Book excerpt: Indictment against a slave, Nat, the property of John Carmatt, for hiring out his own time contrary to the Act of Assembly. He ran a boat on Blount's Creek. Debate over custom of some anti-slavery folk permitting persons of colour, who by law, are slaves, to go at large as free. This was contrary to the law and Nat was found guilty in the Court below. Judgment was reversed by the Supreme Court because the defendant should have been tried by the County Court and not by the Superior Court. Comparison to the case of 'State v Clarissa (a slave)'. Under Revised Statutes, chapter 111, section 31, a master was not indictable for permitting his slave to go at large, hiring his own time; he was merely subject to a penalty of [dollars] 40 and the slave was not indictable either. Under section 32 of the same act the owner was indictable for allowing a slave to go at large, as a freeman, exercising his own discretion in the employment of his time.

Book excerpt: Caesar, a slave, was indicted for murdering Kenneth Mizell, a white man, by striking him with a fence rail, to which he pleaded not guilty. It was proved that the deceased and one Brickhouse came across the prisoner and two other slaves, Dick and Charles, in a field whilst he and Brickhouse were drunk. The two, claiming to be patrollers, asked them to get some girls for them and then started to beat them; Caesar picked up the fence rail and lashed out at the pair, striking both and killing Mizell. Caesar was employed in getting timber and was deposed to be ordinarily obedient to white people. The prisoner's counsel moved the court to direct the jury that the immediate reaction of Caesar to such an assault by two drunken strangers with a weapon which was not a deadly one was manslaughter and not murder. The court declined this request, stating that the weapon had been a deadly one and that the killing of the perpetrator of an assault and battery of the type inflicted by the deceased, being one of a white man on a slave, could not in law be extenuated to manslaughter however worthless and degraded the white man might be. The jury found the prisoner guilty and sentenced him to death, from which he appealed. The Supreme Court ruled that, despite the differences in how the law treated white people and slaves with regard to their reactions to provocation, the killing by a slave, with one blow inflicted at the instant of attack and not repeated, of the white perpetretor of an assult was manslaughter only. Chief Justice Ruffin, however, dissented from this opinion. A new trial was ordered.

Whereas the former rest on the total dominion of the master over the slave and necessitate a concern for the slave's humanity, the latter rest of the purchase by the capitalist of a worker's labor power only and are concerned primarily with economic interest. Focusing on a wide range of issues that include contract and accident law as well as criminal law and the law of manumission, he shows how Southern slave law had to respond to the competing pressures of humanity and interest. Beginning with a critical evaluation of slave law, the author develops the conceptual framework for his own perspective on the legal system, drawing on the works of Marx and Weber. He then examines four appellate court cases decided in three different states, from civil-law Louisiana to commonlaw North Carolina, at widely separated times, from 1818 to 1858. Professor Tushnet finds that the cases display a continuing but never wholly successful attempt at distinguish between law and sentiment as modes of regulating social interactions involving slaves. Also, the cases show that the primary method of accommodating law and sentiment was an attempt to use rigid categories to confine the law of slavery to what was thought its proper sphere.
