Silverstein, includes cases with notes and explanatory text, additional commentary, essay, and short-answer problems, and multiple-choice review questions for each chapter. The cases selected are a balance of traditional and contemporary that reflect the development and complexity of contract law. Explanatory notes and text place the classic and newer decisions in their larger legal context. Questions and problems provide opportunities to practice core legal skills and encourage students to explore the relationship between theory and practice. This successful book is well known for approaching contract law and theory from multiple perspectives and using a variety of contractual settings. Adaptable for instructors with different pedagogical philosophies, Problems in Contract Law can easily be used in teaching by traditional case analysis, through problem-based instruction, or using theoretical inquiry. The purchase of this ebook edition does not entitle you to receive access to the Connected eBook with Study Center on CasebookConnect. You will need to purchase a new print book to get access to the full experience, including: lifetime access to the online ebook with highlight, annotation, and search capabilities; practice questions from your favorite study aids; an outline tool and other helpful resources. New to the 10th Edition: Five new principal cases that reflect advances in or improved statements of contract law. One restored principal case (Oppenheimer & Co. v. Oppenheim, Appel, Dixon & Co.) that provides valuable perspectives on a fundamental area of contract law. Twelve new problems, including several shorter problems, to provide more review options for teachers and students and to add contemporary fact patterns. Eight new tables and flow charts to assist students with the conceptual structure of complicated legal subjects. Editing of note and text material to reduce length without affecting coverage and to capture new legal developments. Reorganization of text and comment material to focus comments primarily on historical developments, allowing professors greater flexibility in assigning or deleting comments. Student accessibility to deleted cases from prior editions through Casebook Connect, allowing professors the further flexibility of continuing to easily assign cases for which they have a particular preference. Professors and students will benefit from: The authors’ emphasis on making the material accessible for both students taking and professors teaching the course - rejecting a hide-the-ball approach. The continued appeal to professors with various teaching methodologies: traditional, problem-oriented, theoretical, and practical. The comprehensive nature of the contents allows professors the flexibility to teach their students the basics or conduct a more in-depth analysis of a given topic. The continued mixture of classic and contemporary cases. Review questions at the end of each chapter that are primarily designed for students to perform self-assessments of their grasp of the material. Answers with explanations are included in an appendix within the book.

Connected eBooks provide what you need most to be successful in your law school classes. The Ninth Edition of Cases, Problems, and Materials on Contracts by Douglas J. Whaley and David Horton features classic cases, new developments, and thought-provoking problems to help students master contract law. Cases, Problems, and Materials on Contracts is known for pioneering the problem method of law school teaching. A staple in classrooms for decades, it stands out from other texts in the scope of coverage and its use of short, carefully constructed Problems to expose students to new concepts, reinforce what they have just learned, and stimulate thought. The Ninth Edition is more accessible than ever. It introduces complicated issues with a clear narrative summary or explicit statement of black-letter law. The cases have been tightly edited for the best effect. And as always, answers to the Problems appear in the Teacher’s Manual. The book can also be easily adapted to fit various pedagogical needs. Although it starts with “Agreement” and moves to “Consideration,” it is also designed for teachers who prefer to begin with “Consideration” or “Remedies.” It can be used in courses that both include and exclude sales. Finally, because it is shorter than most of its rivals, it works in 4-unit, 5-unit, and 6-unit courses. New to the 9th Edition: Cases have been further streamlined and edited for clarity. Expanded use of student-friendly introductions to complex material. Greater emphasis on recent decisions that involve issues to which students can relate. Professors and students will benefit from: The book covers the basics of Contracts Law in a format that allows greater exposure to the legal concepts through the many problems that fill each chapter alongside the most illustrative cases on point. The Assessment multiple-choice questions at the end of each chapter are meatier than such questions in most books, focusing not on the “right answer” so much as on what real attorneys must consider when confronted with the issues presented. Indeed, the whole book is written not just to teach the rules of law but to train the students to be lawyers faced with commercial issues. For example, Problems sometimes ask students whether they would be committing malpractice if they took a certain course of conduct, an issue very much on the mind of actual attorneys but seldom mentioned in law school classrooms.

A staple in classrooms for decades, it stands out from other texts in the scope of its coverage and its use of short, carefully-constructed Problems to expose students to new concepts, reinforce what they have just learned, and stimulate thought. The Eighth Edition, the first since the passing of Thomas Crandall and the addition of David Horton as co-author, is more accessible than ever. It introduces complicated issues with a clear narrative summary or explicit statement of black-letter law. The cases have been tightly edited for best effect. The book can also be easily adapted to fit various pedagogical needs. Although it starts with “Agreement” and moves to “Consideration,” it is also designed for teachers who prefer to begin with “Consideration” or “Remedies.” It can be used in courses that both include and exclude sales. Finally, because it is shorter than most other texts in this field, it works in 4-unit, 5-unit, and 6-unit courses. New to the Eighth Edition: Substantial input from a new co-author means that the book contains scores of new cases, Problems, and narrative introductions to issues. Each opinion has been streamlined to enhance readability. Where possible, applicable Restatement of Contracts and Uniform Commercial Code sections have been printed in the text, saving students the cost of buying separate supplements. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Selected Cases on the Law of Contracts: With Annotations To present any subject of the law by means of cases, is only to follow out the idea of Lord Coke, that "the reporting of particular cases is the most perspicuous course of teaching the right rule and reason of law"; but in studying the law by such cases, the caution of Lord Mansfield is to be observed, that "the law does not consist of particular cases, but of general principles, which are illustrated and explained by those cases." This book has been prepared for the purpose of presenting the general principles of the Law of Contracts, by the study of selected cases, which illustrate and explain different parts of that subject. The cases selected, with one exception, have been taken from the decisions of the Supreme Court of North Carolina. This course has its disadvantage, no doubt, in that perhaps a greater variety of fact and discussion might have been obtained by taking other American or English cases, but it has its advantage, in that it gives a connected view of the whole subject in one jurisdiction. It is not intended to give the law of one jurisdiction exclusively, for it will be found that the principles of the Law of Contract are the same in all the States which have adopted the common law, and even the statutory changes are similar in many respects. While the student is learning the general law of the subject, he is, at the same time, becoming thoroughly familiar with the decisions of his own State, or of a court which has always met with the highest consideration. This court has been in existence for a century, and almost every important question in the Law of Contracts has come before it in some form for discussion. Its judges have been men of approved learning and ability. Its views have always been conservative; and perhaps in no other State have the principles of the common law been more closely observed. There has been no attempt at originality of arrangement, in a subject which has been often discussed; but the cases have been selected to illustrate the general subjects usually presented in the leading text-books on contracts, and frequent references to authorities are given in the notes. The Contracts of Married Women and of Corporations, especially Municipal Corporations in North Carolina, are explained somewhat in detail, while the subjects of Bailment, Sales, Agency and Quasi Contracts are treated only in connection with other forms of contract. Book excerpt: The Seventh Edition casebook has several distinct aims. Those who prefer to emphasize the centrality of remedies, and the economic orientation that implies, will find the new order of chapters congenial. Those who cannot imagine not starting with a discussion of the concept of bargain, or even offer and acceptance, will find that they do not need to rip the book apart to do so. New teachers, who are likely to view the experience of teaching contracts very differently at the end of the semester, need not worry about conducting major surgery to change their approach the next year. The book is constructed out of relatively brief, interchangeable, and free-standing blocks. At the same time the authors continue to avoid the temptation to edit cases heavily. It remains very important to present a judicial opinion that discloses the judge's process of decision and enough of the reasoning underlying the conclusion for students to appreciate the decision making process. It appears that most students and teachers prefer newer cases and up-to-date issues for examination. The authors have sadly bid farewell to a number of old friends that have been replaced by more contemporary cases. These new cases present students with relevant issues stated in a currently recognizable voice.
