Though many states have drone laws "on the books" today, every state will eventually have one. For years now, state legislatures have grappled with the use of drones by their citizens. Much of this has occurred in the absence of clear regulatory guidance from the FAA. States were attempting to regulate an industry that was artificially hobbled by a vague, constantly changing federal regulatory scheme. Thankfully, the federal regulations are coming into focus. The long-awaited "Part 107" regulations for small unmanned aircraft systems - or "sUAS" - went into effect on August 29, 2016. Though there are still many questions about these regulations, at least they are in effect. Until they were in place, any commercial drone activity required a special exemption from the FAA. Without the exemption, no one could legally fly. Things are different now. Today, commercial drone operators have a clear path to operating legally under the FAA regulations. This means that many new companies are going to start flying, nationwide. When more drone entrepreneurs start flying under the new federal regulations, the practical effects of state laws that have been passed over the years will become clear. Legislative ideas that looked desirable to some when the drone industry was small may begin to hurt real businesses. This will happen in every state. If the drone industry is to thrive, entrepreneurs and the attorneys that serve them must understand what laws are "out there" that may impact the industry. This book is a step in that direction

If your electronic logbook is on your device, do you really want to give law enforcement or the FAA your mobile device? Furthermore, how are you to get the data off that device? * If you are marketing to a potential client, you can scan pages of your logbook and send it to them. It is more cumbersome to get the data off a phone or website. * What happens if your phone is stolen, water damaged, battery dies, or there is poor cell phone signal? * You don't have to worry about data theft like you would with a website or an app.* Paper is the current industry standard.

Many of these challenges, such as that of keeping drones away from manned aircraft, are matters that the Federal Aviation Administration (“FAA”) is clearly authorized and well equipped to address. However, several other drone policy challenges relate solely to drones' potential to disrupt landowners' privacy and to otherwise interfere with activities on the ground. The nature and severity of these conflicts often varies greatly depending on a drone's specific location: drone uses that are welcomed in some city neighborhoods may be prohibitively disruptive in others. The FAA, a centralized federal agency, lacks the information and resources necessary to effectively regulate these inherently local drone use issues in every corner of the country. Recognizing this fact, states and cities are increasingly crafting their own drone laws. Soon, some municipalities might even find it beneficial to adopt drone zoning ordinances that specifically restrict where, when, and under what conditions civilian drones may fly within their jurisdictions. Unfortunately, the FAA has taken the position that it holds exclusive regulatory authority over nearly every aspect of civilian drone activity -- a position that threatens to preclude the development of valuable state and local drone policies. What aspects of drone activity could be better regulated at the state or local level than at the federal level? And what principles should guide municipal governments as they craft drone policies for their own communities?
