Available in PDF, EPUB and Kindle. Book excerpt: Law enforcement agencies and their employees are continually at risk for potential liability related to torts, civil rights violations, and employment law issues. Litigation may involve suits by the public against officers and the administration, actions by the administration against officers, or actions by officers against the administration or members of the public they serve. Knowledge of these risks and understanding how they arise are essential to law enforcement officers, administrators, and their legal counsel. Police Liability and Risk Management: Torts, Civil Rights, and Employment Law is written by an attorney and a 34-year law enforcement veteran who knows his way around the streets and the courtroom. Dr. Robert J. Girod combines decades of teaching and practical experience with legal and academic education to compile this practical source of case law and risk management principles. The book is designed to help law enforcement professionals reduce police liability and avoid the risk of litigation—or, in the event a lawsuit does arise—to manage liability and defend themselves. In our litigious society, suits involving the law enforcement community are becoming a more common occurrence and can destroy an officer’s career or cast a pall on an entire department. By understanding the laws governing these types of issues, law enforcement professionals are better able to monitor the sources of liability and implement risk management strategies to shield their policies, practices, procedures, and protocols from the danger of liability.

Available in PDF, EPUB and Kindle. Book excerpt: Building on the strength of previous editions, the fourth edition presents a well-conceived, clearly stated analysis of complex issues confronting law enforcement officers and administrators. Law enforcement duties sometimes place police officers in vulnerable positions regarding their legal obligations and expose them to charges of misconduct. Civil liability is an extremely expensive proposition for police officers, law enforcement agencies, governments, andultimatelytaxpayers. Although substantial resources are often expended by the justice system to resolve liability cases, there are benefits to citizens. When the government assumes the responsibility to provide service or to protect the public, people injured by inadequate performance of those responsibilities deserve compensation; innocent parties who suffer injury should have an avenue for redress. The potential for litigation has been an impetus for better training and more responsible practices. Another excellent resource on the topic, Kappelers edited volume of Supreme Court cases, Police Civil Liability, Second Edition, allows students to understand firsthand the legal reasoning behind Court decisions dealing with these same issues.

Book excerpt: Police Liability: Lawsuits Against the Police provides insights and directions for police managers and trainers as they cope with liability suits filed against their agencies. The book encourages them to develop stronger and more meaningful policies, improved training, closer supervision, and more accountable discipline. Payne provides the readers with a detailed review of general police liability followed by a detailed review of 53 actual cases litigated against the police. Actual cases are presented in the chapters "Police Use of Force," "Police Pursuits," "General Police Procedures," and "Police Procedures when Conducting Homicide Investigations." Each of these chapters includes a review of relevant literature and case law, followed by the cases in point. The 53 cases are presented in three parts: an outline of the facts, critical issues and factors involved, and the author's commentary and recommendations for the police. The analyses presented in this book highlight strengths and weaknesses in police responses to actual incidents. Readers are provided with sufficient insights to change agency practices that lead to law suits and identify training issues to enhance police response to the focal areas covered in the book. "Payne has presented an excellent text for both the practitioner and the academian... After reading this text, I reviewed numerous cases involving the four areas examined by Payne and found the very issues presented in the text in real cases within my agency and in several surrounding communities. It is for this reason, and the user-friendly format of the text, that I strongly recommend this book for every member of the law enforcement community. I also feel that the text would be an excellent supplement to supervision curricula, leadership training, and law enforcement courses." -- William W. Johnson, Sr., Gloucester City (New Jersey) Police Department, Criminal Justice Review, Spring 2004

Book excerpt: Proactive policing, as a strategic approach used by police agencies to prevent crime, is a relatively new phenomenon in the United States. It developed from a crisis in confidence in policing that began to emerge in the 1960s because of social unrest, rising crime rates, and growing skepticism regarding the effectiveness of standard approaches to policing. In response, beginning in the 1980s and 1990s, innovative police practices and policies that took a more proactive approach began to develop. This report uses the term "proactive policing" to refer to all policing strategies that have as one of their goals the prevention or reduction of crime and disorder and that are not reactive in terms of focusing primarily on uncovering ongoing crime or on investigating or responding to crimes once they have occurred. Proactive policing is distinguished from the everyday decisions of police officers to be proactive in specific situations and instead refers to a strategic decision by police agencies to use proactive police responses in a programmatic way to reduce crime. Today, proactive policing strategies are used widely in the United States. They are not isolated programs used by a select group of agencies but rather a set of ideas that have spread across the landscape of policing. Proactive Policing reviews the evidence and discusses the data and methodological gaps on: (1) the effects of different forms of proactive policing on crime; (2) whether they are applied in a discriminatory manner; (3) whether they are being used in a legal fashion; and (4) community reaction. This report offers a comprehensive evaluation of proactive policing that includes not only its crime prevention impacts but also its broader implications for justice and U.S. communities.

An understanding of group behaviors and organizational dynamics is necessary to grasp the fundamentals of managing police officers. The Effective Police Supervision Study Guide coordinates with the core text used in many college-level classes and police departments to teach supervisory practices in criminal justice. This study guide prepares both students and professionals for academic or promotional exams, offering them an opportunity to fully review the material so that they are well-prepared for testing. This new edition, like the new edition of the textbook it accompanies, includes information on the following topics: police accountability, police involvement with news media, the challenges of dealing with social media, updates on legal considerations, and ways to respond to current issues facing law enforcement with COVID-19 and managing protests.

Available in PDF, EPUB and Kindle. Book excerpt: Theory and practice of police supervision are presented from a behavioral standpoint and guidelines are offered for their application. This book focuses on the growing importance of the inclusion of modern behavioral research findings in the theory and practice of police supervision. Conceiving the role of the police supervisor as that of controller, trainer, and shaper of human resources, the study examines the various dimensions of the supervisor's responsibilities and provides pragmatic guidelines for their fulfillment. A systems-oriented approach to modern organization theory is presented which views the police organization as highly dependent on its environment. Includes discussions of organizational communications -- the supervisor's vehicle for exerting control-and an examination of supervisory leadership in terms of mutual support, interaction facilitation, goal emphasis, work facilitation; and a study of the supervisor's role requirement for training personnel. These characterize the supervisor as a team leader with a basic responsibility for developing the human resources of the organization.
