Book excerpt: This study examines the issue of police use of deadly force. The International Association of Chiefs of Police (IACP) obtained 10 years of FBI data for 57 cities on police 'justifiable homicide' (as defined by the FBI Uniform Crime Reports), conducted a 54-city survey of police departments, and analyzed written policies to identify factors involved in deadly force incidents. The study found that departments with sufficient numbers of street supervisors providing tactical guidance and manpower support have a lower incidence of use of deadly force, as do departments having management policy directives regarding stakeout units. Other contributing factors to lower deadly force rates appear to be use of smaller caliber weapons and review of deadly force incidents by police chiefs. Model policy guidelines to assist police executives in exerting maximum control over use of deadly force in their units were developed after review of model standards on deadly force issued by the FBI, American Law Institute, President's Commission, IACP, Institute of Government Affairs, and American Bar Association.

Book excerpt: At a time when police abuses and errors make the headlines, it is important to understand just what goes into the decisions that police make when they are confronted with various crime scenarios in the line of duty. Required to respond within the law, many officers are able to respond in a legal manner to crime situations in which court decisions are written clearly and with easily applied guidelines. But what happens when those decisions and laws are written in a way that invites interpretation and varies from situation to situation? Based on a case study of New York City police officers, this important volume analyzes how officers contend with often-ambiguous laws in the face of specific crime scenarios. In addition, the author explores other influences on police decision making, including officer characteristics and attitudes, and makes policy recommendations in an effort to encourage the reinforcement of legal guidelines so that the rights of individuals are appropriately balanced with the duty to control crime. Based on a survey of nearly 1,300 officers' responses to specially designed hypothetical crime scenarios, this study illustrates how police officers are likely to react with regard to the law in these situations. While officers tend to act legally where the laws are clear, less clearly articulated laws leave the police with a variety of different options for action in ambiguous situations. For instance, in weapons scenarios, the survey showed that officers would often take advantage of ambiguity in the law with regard to how they may respond. In drug scenarios, officers will increase their tendency to do a search if the situation is slightly ambiguous, though they will decrease their search responses when the situation appears to be highly ambiguous. Eterno carefully examines the various responses and the laws that are meant to guide what police may or may not do in given situations, concluding that better laws and bright-line rules will help to check and balance the need to fight crime aggressively while preventing the abuse of authority that may arise in questionable circumstances.

The growth of police unionism in the united states during the 1960's has been a phenomenon of major importance in police management. Police unions in twenty-two urban areas were the target of this field study, during which interviews were conducted with police chiefs or their representatives, city labor relations representatives, police union leaders, and black officer organization leaders. The study explains the influences resulting in the recent rise of militancy in police unions and describes the present nature of these organizations. The effect of the lack of a single employer-figure on the form and conduct of collecting bargaining is discussed, as well as the impact of unions on labor-management relations. The study examines the dimensions of police union bargaining power and the use labor leaders make of this power in varying situations. The relationship between unionization and professionalization is analyzed, as is the impact of police labor organizing on the chief's ability to manage and on the formulation of law enforcement policy. The nature of black officer organizations, and the factors which led to their formation, are compared with similar characteristics of police unions, and the divergence of purpose is examined in relation to intra-departmental racial unrest. Appended is a bibliography on police unions and labor organizations.
