Book excerpt: Judgment by United States District Court for the District of Columbia, judgment date 14 August 2017. The taxpayer was a Swiss company that received dividends from a US corporation. The taxpayer petitioned the IRS for a discretionary reduction in the US tax rate on the dividends under article 10 and article 22(6) of the treaty. The taxpayer did not meet any of the objective criteria enumerated in article 22 of the treaty. The IRS denied the taxpayer's request on the ground that at least one of the principal purposes for moving the taxpayer's residency to Switzerland was to obtain tax benefits under the treaty. The US District Court held that the IRS applied the correct legal standard (i.e. the principal purpose test set forth in the accompanying Technical Explanation) to a host of indisputable relevant facts, and therefore the IRS's decision to deny treaty benefits to the taxpayer was not arbitrary.
