The volume provides a detailed account of the structure and functioning of the Committee on Economic, Social and Cultural Rights in the light of its jurisprudence, through a study of the Committee’s procedures and practices (periodic reports and general comments), including taking into account the Optional Protocol for individual complaint procedure. The book considers the possible implications of the work of this Committee on other UN Committees, such as the Human Rights Committee and the UN Committee on the Rights of the Child, as well as considering the repercussions of its work on the international protection of fundamental rights, such as the right to education, to health and adequate food. The UN Committee on Economic, Social and Cultural Rights will be of particular interest to academics and students of International and Human Rights law.
Book Synopsis Complicity and its Limits in the Law of International Responsibility by : Vladyslav Lanovoy
Download or read book Complicity and its Limits in the Law of International Responsibility written by Vladyslav Lanovoy and published by Bloomsbury Publishing. This book was released on 2016-09-22 with total page 435 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the responsibility of States and international organizations for complicity (aid or assistance) in an internationally wrongful act. Despite the recognition of responsibility for complicity as a rule of customary international law by the International Court of Justice, this book argues that the effectiveness and utility of this form of responsibility is fraught with systemic and operational limits. These limits include a lack of clarity in its constituent elements, its co-existence with primary rules prohibiting complicity and the obligations of due diligence, its implementation and the underlying causal tests, its uncertain relationship to other forms of shared and indirect responsibility, and its potential as a form of attribution of conduct. This book submits that the content and elements of this form of responsibility need adjustments to respond more effectively to the phenomenon of complicity in international affairs. Book Synopsis The United Nations and Space Security by : Annette Froehlich
Download or read book The United Nations and Space Security written by Annette Froehlich and published by Springer. This book was released on 2019-08-10 with total page 129 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a detailed analysis on the history and development of the Committee on the Peaceful Uses of Outer Space (UNCOPUOS) and the Conference on Disarmament (CD) and the coordination and cooperation between these two fora. Furthermore, it discusses the future challenges that these fora will have to deal with and conclude in which way the current system can change to cope with the evolution of space matters. This is necessary for the proper discussion of space matters because these matters cannot simply be divided between military and non-military, but are interrelated.

Book Synopsis The Territorial Jurisdiction of the International Criminal Court by : Michail Vagias
Download or read book The Territorial Jurisdiction of the International Criminal Court written by Michail Vagias and published by Cambridge University Press. This book was released on 2014-10-16 with total page 379 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are many variables of territoriality available to national courts under contemporary international law. Does the same apply to the International Criminal Court? And if so, what are the limits to the teleological expansion of the Court's territorial jurisdiction as regards, for example, partial commission of a crime in State not Party territory, crimes committed over the internet or crimes committed in occupied territories? Michael Vagias's analysis of the law and procedure surrounding the territorial jurisdiction of the Court examines issues such as the application of localisation theories of territoriality and the means of interpretation for article 12(2)(a); the principle of legality (nullum crimen sine lege) and human rights law for the interpretation of jurisdictional provisions; compétence de la compétence; crimes committed over the internet; and the procedure for jurisdictional objections.
Book Synopsis The Last Year of President Kennedy and the "Multiple Path" Policy Toward Cuba by : Håkan Karlsson
Download or read book The Last Year of President Kennedy and the "Multiple Path" Policy Toward Cuba written by Håkan Karlsson and published by Routledge. This book was released on 2019-11-25 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents new aspects of the U.S. "multiple path" policy toward Cuba that was designed and adopted after the Missile Crisis (October 1962) until the assassination of President Kennedy on November 22, 1963, from a Cuban perspective. The policy was characterized by its contradictory profile, since simultaneously as aggressions were directed at Cuba, it also included the establishment of channels of communication with the Cuban government. The book also analyzes the Cuban–Soviet dispute during the same period. The Cuban experiences have still not been sufficiently discussed, and the aspects offered will enrich the knowledge of the U.S.–Cuban relationship during the mentioned period.
Book Synopsis Complicity and the Law of International Organizations by : Magdalena Pacholska

This book was released on 2020-04-24 with total page 275 pages. Available in PDF, EPUB and Kindle. Book excerpt: This timely book examines the responsibility of international organizations for complicity in human rights and humanitarian law violations. It comprehensively addresses a lacuna in current scholarship through an analysis of the mandates and modus operandi of UN peace operations, offering workable normative solutions and striking a balance between the UN’s duty not to contribute to international law violations and its need to discharge mandated tasks in a highly volatile environment.
Book Synopsis Protecting the Internally Displaced by : Phil Orchard
Download or read book Protecting the Internally Displaced written by Phil Orchard and published by Routledge. This book was released on 2018-11-01 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: Today, there are over 40 million conflict-induced internally displaced persons (IDPs) globally, almost double the number of refugees. Yet, IDPs are protected only by the soft-law Guiding Principles on Internal Displacement at the global level. Instead of a dedicated international organization, IDPs receive protection and assistance only through the UN’s cluster approach. Orchard argues that while an international IDP protection regime exists, many aspects of it are informal, with IDP issues bound up in a humanitarian regime complex that divides the mandates of key organizations and even the question of IDP status itself. While the Guiding Principles mark an important step forward, implementation of laws and policies based on them at the domestic level remains haphazard. Action at the international level similarly reflects an all-too-often ad hoc approach to IDP issues. Through an in-depth examination of IDP efforts at the international level and across the forty states which have adopted IDP laws and policies, Orchard argues that while progress has been made, new and greater monitoring and accountability mechanisms at both the domestic and international levels are critical. This work will be valuable to scholars, students, and practitioners of forced migration, international relations theory, and the Responsibility to Protect doctrine.
