Read: In Favor of Free Kansas, Free White Labor, and of Fremont and Dayton, at the Eighth Ward Mass Meeting, Held in the Assembly Buildings, on Tuesday Evening, September 30, 1856 By the purchase of Louisiana we had acquired a claim to what was called Texas, and our western boundary in that quarter, between us and Spain, was unsettled and undefined. Spain owned the Floridas, which, by a resolution and acts passed in secret session in 1811 and 1812, but not published until 1818, Congress had determined should not pass into any other hands than our own. Available in PDF, EPUB and Kindle. Book excerpt: The fundamental fact about our Constitution is that it is old -- the oldest written constitution in the world. The fundamental challenge for interpreters of the Constitution is how to read that old document over time. In Fidelity & Constraint, legal scholar Lawrence Lessig explains that one of the most basic approaches to interpreting the constitution is the process of translation. Indeed, some of the most significant shifts in constitutional doctrine are products of the evolution of the translation process over time. In every new era, judges understand their translations as instances of "interpretive fidelity," framed within each new temporal context. Yet, as Lessig also argues, there is a repeatedly occurring countermove that upends the process of translation. Throughout American history, there has been a second fidelity in addition to interpretive fidelity: what Lessig calls "fidelity to role." In each of the cycles of translation that he describes, the role of the judge -- the ultimate translator -- has evolved too. Old ways of interpreting the text now become illegitimate because they do not match up with the judge's perceived role. And when that conflict occurs, the practice of judges within our tradition has been to follow the guidance of a fidelity to role. Ultimately, Lessig not only shows us how important the concept of translation is to constitutional interpretation, but also exposes the institutional limits on this practice. The first work of both constitutional and foundational theory by one of America's leading legal minds, Fidelity & Constraint maps strategies that both help judges understand the fundamental conflict at the heart of interpretation whenever it arises and work around the limits it inevitably creates.

Book excerpt: One hundred and fifty years after Kansas was admitted to the Union, we still find ourselves fascinated by the specter of "Bleeding Kansas" and the violence that preceded the American Civil War by five years. Although ample attention has been devoted to understanding why territorial violence broke out in Kansas in 1856, of equal concern but less illuminated is the question of why government, both local and national, allowed the violence to continue unstanched for so long. This question is fundamentally about governance-its existence, exercise, limits, and continuance-and its study has ramifications for understanding both Kansas events and why the American experiment in government failed in 1861. In addition, the book also sheds light on the nature of democracy, the challenges of implanting it in distant environs, the necessity of cooperation at the various levels of government, and the value of strong leadership. To Govern the Devil in Hell uses the prism of governance to investigate what went wrong in territorial Kansas. From the first elections in late 1854 and early 1855, local government was tarnished with cries of illegitimacy that territorial officials could not ameliorate. Soon after, a shadow government was created which further impeded local management of territorial challenges. Ultimately, this book addresses why Presidents Franklin Pierce and James Buchanan failed to act, what hindered Congress from stepping into the void, and why and how the lack of effective governance harmed Kansas and later the United States.

Book excerpt: A user’s guide to understanding contemporary free speech issues in the United States Americans today are confronted by a barrage of questions relating to their free speech freedoms. What are libel laws, and do they need to be changed to stop the press from lying? Does Colin Kaepernick have the right to take a knee? Can Saturday Night Live be punished for parody? While citizens are grappling with these questions, they generally have nowhere to turn to learn about the extent of their First Amendment rights. The Fight for Free Speech answers this call with an accessible, engaging user’s guide to free speech. Media lawyer Ian Rosenberg distills the spectrum of free speech law down to ten critical issues. Each chapter in this book focuses on a contemporary free speech question—from student walkouts for gun safety to Samantha Bee’s expletives, from Nazis marching in Charlottesville to the muting of adult film star Stormy Daniels— and then identifies, unpacks, and explains the key Supreme Court case that provides the answers. Together these fascinating stories create a practical framework for understanding where our free speech protections originated and how they can develop in the future. As people on all sides of the political spectrum are demanding their right to speak and be heard, The Fight for Free Speech is a handbook for combating authoritarianism, protecting our democracy, and bringing an understanding of free speech law to all.

Available in PDF, EPUB and Kindle. Book excerpt: The election of 1856 was the most violent peacetime election in American history. Amid all the violence, the campaign of the new Republican Party, headed by famed explorer John C. Frémont, offered a ray of hope that had never before been seen in the politics of the nation—a major party dedicated to limiting the spread of slavery. For the first time, women and African Americans became actively engaged in a presidential contest, and the candidate's wife, Jessie Benton Frémont, played a central role in both planning and executing strategy while being a public face of the campaign. The 1856 campaign was also run against the backdrop of a country on the move, with settlers continuing to spread westward facing unimagined horrors, a terrible natural disaster that took hundreds of lives in the South, and one of the most famous Supreme Court cases in history, which set the stage for the Civil War. Frémont lost, but his strong showing in the North proved that a sectional party could win a national election, blazing the trail for Abraham Lincoln's victory four years later.
