This book tells what the courts have decided, the matter being couched in language that will be understood by the layman as well as the lawyer. To quote from the preface to Volume III: In its preparation, the constant aim has been to omit nothing vital, to cover all points of interest of both law and fact; to give as much space as necessary to new and exceptionally important points, yet, on the whole, to be as brief as possible without sacrificing anything of prac tical value. It is much more full and comprehensive than an ordi nary digest would be, and is at the same time in about the same pro portion less bulky and more readable than would be the several vol umes that would be required to report the same cases in full. It is probably all that; managers or other street railway officers will care for in the way of reports on the cases covered, while such attorneys as desire to see and use full opinions, when the occasion requires, will find it a'good medium for locating such as they want, as well as a convenient handbook for many other purposes. The arrangement chronologically and something of the style are attributable to the fact that the work was originally prepared for publication in the Legal Department Of the Street Railway Review. However, it is believed that there will be more gain than loss in this last fact. The index, which has been prepared with a good deal of care, will make the contents of the book readily available. Mathes v. Lowell, Lawrence & Haverhill Street Railway (Mass.), 59 N. E. Rep. 77. Jan. 4, 1901. A foot traveler whose course is across the tracks of a street railway, the supreme judicial court of Massachusetts holds, must exercise care to avoid being hurt by the cars, and if he is struck by a car and injured or killed, there can be no recovery, in a suit against the railway company for damages, unless the plaintiff shows by affirmative evidence that the traveler was in the exercise of due diligence to avoid injury. And, further, when the whole evidence has no tendency to show care on the part of the traveler, but, on the contrary, shows that he was careless, it is the duty of the court to direct a verdict for the defendant. Sufficient Diligence to Maintain Track in Safe Condition. Casper v. Dry dock, East Broadway & Battery Railroad Co. (N. Y. Sup.), 67 N. Y. Supp. 805. Dec. 31, 1900. Assuming in this case that there was evidence to go to the jury that at about 12 o'clock in the day a rail had become loosened, so that the plaintiff's foot was caught between the rail and the pavement, and that proof of this fact, unexplained, justified an inference of negligence, the first appellate division of the supreme court of New York holds that this presumption was rebutted, so that it was proper to direct a verdict for the defendant where the evidence showed that employes were constantly inspecting the road, and repairs were promptly made; that several trips had been made over it that day, before the accident, to ascertain if anything was out of order; that at about 11 o'clock an inspector had observed that there were two holes that needed spikes, and had immediately reported same by a note which he sent by a conductor, and that the repair was made shortly after 1 o'clock, or within about an hour after the accident. Book excerpt: Excerpt from Street Railway Law, Vol. 2: A Digest of Important Decisions in All Parts of the Country, Covering the More Important Class of Cases Which Daily Arise in the Management of Street Railways for Managers and Claim Departments The erection upon a public street of an elevated railroad imposes no additional servitude; where an additional use of a street has been granted by the city authorities to build and operate a street railroad an injunction will not be granted to restrain the construction or operation of the road at the suit of an abutting property owner until the resulting dam ages to his property are ascertained and paid, but his rem edy is by action at law for such damages. The proposition that a railroad unlawfully in a street is a public nuisance and liable as such to be abated at any time, and therefore a recovery for damages can only be had to ithe time of bringing the action is untenable; the injury would be a continuing and permanent one; therefore a sin gle recovery can be had for the whole damages, present and future. The abutting property owner having a complete remedy at law, courts of equity will not, upon his allegation that the ordinance authorizing the construction is illegal, enjoin the defendant from proceeding until the question of illegality can be litigated and determined, but will remit him to his action at law. Hill, daughter of Samuel Hill of South Boston. Her life ended prematurely through an illness on 15 September 1855. He married secondly, Susanna Champney Reed on 25 August 1858 in South Abington, Massachusetts. He was then serving as pastor of the High Street Baptist Church of Charlestown, Massachusetts. Rev. Colver pastored churches in Massachusetts, Michigan, Illinois and Wisconsin. He died 28 October 1896 in Chicago, Illinois. His second wife, Susanna, died 12 September 1889 also in Chicago.
