Available in PDF, EPUB and Kindle. Book excerpt: The end of the post-World War II ‘long boom’ in the mid-1970s proved the beginning of a process of political-economic change that has fundamentally transformed labour law, both in Australia and across the developed world more generally. This is a phenomenon with deep ramifications for social justice. The dissolution of productive industry, the fragmentation of employment categories, the rise of profound employment precarity and an increasingly hostile legal environment for trade unionism have been of immense significance for key social justice issues, including income inequality, the rise of a new working-underclass, and the marginalization of organised labour. By combining the concepts of the Parisian Regulation Approach with an explicitly Marxist jurisprudence, this study offers a theoretically rigorous yet empirically sensitive account of legal transition, with key case studies in the metal, food processing and retail sectors. Given the similar development logic of post-World War II capitalism in Western societies, this theory, although operationalised in the Australian context, can be used in the effort to explain labour law change more broadly.

Book Synopsis Reshaping the Labour Market by : Sue Richardson
Download or read book Reshaping the Labour Market written by Sue Richardson and published by Cambridge University Press. This book was released on 1999-12-06 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: The outcomes of the labour market were the major economic and social problems of OECD countries. Inflation virtually disappeared, material standards of living on average were high, but 35 million people remained unemployed, inequality of earnings was rising and the establishment of regular employment was increasingly difficult for young people. In this 2000 book, a team of leading economists take Australia as a case study in which to examine whether regulation of the labour market assists or detracts from the achievement of desirable labour market outcomes. Attention is focused especially on the provision of adequate incomes and jobs for low-skilled workers, because this is the area in which labour markets around the world, including Australia, have failed most seriously in the past.

Download or read book Work Choices written by Andrew Stewart and published by Federation Press. This book was released on 2007 with total page 204 pages. Available in PDF, EPUB and Kindle. Book excerpt: Andrew Stewart and George Williams, leading scholars and media commentators, explain what has been called the most important decision of the Australian High Court since the Tasmanian Dam Case in 1983. They show what was being argued and why it was being argued, as well as what was decided and the implications for Australia’s future. They include key passages of the majority judgment, and from the dissents of Justices Kirby and Callinan. Is this “a destabilising intrusion of direct federal lawmaking into areas of legislation which, since federation, have been the subjects of State laws†(Justice Kirby)? Might it reduce State Parliaments to “impotent debating societies†(Justice Callinan)?
