Frank Upham shows conclusively that this view is mistaken and demonstrates that the law is extensively used, on the one hand, by aggrieved groups to articulate their troubles and mobilize political support and, on the other, by the government to channel and manage conflict after it has arisen. This is the first Western book to take law seriously as an integral part of the dynamics of Japanese business and society, and to show how an informal legal system can work in a complex industrial democracy. Upham does this by focusing on four recent controversies with broad social implications: first, how Japan dealt with the world's worst industrial pollution and eventually became a model for Western environmental reforms; second, how the police and courts have allowed one Japanese outcast group to use carefully orchestrated physical coercion to achieve wide-ranging affirmative action programs; third, how Japanese working women used the courts to force employers to eliminate many forms of discrimination and eventually convinced the government to pass an equal employment opportunity act; and, finally, how the Ministry of International Trade and Industry and various sectors of Japanese industry have used legal doctrine to cope with the dramatic changes in Japan's economy over the last twenty-five years. Book excerpt: This memorandum requests the immediate reallocation of a total of SDR8.1 million (US$ , 1115 million equivalent) of Credit proceeds under eight operations to support the SARS and Infectious Diseases Response Program (hereafter referred to as the "Program"). The objective of the Program is to: (1) address emergency needs for W&S-related diagnosis, clinical management, and personal protection that are necessary to bring the current epidemic fully under control; and (2) support the Government's efforts to strengthen the capacity of the public health system more generally so that China's health system is prepared to combat the possible re-emergence of SARS and, equally important, similar infectious disease threats that might occur in the future. There are 3 program components: Component 1 supports program planning, coordination, and policy development activities. Component 2 supports clinical management of SARS patients including setting up fever clinics, renovating designated SARS hospitals and wards, training female and male health care workers, strengthening personal protection measures for health care workers, providing emergency supplies, undertaking regular supervision, and carrying out operational research. Component 3 supports disease prevention and control, with a focus on SARS and other infectious diseases including strengthening disease surveillance and case reporting. The eight operations comprise: the Environmental Technical Assistance Project (report no. P6056), the Loess Plateau Watershed Rehabilitation Project (report no. 12593), the Yangtze Basin Water Resources Project(report no. 13674), the Southwest Poverty Reduction Project (report no. 13968), the National Rural Water Supply Project (report no. 16380), the Basic Health Services Project (report no. 17403), the Fourth Rural Water Supply and Sanitation Project (report no. 19226), and the Enterprise Reform Project (report no. 19300). In all cases the reallocations would neither compromise the original objectives nor the economic viability of the eight projects concerned. The respective Development Credit Agreement for each of the eight operations, listed will be amended to add a new component covering activities to be carried out under the SARS and Infectious Diseases Response Program and to enable Credit proceeds to be used to fund the activities. For activities that will be carried out by provinces, agreements will be entered into with each province for the carrying out of such activities using the proceeds of the Credit.
