The U.S. Department of Health and Human Services (HHS) Administration for Children and Families (ACF) oversees TANF and child welfare programs, which are administered by states. GAO was asked to examine the (1) trends and composition of the child-only caseload, (2) characteristics of caregivers and children in nonparent child-only cases, (3) factors influencing the level of benefits and services for children with non-parent caregivers, and (4) coordination efforts between state TANF and child welfare programs. GAO analyzed federal TANF and child welfare data; surveyed states; interviewed HHS officials and researchers; and conducted site visits in Tennessee, Texas, and Washington, selected for variation in TANF caseload characteristics and implementation of programs to support relative caregivers. Book excerpt: The Temporary Assistance for Needy Families (TANF) block grant provides federal grants to states for a wide range of benefits, services, and activities. It is best known for helping states pay for cash welfare for needy families with children, but it funds a wide array of additional activities. TANF was created in the 1996 welfare reform law (P.L. 104-193). TANF funding and program authority were extended through FY2010 by the Deficit Reduction Act of 2005 (DRA, P.L. 109-171). TANF provides a basic block grant of $16.5 billion to the 50 states and District of Columbia, and $0.1 billion to U.S. territories. Additionally, 17 states qualify for supplemental grants that total $319 million. TANF also requires states to contribute from their own funds at least $10.4 billion for benefits and services to needy families with children -- this is known as the maintenance-of-effort (MOE) requirement. States may use TANF and MOE funds in any manner "reasonably calculated" to achieve TANF's statutory purpose. This purpose is to increase state flexibility to achieve four goals: (1) provide assistance to needy families with children so that they can live in their own homes or the homes of relatives; (2) end dependence of needy parents on government benefits through work, job preparation, and marriage; (3) reduce out-of-wedlock pregnancies; and (4) promote the formation and maintenance of two-parent families. Though TANF is a block grant, there are some strings attached to states' use of funds, particularly for families receiving "assistance" (essentially cash welfare). States must meet TANF work participation standards or be penalised by a reduction in their block grant. The law sets standards stipulating that at least 50% of all families and 90% of two-parent families must be participating, but these statutory standards are reduced for declines in the cash welfare caseload. (Some families are excluded from the participation rate calculation.) Activities creditable toward meeting these standards are focused on work or are intended to rapidly attach welfare recipients to the workforce; education and training is limited. Federal TANF funds may not be used for a family with an adult that has received assistance for 60 months. This is the five-year time limit on welfare receipt. However, up to 20% of the caseload may be extended beyond the five years for reason of "hardship", with hardship defined by the states. Additionally, states may use funds that they must spend to meet the TANF MOE to aid families beyond five years. TANF work participation rules and time limits do not apply to families receiving benefits and services not considered "assistance". Child care, transportation aid, state earned income tax credits for working families, activities to reduce out-of-wedlock pregnancies, activities to promote marriage and two-parent families, and activities to help families that have experienced or are "at risk" of child abuse and neglect are examples of such "nonassistance".

Temporary Assistance for Needy Families (TANF) is a form of cash assistance provided to families that are struggling to meet their basic needs. There are four purposes to the TANF program: provide assistance to needy families so that children can be cared for in their own homes; reduce the dependency of needy parents by promoting job preparation, work, and marriage; prevent and reduce the incidence of out-of-wedlock pregnancies; and encourage the formation and maintenance of two-parent families (DHHS Office of Family Assistance 2015). In regards to the child welfare system, there were over 600,000 children entering the in the child welfare system in 2012. These children can experience multiple placement changes and long-term stays in the foster care system which impacts their emotional, behavioral, and psychological well-being. This study focuses on four child welfare outcomes when assessing the impact of TANF benefits. These outcomes are: average length of time in care, percentage of children entering care, percentage of children exiting due to reunification, and average number of removals for each child. This study finds that TANF had an effect that was opposite to what was initially predicted. This study found that TANF did not have any effect on the four child welfare outcomes measured, as it was originally hypothesized that more generous TANF benefits would result in better child welfare outcomes.

Book excerpt: Child welfare services are intended to prevent the abuse or neglect of children; ensure that children have safe, permanent homes; and promote the well-being of children and their families. As the U.S. Constitution has been interpreted, states bear the primary responsibility for ensuring the welfare of children and their families. In recent years, Congress has annually appropriated between $7.6 billion and $8.7 billion in federal support dedicated to child welfare purposes. Nearly all of those dollars (97%) were provided to state, tribal, or territorial child welfare agencies (via formula grants or as federal reimbursement for a part of all eligible program costs). Federal involvement in state administration of child welfare activities is primarily tied to this financial assistance. The remaining federal child welfare dollars (3%) are provided to a variety of eligible public or private entities, primarily on a competitive basis, and support research, evaluation, technical assistance, and demonstration projects to expand knowledge of, and improve, child welfare practice and policy. At the federal level, child welfare programs are primarily administered by the Children's Bureau, which is an agency within the Administration for Children and Families (ACF) at the U.S. Department of Health and Human Services (HHS). However, three competitive grant programs (authorized by the Victims of Child Abuse Act) are administered by the Office of Justice Programs (OJP) within the Department of Justice (DOJ). Federal child welfare support is provided via multiple programs, the largest of which are included in the Social Security Act. Title IV-B of the Social Security Act primarily authorizes funding to states, territories, and tribes to support their provision of a broad range of child welfare-related services to children and their families. Title IV-E of the Social Security Act entitles states to federal reimbursement for a part of the cost of providing foster care, adoption assistance, and (in states electing to provide this kind of support) kinship guardianship assistance on behalf of each child who meets federal eligibility criteria. Title IV-E also authorizes funding to support services to youth who "age out" of foster care, or are expected to age out without placement in a permanent family. Legislation concerning programs authorized in Title IV-B and Title IV-E, which represents the very large majority of federal child welfare dollars, is handled in Congress by the House Committee on Ways and Means and the Senate Finance Committee. Additional federal support for child welfare purposes, including research and demonstration funding, is authorized or otherwise supported in the Child Abuse Prevention and Treatment Act (CAPTA) and the Adoption Opportunities program. Further, the Victims of Child Abuse Act authorizes competitive grant funding to support Children's Advocacy Centers, Court Appointed Special Advocates, and Child Abuse Training for Judicial Personnel and Practitioners. Authorizing legislation for these programs originated with the House and Senate Judiciary committees. Each child welfare program that receives discretionary funding is funded through April 28, 2017 at about 99.8% of the funding provided for each of the programs in FY2016. For child welfare programs receiving mandatory funding, the continuing resolution makes funding available at the rate needed to maintain the current law program, under the authority and conditions provided in the FY2016 appropriations act. While the continuing resolution allows federal funds to be awarded, until a final appropriations bill is enacted, the total amount of FY2017 funding that will be made available for a given program remains unknown and may be less (or more) than the annualized amount provided in the continuing resolution.

Book excerpt: This report examines recent research findings about Temporary Assistance for Needy Families (TANF) implementation as it has affected the nation's child welfare system. The nation's program of cash aid for needy families with children (TANF) and its program to protect and care for children who are abused or neglected (child welfare services) are linked by history and share some of the same clients who have similar service needs. Assessing the full significance of the 1996 welfare reform law (P.L. 104-193) to the child welfare system is complicated by the 1997 enactment of the Adoption and Safe Families Act (P.L. 105-89), which made direct and major changes to the child welfare system, and by the fact that TANF implementation generally occurred during a strong economy. Some child advocates were concerned that 1996 welfare reform initiatives ? including time limits, family cap policies, and work requirements ? might harm children and/or place new strains on the child welfare system. Research on the effect of TANF implementation has not produced conclusive findings. Changes in the size of the child welfare caseload have not been attributed to welfare reform, although certain work requirements may increase the incidence of child neglect. Welfare reform also changed specific child welfare funding streams and renewed calls for stronger collaboration between child welfare and cash aid programs. Here too the evidence of an effect on the child welfare system is inconclusive. Greater collaboration has occurred in some locations and the flexible funding of TANF, combined with a strong economy and rapidly declining cash assistance caseload, meant new resources became available for child welfare services in some states. Child welfare administrators are concerned, however, that because this money is not dedicated to their agencies it may not always be available. Further, the 1996 welfare reform continues to base eligibility for federal foster care and adoption assistance on whether the family a child is removed from was (or would be) eligible for cash aid as it existed in prior law (Aid to Families with Dependent Children, AFDC). This increased the complexity of determining eligible federal foster care and adoption assistance costs and, as the 1996 income and resource standards become dated, might diminish federal child welfare funds by establishing a diminishing pool of children eligible for federally reimbursable assistance. Finally, some child welfare advocates have also been concerned that children in families where no adult is receiving a TANF cash benefit ("child-only" cases) receive the necessary support, services and protection they require. The percentage of child-only cases has grown since enactment of welfare reform, although the actual number of these families being served has declined. Some states have used TANF funds to enact programs specific to the needs of child-only families, and many require involvement of child welfare agencies to access these new supports.
