Y: February 3, 1863 The founders of our Republic were not ignorant of this fact: and, in the enacting clause of the Constitution, they declared one of its great objects to be, to establish justice. Tautological was it then in them to include liberty, among their purposes. For, without justice, there is no liberty; and what is liberty but justice - which, perceiv ing the true relation of all things, obeys them? Theseeternal relations of things are laws. Well may it then be said, that without law, there is no liberty. I stand before you the defender of law. A citizen of the United States, and a Republican, I would vindicate my party, and my country; for I believe they are one. I stand by the Union, the Constitution, and the laws. T 116 Constitution as it is. The Union as our designed it: as it ought to be: based not upon injustice, usurping the name of law; but truly upon the law of nature, and of nature's God. First, then, we claim the name of Republican, be cause it best represents what we are; it is a good name: let us never abandon it It is not our fault, in this crisis of life and death to the nation, that party names and party organizations are revived. I ardently hoped that, in this struggle for our national being, all citizens of the United States of America would have stood for them, in support of their chosen powers that -be. But the Democratic party has decreed otherwise: and we have nothing left but to accept the issue. I accept it with reluctance, but not with fear. I have no personal enmities to avenge the friends of my country are my friends: the enemies of my country are my enemies. If we are right, we will stand if we are wrong, we will fall. It is a signifi cant fact, that, the foes of our Republic abroad, in the rebel States, and in our Northern homes, all take common ground against us. Free Speech, “The People’s Darling Privilege” refutes this misconception by examining popular struggles for free speech that stretch back through American history. Michael Kent Curtis focuses on struggles in which ordinary and extraordinary people, men and women, black and white, demanded and fought for freedom of speech during the period from 1791—when the Bill of Rights and its First Amendment bound only the federal government to protect free expression—to 1868, when the Fourteenth Amendment sought to extend this mandate to the states. A review chapter is also included to bring the story up to date. Curtis analyzes three crucial political struggles: the controversy that surrounded the 1798 Sedition Act, which raised the question of whether criticism of elected officials would be protected speech; the battle against slavery, which raised the question of whether Americans would be free to criticize a great moral, social, and political evil; and the controversy over anti-war speech during the Civil War. Many speech issues raised by these controversies were ultimately decided outside the judicial arena—in Congress, in state legislatures, and, perhaps most importantly, in public discussion and debate. Curtis maintains that modern proposals for changing free speech doctrine can usefully be examined in the light of this often ignored history. This broader history shows the crucial effect that politicians, activists, ordinary citizens—and later the courts—have had on the American understanding of free speech.
