Available in PDF, EPUB and Kindle. Book excerpt: Governmental Powers: Cases and Readings in Constitutional Law and American Democracy, written by prominent scholar and professor of constitutional law and political theory, Corey Brettschneider, explores the division, enumeration, and roles of the governmental powers established under the U.S. Constitution and the controversies arising from that system in the context of a changing American society. Like its parent volume, Constitutional Law and American Democracy, this text offers a wealth of highly focused case excerpts and interdisciplinary readings dealing with today s most salient debates. These carefully selected readings and cases focus on high-interest topics, including the nature and justification of judicial review, federalism, and separation of powers, and work together to create a nuanced view of key political and constitutional issues. Grounded in precedent, constitutional theory, and history, this bold work explores urgent issues of current debate and controversy making Governmental Powers fun to read and to teach. The clear, well-reasoned writing frequently challenges and always engages. A dynamic book drawing on a wealth of sources, Governmental Powers: Cases and Readings in Constitutional Law and American Democracy, features: An organization linking the history of the Constitution, constitutional law, and the structure of the federal government to contemporary issues and controversies A wealth of primary sources, including case excerpts, concurring and dissenting opinions, law journal and interdisciplinary articles, and published letters A new chapter on the nature and implications of the Supreme Court s 2012 decision regarding the Patient Protection and Affordable Health Care Act A focused selection of cases conveying a nuanced perspective on the Constitution and the political and constitutional disputes that have shaped its meaning Exposure to legal argumentation through astutely selected and edited readings from noted scholars and theorists Coverage spanning the history and development of constitutional law up to the present day, with ample background for considering the big-picture questions of constitutional doctrine and the Supreme Court s role A stimulating balance of foundational and cutting-edge topical coverage that doesn t sidestep provocative or controversial subject matter Overviews in each chapter introducing the constitutional arguments, chapter readings, and cases Discussion questions promoting comprehension, analysis, and classroom discourse Teachers of constitutional law have long awaited a text like this. Brettschneider blends the most important pertinent statements of political and legal theory with skillful excerpts from the major constitutional cases on governmental powers, civil rights, and civil liberties. Brettschneider s insightful commentaries make the text all the richer. Rogers M. Smith, Christopher H. Browne Distinguished Professor of Political Science, University of Pennsylvania

Available in PDF, EPUB and Kindle. Book excerpt: The value of the more general and abstract efforts of politi cal theory, of what may perhaps be called the philosophy of the state, is often questioned. It is urged on the one hand that the true science of politics cannot go beyond the study of the actual organization of government and of its relations to other social and economic institutions. On the other hand, it is asserted that political philosophy, because it is necessarily a priori in method, cannot do more than ring the changes on certain fundamental types of theory which were stated once for all in the far-distant past. Thus, for example, Professor Dunning in his recent book on Political Theories Irom Rousseau to SPencer says, "Greek Thought on this problem [the justification of authority and submission] in the fourth and third centuries before Christ in cluded substantially all the solutions ever suggested." 1) Nevertheless, with some ups and downs, political philosophy goes on; it is one of those subjects of pennanent human inter est which, whether "scientific" or not, men are not likely to abandon. To be sure, it does at times degenerate into an apol ogy for special interests in their endless struggle for power. This danger can scarcely be avoided when men undertake to weigh values and to estimate the importance of tendencies that have not yet eventuated in political fact. But notwithstanding this danger, the criticism of principles is indispensable.

Book excerpt: Public choice is the study of behavior at the intersection of economics and political science. Since the pioneering work of Duncan Black in the 1940s, public choice has developed a rich literature, drawing from such related perspectives as history, philosophy, law, and sociology, to analyze political decision making (by citizen-voters, elected officials, bureaucratic administrators, lobbyists, and other "rational" actors) in social and economic context, with an emphasis on identifying differences between individual goals and collective outcomes. Constitutional political economy provides important insights into the relationship between effective constitutions and the behavior of ordinary political markets. In Readings in Public Choice and Constitutional Political Economy, Charles Rowley and Friedrich Schneider have assembled an international array of leading authors to present a comprehensive and accessible overview of the field and its applications. Covering a wide array of topics, including regulation and antitrust, taxation, trade liberalization, political corruption, interest group behavior, dictatorship, and environmental issues, and featuring biographies of the founding fathers of the field, this volume will be essential reading for scholars and students, policymakers, economists, sociologists, and non-specialist readers interested in the dynamics of political economy.

Available in PDF, EPUB and Kindle. Book excerpt: Following one of the most contentious and truth-challenged presidential administrations and elections in U.S. history, there has never been a greater need for an American government text like this--evidence-based, critically thoughtful, and contemporary in tone and touch. This text teaches students to think analytically by presenting current political science theories and research in answering the engaging, big questions facing American politics today. It serves as an introduction to the discipline—covering the Constitution, political behavior, formal and informal institutions, and public policy--by reflecting the theoretical developments and types of empirical inquiry conducted by researchers. For introductory courses in American government, this text covers theory and methods as well. New to the Fourth Edition Provides 2020 election data updates throughout and examines policy implications of the ensuing changes in election laws across the country. Recaps controversial Trump administration policies and looks into the Biden administration’s early days. Offers strategic updates on the Covid-19 pandemic and the resulting economic crisis both in terms of questions of federalism as well as public policy. Considers the rise of new interest groups and social movements as well as the reckoning with racial injustice. Examines contemporary questions of social justice in light of civil rights and liberties as well as in terms of policy. Covers the death of Supreme Court Justice Ruth Bader Ginsberg, the battle to confirm her replacement, the addition of Justice Coney Barrett, and the policy implications of the shift in the ideological balance of the Court. For the fourth edition, a new co-author comes to the book with award-winning experience in diversity and teacher education as well as research interests in the presidency, women and politics, and foreign policy.
