It explains the development of the system of international criminal law enforcement in historical context, from antiquity through the Nuremberg and Tokyo Trials, to modern-day prosecutions of atrocities in the former Yugoslavia, Rwanda and Sierra Leone. The modern regime of prosecution of international crimes is evaluated with regard to international relations theory. The book then subjects that regime to critique on the basis of legitimacy and the rule of law, in particular selective enforcement, not only in relation to who is prosecuted, but also the definitions of crimes and principles of liability used when people are prosecuted. It concludes that although selective enforcement is not as powerful as a critique of international criminal law as it was previously, the creation of the International Criminal Court may also have narrowed the substantive rules of international criminal law.

In addition, increasingly sophisticated drug trafficking uses advanced information and telecommunications technologies to import and distribute illegal drugs without detection. For the first time in recent history, a Congressional Commission has set out to study the integration of widely disparate and often conflicting issues to strengthen the law enforcement fabric of the Federal Government while protecting democracy and the rights and liberties of individual citizens. The Commission saw its role as calling the Nation’s attention to the broadest concerns in national and international law enforcement. It also urges the Nation and its Federal law enforcement establishment to break down the barriers of institutional thinking and find new ways to approach the challenges of crime in the new century. Over its 2-year tenure, the Commission met more than 20 times and took verbal and sometimes written testimony from some 70 witnesses, including two members of President Clinton’s Cabinet and numerous presidential appointees. They identified that reforms are needed in six major areas: 1) To combat global crime, cybercrime, and terrorism; 2) Make it clear that the Attorney General has broad coordinating authority for Federal law enforcement, and minimize overlap and duplication 3) Provide the intelligence and information needed to combat terrorism; 4) Make global crime a national law enforcement priority; 5) Reverse the trend toward federalization; and 6)Focus on professionalism, integrity, and accountability.

At times the uneasy relationship between the ICC, the African Union, and a few influential African states has given rise to concerns about the future of international criminal justice in general, and in Africa in particular. Still, the enthusiasts for international criminal justice as enforced by the ICC, interpret the challenges that the ICC is encountering in Africa as part of the growing pains of a new institution in the international system. The distractors have already prepared the ICC's obituary. One of the criticisms levelled against the ICC, and which is the motivation for, and central theme behind, this book is that the ICC has morphed and ceased to be an independent legal institution, instead becoming a political tool utilized by politically powerful states in the West against their political opponents in Africa. More specifically, the Court is alleged to be selectively enforcing international criminal law by only officially opening investigations and prosecutions in Africa.
