Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Oxford Studies in Social and Legal History, Vol. 6: XI. Studies in the Hundred Rolls Some Aspects of Thirteenth-Century Administration; XII. Proceedings Against the Crown (1216 1377) The two monographs of the present volume are closely connected: they illustrate the two aspects of the Constitutional development of England in the thirteenth and fourteenth centuries. The inquests as to misdoings of officers and encroachments on public rights show the insistence of the Crown in its efforts to keep order and to suppress administrative abuses. But this very insistence was a source of hardship and gave rise to constant grievances, because the King and his ministers were apt to brush away established customs and to exert arbitrary despotism on the pretext of enforcing discipline and serving the interests of the Community. A strong opposition to such high-handed acts was manifested on many occasions, and found an appropriate basis in the juridical conceptions and traditions of feudal society - a society which looked upon convention and custom as the ruling principles of the law. Dr. Ehrlich traces the influence of this peculiar legalism in the early history of Proceedings against the Crown, and shows that the contradictory statements of Bracton's treatise are connected with different tendencies in the actual practice of the law. Indeed, it fills a very real gap in the history of Britain during the last hundred years. The book is a product of interdisciplinary collaboration by a distinguished group of constitutional lawyers, historians and political scientists, and draws where possible on primary sources. Its evaluation of the recent constitutional reforms will be of particular interest. This major interpretation of the constitution will remain authoritative for many years. It is essential reading for all those seeking to understand the impact of the constitutional reforms of recent years.

Communities crystallized upon them and the governments worked through them. This book describes the scope and procedures of the different courts, appointment of the judges, the beginnings of civil and criminal courts, the origin of the jury system and other aspects of the modern legal system. It is all shown by an analysis of actual reports of court cases of the time, giving a vivid picture of the life of the English people as well as of the ways of the professional lawyers, no less intricate than they are today.

Available in PDF, EPUB and Kindle. Book excerpt: This book pursues a comparative and interdisciplinary approach to assess presidential impeachments in Latin America. Mixing methodologies from legal studies and political science, it provides a novel and comprehensive assessment of some of the most controversial questions regarding the constitutional function of impeachment and its place in the theory of government. Presidential impeachments have become frequent in Latin America, yet they are still largely misunderstood by legal practitioners and the general public. As such, impeachments frequently provide for heated and polarizing debates. The misunderstandings stem from skewed expectations arising from different theories of government, legal interpretation, and presidential impeachment. The empirical evidence and arguments presented here will help to find common ground on these topics and pacify some latent tensions in society and academia. In addition, the book’s case studies cover cases that have been rarely or incompletely addressed in the literature. Some cover events so recent that they have never been analyzed elsewhere. The book proposes reconsidering certain assumptions made about systems of government, which are based on skewed expectations of impeachments. It also draws on new evidence to re-examine existing impeachment theories and develop new ones. By doing so, it offers valuable insights that may guide lawmakers to redesign their own systems, optimizing them to achieve certain goals. It will also acquaint legal practitioners with the strategies of prosecution, defense, and decision-making in connection with impeachments.

Book excerpt: The crucial first years of Henry IV's reign examined, to discover how he met and overcame the challenges created by his usurpation of the throne. Having seized the throne from his cousin Richard II in 1399, Henry Bolingbroke, the first nobleman to be made king of England since the twelfth century, faced the remarkable challenge of securing his power and authority over a kingdom that was divided and in turmoil. This collection of essays - the first such collection focusing specifically on the reign of the first Lancastrian king - by some of the leading historians of late medieval England, takes a fresh look at the crucial but neglected first years of Henry IV's reign, examining how Henry met and overcame the challenges which his usurpation created. Topics covered include a reappraisal of the events surrounding the revolutionof 1399; Henry's relations with his northern magnates; the Yorkshire rising of 1405; the "Long Parliament" of 1406 and the nature and purpose of the king's council. This collection adds significantly to an understanding of the character of Henry IV, as well as the circumstances in which he ruled, and will be essential for anyone with an interest in late medieval English political history. Dr GWILYM DODD is Lecturer in History at the University of Nottingham; Dr DOUGLAS BIGGS teaches at the Department of History at Waldorf College. Contributors: M. ARVANIGIAN, MICHAEL J. BENNETT, DOUGLAS BIGGS, JOEL BURDEN, GWILYM DODD, ANTHONY GOODMAN, ANDY KING, CYNTHIA J. NEVILLE, A.J.TUCK, SIMON K. WALKER.
