Available in PDF, EPUB and Kindle. Book excerpt: State provisions for the education of exceptional children have become an established feature of State legislative structure. Every State makes provision for the education of extremely handicapped children in residential schools, 41 States authorize by law the inauguration of special educational facilities for exceptional children in local school districts, and 34 of these States make varying financial contributions to the maintenance of local programs. The time has come to consider the nature of these laws, what they have in common and how they differ, and what principles seem to evolve from them that may provide a guide for further developments. This report presents and analyzes the salient features of State legislation for the education of all types of exceptional children and suggests basic elements that should be included in any State legislative program of this type. While it does not deal with programs in various vocational rehabilitation agencies for handicapped adults and young people of employable age, it does involve provisions made for the education of handicapped youth in secondary schools, which may comprise specific vocational training. The study is limited specifically to instructional services and to those concomitant services which facilitate or are immediately tied up with the instructional program, and address the consideration of State provisions for the clinical study of children presenting serious problems of behavior. Sections include: (1) Some Definitions and Delimitations; (2) Exceptional Children and School Attendance; (3) Status of Residential Schools; (4) Special Education in Local School Districts; (5) State Supervision and Certification of Personnel; and (6) Conclusion: Some Basic Principles of State Legislation. An addendum notes the new State laws passed as of June 1, 1949, or amendments to existing statues. This publication gives an encouraging account of what the States have done through legislation to give to every exceptional child the educational opportunity which is his birthright. To be sure, legislative progress has been noted from time to time in printed documents. Compilations of laws have been made. But this report, it is believed, is unique in presenting and analyzing the salient features of State legislation for the education of all types of exceptional children and in drawing there from certain summaries and conclusions. Book excerpt: The text presents six chapters on the legal and governmental bases of special education. In the Introduction, F. Weintraub and J. Ballard cite the legislative and litigative history of P.L. 94-142, the Education for All Handicapped Children Act, and briefly address information sources on such policy issues as procedural safeguards, underserved populations, and standards of practice. In chapter 2, "The Education for All Handicapped Children Act of 1975 (P.L. 94-142): Its History, Origins, and Concepts," J. Zettel and J. Ballard review court cases and state and federal legislation, and list the rights of handicapped children, including the right to an appropriate education and the right to be educated in the least restrictive environment. J. Zettel in "Implementing the Right to a Free Public Education" analyzes five aspects of P.L. 94-142: zero reject, individualized education programs, least restrictive environment, nondiscriminatory testing and evaluation, and due process. In "Section 504: The Larger Umbrella," M. Gerry and J. Benton examine Section 504 of the Rehabilitation Act of 1973 in terms of its litigative background, statutory and regulatory setting, and enforcement. "The Education of Gifted and Talented Children from a Federal Perspective" by J. Zettel describes the cyclical nature of support and interest in education for gifted students. In the final chapter, "Interpreting the Rights of Exceptional Citizens through Judicial Action," B. Smith and J. Barresi summarize siginifcant cases concerning issues that have surfaced since passage of P.L. 94-142, including compensatory services, suspension and expulsion, and bilingual special education. Appendixes include a paper by J. Barresi and B. Ramirez, "The Federal Program Presence Accompanying P.L. 94-142," a list of federal laws for the handicapped from 1827 to 1981, and a list of resources. (CL)

Available in PDF, EPUB and Kindle. Book excerpt: Special education teachers, as a significant segment of the teaching profession, came into their own with the passage of Public Law 94-142, the Education for All Handicapped Children Act, in 1975. Since then, although the number of special education teachers has grown substantially it has not kept pace with the demand for their services and expertise. The roles and practice of special education teachers have continuously evolved as the complexity of struggling learners unfolded, along with the quest for how best to serve and improve outcomes for this diverse group of students. High-Leverage Practices in Special Education defines the activities that all special educators needed to be able to use in their classrooms, from Day One. HLPs are organized around four aspects of practice collaboration, assessment, social/emotional/behavioral practices, and instruction because special education teachers enact practices in these areas in integrated and reciprocal ways. The HLP Writing Team is a collaborative effort of the Council for Exceptional Children, its Teacher Education Division, and the CEEDAR Center; its members include practitioners, scholars, researchers, teacher preparation faculty, and education advocates--Amazon.com

Available in PDF, EPUB and Kindle. Book excerpt: Special Education Law, Sixth Edition, written by Laura Rothstein and Scott F. Johnson, provides a comprehensive and current overview of the major federal law, and judicial interpretations of those laws, that apply to special education students. School administrators and attorneys attend to special education issues on a regular basis, and local superintendents, principals, special education professionals, psychologists, and regional and state administrators must also be familiar with the legal requirements of educating students with disabilities. Classroom teachers in all types of classrooms need to be aware of the laws that affect them and their students. Special Education Law 6e is intended for students in education and educational administration, both graduate and undergraduate, as well as law students in courses on special education law, school law, and special education. The framework of this book begins with five introductory chapters on the major issues that are addressed in special education law. These topics include an overview the legal system, the history of special education, major statutes in special education law, stakeholders such as students, families, educators, and advocates, and finally, requirements for protection under various special education laws. The remainder of the text presents and analyzes special education case law within specific contexts. The text helps educators understand what the law requires so that they can make decisions that comply with these laws. Updates for the sixth edition include a major reorganization of the text. Chapters have been streamlined and edited for clarity, combining a previous chapter on Related Services with Free Appropriate Publication Education, and folding Eligibility into Identification, Evaluation, and Eligibility, so students can better see the connections between these topics. Many case excerpts have been shortened or summarized to provide students with a more straightforward and focused reading experience. The latest updates in statutes, regulations, and case law are included throughout the text.
