Available in PDF, EPUB and Kindle. Book excerpt: There is no better key to the strengths and weaknesses of the Soviet social system than Soviet law. Here in English translation is the Criminal Code and Code of Criminal Procedure of the largest of the fifteen Soviet Republics--containing the basic criminal law of the Soviet Union and virtually the entire criminal law applicable in Russia--and the Law on Court Organization. These two codes and the Law, which went into effect o January 1, 1961, are among the chief products of the Soviet law reform movement which began after Stalin's death, and are a concrete reflection of the effort to establish legality and prevent a return to Stalinist arbitrariness and terror. In a long introductory essay Harold Berman, a leading authority on Soviet law, stresses the extent to which the codes are expressed in authentic soviet legal language, based in part on the pre-Revolutionary Russian past but oriented to Soviet concepts, conditions, and policies. He outlines the historical background of the new codes, with a detailed listing of the major changes reflected in them, interprets their significance, places them within the system of Soviet law as a whole, and discusses some of the principal similarities and differences between Soviet criminal law and procedure and that of Western Europe and of the United States.

Book excerpt: An Introduction to the Soviet Legal System (1969) sets the main features of modern Soviet law against their background in Russian legal history and Marxist political thought. Important constitutional provisions are examined in detail and their value in practice considered. In the second part of the book special emphasis is given to those parts of the system most likely to interest the general reader and the non-legal specialist in Soviet affairs. Criminal Procedure and Family Law are considered in detail, as are Trade Unions and the settlement of Labour Disputes. Special features of the Soviet legal system such as the legal position of the State Bank, collective farms and the state-controlled commercial and industrial enterprises are examined. The final chapter is devoted to the work of the Soviet legal profession.

Book Synopsis Choosing for Juries by : Nazim Ziyadov
Download or read book Choosing for Juries written by Nazim Ziyadov and published by Maklu. This book was released on 2013 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Why do governments try to limit the application of jury trials, both in countries where jury trials are native and in countries that have more recently instituted them? This is a critical question today as government authorities are trying to limit the role of juries, especially when it comes to complex fraud cases, national security/terrorism cases, and cases where juries seem to have a propensity for high acquittal rates. Therefore, understanding how governments are promoting and constraining jury trials is important. This book analyzes the reasons that motivate governments to introduce jury trial practices and the factors that condition the role these types of trials play in the administration of criminal justice systems as a whole. The book's research derives its finding from the comparative analysis of criminal justice systems of the United Kingdom, the Russian Federation, and the Republic of Azerbaijan. It also assesses prospects of the application of jury trials in the Republic of Azerbaijan based on analysis of the criminal justice systems of countries where these practices already exist.

Book Synopsis Complaints to the Authorities in Russia by : Elena Bogdanova
Download or read book Complaints to the Authorities in Russia written by Elena Bogdanova and published by Routledge. This book was released on 2021-06-10 with total page 153 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers the process of legal modernization in Russia from the development of the mechanism of complaints addressed to the authorities from the pre-revolutionary period to today. It analyzes wide-ranging data and sources, collected over 17 years, such as legislation, in-depth interviews, archival materials, original texts, and examples of different methods of complaints in Soviet and contemporary Russia. Being marginal to the legal system and almost invisible for researchers of legal development, the complaint mechanism has functioned as an extremely important way of restoring justice, available to the majority of people in Russia for centuries. It has survived several historical gaps and, in a sense, acts as a thread that stitches together different eras, coexisting with the establishment and modernization of legal institutions, compensating, accompanying, and sometimes substituting for them. The research covers a period of over 100 years, and shows how and why at major historical crossroads, Russia chooses between full-fledged legal modernization and saving the authoritarian social contract between the state and society. This book will be especially useful to scholars researching Soviet society and Post-Soviet transformations, socio-legal studies, and liberal legal reforms, but will also appeal to those working in the broader fields of Russian politics, the history of Soviet society and justice issues more generally.
