Whether the proposition is one that the defendant was insane when he committed the alleged crime; or that the plaintiff seeking to recover from a rich corporation is a malingerer and a hypocrite; whether the man died from poison administered by the defendant or from natural causes, there can, it is sad to say, generally be found so-called experts who will swear whichever way they are paid to swear. Such witnesses are never prominent members of the profession. But whenever such testimony is given, which is influenced by the dollars received from one side or the other, a reflection of a discreditable character is cast upon the entire profession to which such witnesses belong. The com ments of the newspapers - their jokes in their funny columns - te garding the matter do not merely reflect on the individual physicians who permit themselves to be placed in an equivocal position, but on all other physicians in the community. Physicians are human, but not more than one in a hundred will be influenced in his testimony a hair's breadth by the fact that he receives fees for his services from one side or the other. But the one in a hundred - assuming that that is a proper proportion - is willing to be influenced, and the lawyer who approaches him outlines in every particular the sort of questions he will ask, on direct examination, and indicates the sort of answers he desires in return. A jury was no longer necessary under the law Of New Hampshire, guilt being admitted. The responsibility of determining the degree Of guilt is placed on the judge, and this depends on whether deliberation and pre meditation can or cannot be proved. It was a striking and never - to-be-forgotten moment when the jury, the supposed bulwark of justice and personal freedom, was dismissed, and on the judge alone was left the weight of deciding between life and death. It was, however, a weight more appar ent than real, for the question resolved itself into one of two degrees of guilt, and the first was already, inferentially at least, excluded by the agreement Of counsel that the prisoner should plead guilty because of his peculiar mental condition. A portion of this, the fourth day of the trial, was spent in the introduction Of evidence relative to Kelley's infancy and youth, corroborating the statements made in the opening Of the defense and adding to their force by fuller details. It appeared that he had been a normal child up to four years Of age, when the accident occurred resulting in an injury to the brain. As already stated, the seat Of this injury is distinctly visible as a depression in the left frontal bone. After the accident there were epileptic convulsions up to 13 or 14 years Of age. There was accompany ing moral perversion and strange conduct noticeable enough to lead to his being called foolish Joe, Kelley's fool, and so on. No other department comes so near home to the citizen as this. A few see the workings of the other departments, but the great majority are totally unacquainted with them except by hearsay. Their workings affect the people as a whole, and not as individuals. They seem far off, and their effects, though powerful, are mostly indirect and not easily described in their action. With the courts it is dif ferent. There is not a citizen in the land who does not come in contact with their operations. It is here that he is punished, that his wrongs are redressed, and his rights obtained. He is affected as an individual. He sees and hears for himself the causes by which effects are wrought upon his life, his liberty, his property, or his reputation. The fact need scarcely be pointed out that where such im portant interests are at stake, the instrumentalities em ployed in securing justice should be as perfect as possible. The great progress which has been made in the last cen tury in judicial science abundantly attests the general ap preciation of this fact by the English and American people. The matter of medical expert testimony furnishes, how ever, an exception. In this a conservatism has been dis played which evinces either a marvelous confidence in the infallible wisdom of their ancestors who founded the pres ent methods of procedure, or a neglect utterly at variance with the radical and reformatory ideas of the nation. Book excerpt: Excerpt from The War on Hospital Ships: From the Narratives of Eye-Witnesses On March 17th, 1916, the Russian hospital ship "Portugal" was lying off Rizeh, on the Turkish coast of the Black Sea. She was on her way from Batoum to Ofi with a string of flat-bottomed boats in tow, destined for the conveyance of wounded from the shore to the ship. One of these boats had become water-logged, and was being pumped clear while the "Portugal" lay to. The "Portugal" carried no wounded at the moment, but the Red Cross Staff was on board and the full crew. The weather was clear. Suddenly the look-out man saw a periscope approaching the vessel, but the ships officers explained to all hands that they were immune from attack. When the "Portugal" had first been commissioned for Red Cross work - she belonged to the Messageries Maritimes and still kept her French officers and crew - the Russian Government had notified the Turkish and Bulgarian Governments of the fact, and had obtained from them a recognition of her status. In the clear weather her distinguishing marks could not be unobserved. The only thing now necessary, the Captain and the Mate explained, was to keep calm, and to take no precautionary measures which might arouse the submarine commanders suspicion.
