Book excerpt: Excerpt from Studies in the Civil Law: And Its Relations to the Jurisprudence of England and America, With References to the Law of Our Insular Possessions The first edition of this book was suggested by the fact that in the year 1894 the writer delivered a course of lectures on the Storrs foundation, on similar topics, before the Law School of Yale University. In preparing the second edition the work has been considerably enlarged, so as to embrace a wider scope in the same field. Since the first edition was published our country has acquired what we call our insular possessions. The private law of those islands is derived from Spain; and Spanish law in turn is largely of Roman origin. In preparing this volume I have kept the following points in view: firstly, to state the elements of Roman law; secondly, to trace the extension of that system to what we know as modern civil law states in Europe and America; thirdly, to give the student references to the law of our new possessions; and, finally, to compare the leading doctrines of the civil law with those of what we call the common law. I do not know of any other work of this special scope, and I hope it may be useful to students in law schools, as well as to my brethren of the bar. This book was released on 1997 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seeking to fill a gap in our knowledge of the legal history of the nineteenth century, this volume studies the influence of Roman and civil law upon the development of common law jurisdictions in the United States and in Great Britain. M. H. Hoeflich examines the writings of a variety of prominent Anglo-American legal theorists to show how Roman and civil law helped common law thinkers develop their own theories. Intellectual leaders in law in the United States and Great Britain used Roman and civil law in different ways at different times. The views of these lawyers were greatly respected even by nonlawyers, and most of them wrote to influence a wider public. By filling in the gaps in the history of jurisprudence, this volume also provides greater understanding of the development of Anglo-American culture and society.

Book excerpt: Excerpt from The Origin and Growth of the Common Law in England and America: A Study of Private Law, Comparing the Evolution of the Common Law and the Civil Law No one knows better than myself that this book is at best only an introduction, but a good introduction to law has a real place to fill. The authorities before each lecture are themselves only a selection, a selection which individual tastes would perhaps vary, but at least they will enable students to go further into the subjects discussed. Space compelled the. Limitation of cases to those in the Supreme Court. The Tables are useful, but necessarily brief and probably omit some. Available in PDF, EPUB and Kindle. Book excerpt: This volume contains a collection of studies composed at different times over a long series of years. It treats of diverse topics: yet through many of them there runs a common thread, that of a comparison between the history and law of Rome and the history and law of England. The author has handled this comparison from several points of view, applying it in one essay to the growth of the Roman and British Empires, in another to the extension over the world of their respective legal systems, in another to their Constitutions, in others to their legislation, in another to an important branch of their private civil law. The topic is one profitable to a student of the history of either nation; and it has not been largely treated by any writers before Bryce, as indeed few historians touch upon the legal aspects of history. This is volume one out of two.

This is more apparent with the use of some methods for comparison, such as legal transplant, natural law, or nation building. M.N.S. Sellers nicely portrayed the relationship. The past is a foreign country, its people strangers and its laws obscure.... No one can really understand her or his own legal system without leaving it first, and looking back from the outside. The comparative study of law makes one's own legal system more comprehensible, by revealing its idiosyncrasies. Legal history is comparative law without travel. Legal historians, perhaps especially in the United States, have been skeptical about the possibility of a fruitful comparative legal history, preferring in general to investigate the distinctiveness of their national experience. Comparatists, however, content with revealing or promoting similarities or differences between legal systems, by their nature strive toward comparison. Some American historians, especially since World War II, see the value in this"--

Available in PDF, EPUB and Kindle. Book excerpt: An essential, rigorous, and lively introduction to the beginnings of American law. How did American colonists transform British law into their own? What were the colonies' first legal institutions, and who served in them? And why did the early Americans develop a passion for litigation that continues to this day? In Law and People in Colonial America, Peter Charles Hoffer tells the story of early American law from its beginnings on the British mainland to its maturation during the crisis of the American Revolution. For the men and women of colonial America, Hoffer explains, law was a pervasive influence in everyday life. Because it was their law, the colonists continually adapted it to fit changing circumstances. They also developed a sense of legalism that influenced virtually all social, economic, and political relationships. This sense of intimacy with the law, Hoffer argues, assumed a transforming power in times of crisis. In the midst of a war for independence, American revolutionaries used their intimacy with the law to explain how their rebellion could be lawful, while legislators wrote republican constitutions that would endure for centuries. Today the role of law in American life is more pervasive than ever. And because our system of law involves a continuing dialogue between past and present, interpreting the meaning of precedent and of past legislation, the study of legal history is a vital part of every citizen's basic education. Taking advantage of rich new scholarship that goes beyond traditional approaches to view slavery as a fundamental cultural and social institution as well as an economic one, this second edition includes an extensive, entirely new chapter on colonial and revolutionary-era slave law. Law and People in Colonial America is a lively introduction to early American law. It makes for essential reading.
