Book excerpt: The country has a strong private sector and received encouraging forecasts of new oil, gas and water reserves, which if harnessed appropriately bode well for future growth. While a pending international court case resulting from prior elections provoked a measure of uncertainty, the country’s medium to long-term economic outlook is robust. With over 40% of the population under the age of 15, Kenya stands to benefit from a significant demographic dividend, provided that sufficient jobs can be found when this population bulge enters the workforce. The country has a reasonably sized industrial base, competitive infrastructure and a large agricultural sector, all of which offer opportunities for capital-intensive investment.

Book excerpt: As the largest economy in the EAC and COMESA in terms of GDP, Kenya has positioned itself as a major economic power in sub-Saharan Africa. Traditionally a largely agrarian economy, Kenya has quickly entrenched its position as a manufacturing, logistics and technology hub in the region, and this diversification forms a solid platform from which the government can generate economic growth over the coming years. The resolution of the electoral process, improving business confidence and strong private consumption are likely to support GDP expansion over 2018 and into 2019. In April 2018 the IMF estimated the economy would expand by 5.5% in 2018 and 6% in 2019, compared to 4.8% in 2017.

Book excerpt: In the early part of 2007 The Law Society of Kenya, through the Governance, Justice, Law and Order Sector Reform Programme (“GJLOS”) of Kenya, undertook a review of the disciplinary machinery of the legal profession. This work, conducted by a team of consultants, was intended, inter alia, to review progress since the 2002 “Review of the Effectiveness of the Disciplinary Committee of The Law Society of Kenya and the Complaints Commission” by Mr. Mark Stobbs of the International Bar Association. This book is the result. Although the purpose of the project was to identify means of strengthening the disciplinary processes of the Kenya bar, its application is broader. There are generic and universal principles of good practice which are applicable in all countries and in more professions than just the legal profession. One difficulty faced by the consultants was to identify processes that reflected good practice and also were workable in the environment in which they were placed. This involved consideration of social, political and economic aspects of the environment. One of the major challenges facing the world today is the relative fragility of democracy, transparency, and the rule of law in many countries. This report, though intended for the benefit of Kenya, is a rich resource for other countries that might wish to review the disciplinary mechanisms for their legal professions, or other learned professions.

Book excerpt: Minority and indigenous women in Kenya are discriminated against on multiple levels; they are targeted because of their identification with a minority or indigenous group, and as women – both by cultural practices within their own community and because of gender discrimination more widely. This report examines the challenges and the new opportunities that have emerged with the passing of the new Constitution in 2010. The goal of the report is to reflect the voices and experiences of women from diverse minority and indigenous communities in Kenya. For hunter-gatherer women, many of whom have been displaced and forced to become squatters, community land rights are a primary concern. They view their lack of opportunities, basic services and education for girls as a direct result of their displacement. For pastoralist women, insecurity and conflict in areas where they live has a disproportionate impact on them. Cultural practices that are harmful to girls, such as female genital mutilation and early marriage, reduce girls’ access to education and entrench women’s poverty. For fisher peoples, environmental degradation and collapsing fish stocks are major fears. Women from these communities expressed their frustration at traditional gender roles that place much of the responsibility for meeting the family’s basic needs on women. While there is strong leadership from individual women in many of the minority and indigenous communities described in this report, the majority of women face ongoing violations of their human rights. Trapped in a cycle of poverty that they attribute directly to decades of marginalization, they fear that they and their children will not be able to take advantage of gains in the new Constitution. This report highlights actions identified by minority and indigenous women that should be taken by the government and other actors to support women’s empowerment and participation in the decision-making processes that directly affect them.

Book excerpt: This 2001 Article IV Consultation highlights that Kenya’s economic performance during the past decade has been well below its potential. This reflects the failure to sustain prudent macroeconomic policies and the slow pace of structural reform. Consequently, Kenya’s real per capita GDP is now lower than it was in 1990, and poverty is much more prevalent. Executive Directors have commended the authorities for achieving a measure of macroeconomic stability during recent years, in difficult circumstances. To help obtain tangible results, they have stressed the importance of departing from the “stop-go” policies of the 1990s.

According to the World Bank, GDP growth is expected to reach 5.4% for the year, aided in large part by sustained public sector capital spending. The country has a strong private sector and received encouraging signs of new oil, gas and water reserves, which if harnessed appropriately bode well for future growth. Book excerpt: The period immediately following Kenya's 2007 presidential election left a shocking trail of atrocities, with over 1,000 people dead and countless thousands left victimised and displaced. In response, the International Criminal Court began a series of investigations and trials, promising no impunity for even the highest ranking perpetrators. When the country's president and vice-president were implicated in the crimes, the case took on worldwide significance. The International Criminal Court and the End of Impunity in Kenya is a five-year study addressing critical human rights issues with a global reach and is the first detailed account of the ICC's intervention in Kenya. It probes the relationship between the ICC and state institutions, known as positive complementarity, and asks whether the ICC's intervention led to an end to impunity. The author provides comprehensive analysis of the Waki Commission's sealed envelope, the government's attempts to establish a special tribunal and the trials in The Hague. He also provides in depth consideration of any influence the ICC's intervention may have had on the passing of a new constitution, the establishment of a truth commission and important reforms to the judiciary, police and witness protection programme. Documenting the effects of these interventions on the Kenyan people, and on the country's legal and judicial systems, the book provides vital lessons in global justice as it: •Details the ICC's involvement in Kenya in the aftermath of extreme violence and instability •Evaluates the ICC prosecutor's strategy of positive complementarity •Identifies optimal conditions for positive complementarity to be effective •Links cultures of impunity to state-sponsored corruption •Explores the possible impact of the ICC on national and global policy •Discusses implications in responding to future crimes against humanity Replete with official government sources, The International Criminal Court and the End of Impunity in Kenya is necessary reading for researchers and practitioners working in public international law, particularly those specialising in conflict and post-conflict states.

Available in PDF, EPUB and Kindle. Book excerpt: The drafters of the ICC’s founding document, the Rome Statute, foresaw what would become the main challenge to the Court’s legitimacy: that it could violate national sovereignty. To address this concern, the drafters added the principle of complementarity to the ICC’s jurisdiction, in that the Court’s province merely complements the exercise of jurisdiction by the domestic courts of the Statute’s member states. The ICC honours the authority of those states to conduct their own trials. However, if the principle of complementarity is to be applied, states must ensure that their own judicial systems and trials are consistent with international standards of independence and fairness. In addition, for complementarity to work, the ICC must be willing to actively support, embrace, and implement the principle. If the Court holds on too tightly to a self-aggrandising view of its role in promoting international justice, then it will lose all credibility in the eyes of nation states. Finally, the international community, in calling on states to address war crimes committed within their borders, must provide the financial, technical, and professional resources that many struggling states need in this endeavour. This book sets forth several innovative recommendations to fulfil these goals so as to make future domestic war crimes courts work more effectively.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations estimates that four billion people worldwide live outside the protection of the law. These people can be driven from their land, intimidated by violence, and excluded from society. This book is about community paralegals - sometimes called barefoot lawyers - who demystify law and empower people to advocate for themselves. These paralegals date back to 1950s South Africa and are active today in many countries, but their role has largely been ignored by researchers. Community Paralegals and the Pursuit of Justice is the first book on the subject. Focusing on paralegal movements in six countries, Vivek Maru, Varun Gauri, and their coauthors have collected rich, vivid stories of paralegals helping people to take on injustice, from domestic violence to unlawful mining to denial of wages. From these stories emerges evidence of what works and how. The insights in the book will be of immense value in the global fight for universal justice. This title is also available as Open Access.
