements. The present volume summarizes the committee's principal findings and recommendations.
