Drawing on examples from the federal and state governments, Rules and Restraint explains in lucid, nontechnical prose why these budget rules tend to fail, and proposes original alternatives for imposing much-needed fiscal discipline on our legislators. One reason budget rules are ineffective, David Primo shows, is that politicians often create and preserve loopholes to protect programs that benefit their constituents. Another reason is that legislators must enforce their own provisions, an arrangement that is seriously compromised by their unwillingness to abide by rules that demand short-term sacrifices for the sake of long-term gain. Convinced that budget rules enacted through such a flawed legislative process are unlikely to work, Primo ultimately calls for a careful debate over the advantages and drawbacks of a constitutional convention initiated by the states—a radical step that would bypass Congress to create a path toward change. Drawing on empirical findings from field studies of eleven states in the American heartland, the authors demonstrate how budgeting at the state level has become more policy-oriented, requiring complex decision making by budget analysts. The incrementalist model of budgetary decision-making thus gives way to a multiple rationalities model. The authors illustrate the decision-making model with the story of two office examiners who have distinctly different orientations as they begin their work, and contrast the different decision nationalities that come into play for them at different points in a typical budget cycle. Fiscal restraints such as balanced budget rules limit the scope of government, while fiscal pressures such as education rights expand or place demands on government. After detailing the types of fiscal restraints and pressures in state constitutions, this paper discusses four limitations of state constitutions as they relate to achieving sustainable fiscal policies. It then discusses five principles for reform moving forward and calls for giving legislators more discretion about substantive policy matters while placing bounds on the overall scope of government.
