Book excerpt: This intellectual biography provides an organic framework for understanding Antonio Gramsci’s process of intellectual development, paying close attention to the historical and intellectual contexts out of which his views emerged. The Gramsci in Notebooks cannot fully account for the young director of L’Ordine Nuovo, or for the communist leader. Gramsci’s development did not occur under conditions of intellectual inflexibility, of absence of evolution. However, there is a strong thread connecting the “political Gramsci” with Gramsci as a “cultivated man.” The Sardinian intellectual’s life is marked by the drama of World War I, the first mass conflict in which the great scientific discoveries of the previous decades were applied on a large scale and in which millions of peasants and workers were slaughtered. In all of his theoretical formulations, this dual relation, which epitomizes the instrumental use of “simpletons” by ruling classes, goes beyond the military context of the trenches and becomes full-fledged in the fundamental relations of modern capitalist society. In contrast with this notion of social hierarchy, which is deemed natural and unchangeable, Gramsci constantly affirmed the need to overcome the historically determined rupture between intellectual and manual functions, due to which the existence of a priesthood or of a separate caste of specialists in politics and in knowledge is made necessary. It is not the specific professional activity (whether material or immaterial) that determines the essence of human nature: to Gramsci, “all men are philosophers.” In this passage from Notebooks, we find the condensed form of his idea of “human emancipation,” which is the historical need for an “intellectual and moral reform”: the subversion of traditional relations between rulers and ruled and the end of exploitation of man by man.

Book excerpt: A Treatise of Legal Philosophy and General Jurisprudence is the first-ever multivolume treatment of the issues in legal philosophy and general jurisprudence, from both a theoretical and a historical perspective. The work is aimed at jurists as well as legal and practical philosophers. Edited by the renowned theorist Enrico Pattaro and his team, this book is a classical reference work that would be of great interest to legal and practical philosophers as well as to jurists and legal scholar at all levels. The work is divided in two parts. The theoretical part (published in 2005), consisting of five volumes, covers the main topics of the contemporary debate; the historical part, consisting of six volumes (Volumes 6-8 published in 2007; Volumes 9 and 10, published in 2009; Volume 11 published in 2011 and Volume 12 forthcoming in 2016), accounts for the development of legal thought from ancient Greek times through the twentieth century. Volume 12 Legal Philosophy in the Twentieth Century: The Civil Law World Volume 12 of A Treatise of Legal Philosophy and General Jurisprudence, titled Legal Philosophy in the Twentieth Century: The Civil-Law World, functions as a complement to Gerald Postema’s volume 11 (titled Legal Philosophy in the Twentieth Century: The Common Law World), and it offers the first comprehensive account of the complex development that legal philosophy has undergone in continental Europe and Latin America since 1900. In this volume, leading international scholars from the different language areas making up the civil-law world give an account of the way legal philosophy has evolved in these areas in the 20th century, the outcome being an overall mosaic of civil-law legal philosophy in this arc of time. Further, specialists in the field describe the development that legal philosophy has undergone in the 20th century by focusing on three of its main subjects—namely, legal positivism, natural-law theory, and the theory of legal reasoning—and discussing the different conceptions that have been put forward under these labels. The layout of the volume is meant to frame historical analysis with a view to the contemporary theoretical debate, thus completing the Treatise in keeping with its overall methodological aim, namely, that of combining history and theory as a necessary means by which to provide a comprehensive account of jurisprudential thinking.

Available in PDF, EPUB and Kindle. Book excerpt: This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.

Available in PDF, EPUB and Kindle. Book excerpt: Available in English for the first time, Hegel and the Freedom of Moderns revives discussion of the major political and philosophical tenets underlying contemporary liberalism through a revolutionary interpretation of G. W. F. Hegel’s thought. Domenico Losurdo, one of the world’s leading Hegelians, reveals that the philosopher was fully engaged with the political controversies of his time. In so doing, he shows how the issues addressed by Hegel in the nineteenth century resonate with many of the central political concerns of today, among them questions of community, nation, liberalism, and freedom. Based on an examination of Hegel’s entire corpus—including manuscripts, lecture notes, different versions of texts, and letters—Losurdo locates the philosopher’s works within the historical contexts and political situations in which they were composed. Hegel and the Freedom of Moderns persuasively argues that the tug of war between “conservative” and “liberal” interpretations of Hegel has obscured and distorted the most important aspects of his political thought. Losurdo unravels this misleading dualism and provides an illuminating discussion of the relation between Hegel’s political philosophy and the thinking of Karl Marx and Friedrich Engels. He also discusses Hegel’s ideas in relation to the pertinent writings of other major figures of modern political philosophy such as Jean-Jacques Rousseau, John Locke, Edmund Burke, John Stuart Mill, Jeremy Bentham, Karl Popper, Norberto Bobbio, and Friedrich Hayek.

Book excerpt: This book is a treasure house of Italian philosophy. Narrating and explaining the history of Italian philosophers from the Middle Ages to the twentieth century, the author identifies the specificity, peculiarity, originality, and novelty of Italian philosophical thought in the men and women of the Renaissance. The vast intellectual output of the Renaissance can be traced back to a single philosophical stream beginning in Florence and fed by numerous converging human factors. This work offers historians and philosophers a vast survey and penetrating analysis of an intellectual tradition which has heretofore remained virtually unknown to the Anglophonic world of scholarship.

Available in PDF, EPUB and Kindle. Book excerpt: With a century of solid theory behind it, tax law confronts a new reality: the weakening of the tenacious link between the sovereignty of states and taxation. Yet it is to the continuity of certain themes and principles inherent in the various national tax systems that tax law scholarship continues to look, even as it develops new principles designed to meet the expanding processes of internationalization. This completely updated collection of essays offers an expert comparative analysis, conducted by a sample of the best international tax law scholars, of the fundamental theory of tax law and of the prospects in the near future of tax legislative systems. The emphasis falls naturally on tax theory, jurisprudence, and legislative development in the Member States of the European Union (particularly in Italy, Germany, and Spain), where the process of tax harmonization has been under way for many years. The effect of these processes, via the relevant tax treaties, on the tax systems of Japan and the United States provides a secondary emphasis. Practitioners and academics in tax law will find in this book an invaluable understanding of the challenges that tax law theory strives to meet at this crucial moment in economic history. The essays present a full and reliable exposition of the current theoretical approaches adopted by the various schools of thought in the field, as well as of the main contributions of jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a “form” that, when applied to different legal themes, would add a “material content” to the three-dimensional theory. We can point out, as a study plan, the distinction between “three” perspectives: Those of the legal norm, of the legal order, and the legal relationship. Three-dimensionalism also appears in this work when one analyzes the “three” phases of the life of the law: The formation, the interpretation, and the application; and in the distinction between the “three” characteristics of the legal order: Fullness, coherence, and unity—the theory of legal validity, intended as legitimacy, as validity strictly speaking, or as effectiveness.

Available in PDF, EPUB and Kindle. Book excerpt: Antonio Rosmini (1797–1855) was a genius who combined science and sanctity. His contribution turns on the theory of the suspended middle of the original relationship between the natural and the supernatural, which he experienced and elaborated. The device of the relationship between the original metaphysical-affective-symbolic structure of the believing conscience and the affective turn in metaphysics, intrinsically linked to his trinitarian ontology, allowed Rosmini to elaborate theories and epistemologies from a unitary perspective in various fields of knowledge. This volume indicates the implications of the unbreakable bond between Rosmini’s philosophy and theology in disciplines such as pedagogical science, political science, and juridical science. Following the favorable resolution of the “Rosminian question” the Catholic Church beatified Rosmini in 2007 and in 2018 indicated his theoretical-practical approach as a universal education model to be followed. Through essays by major experts in Rosmini’s thought, this curatorship offers an international public a brief, reasoned overview of Rosmini’s thinking on these disciplines, finally translated into English, so that this perspective can be understood and explored with particular regard to the possibility of encouraging ecumenical comparison between Rosmini’s suspended middle and, for example, that of Radical Orthodoxy.
