It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. Ces mesures sont mises en place lorsque l’état mental d’un patient nécessite des soins immédiats assortis d’une surveillance médicale constante ou régulière, et que les troubles mentaux rendent impossible son consentement. Les médecins jouent un rôle clé dans l’instauration des mesures de SSC qu’ils doivent justifier d’un point de vue médical dans leurs certificats. L’objectif de ce travail était d’explorer les difficultés rencontrées par les Médecins Généralistes (MG) en libéral pour initier une mesure en SSC en psychiatrie. Méthode : Il s’agit d’une étude qualitative par entretiens individuels semi-dirigés avec une analyse par phénoménologie interprétative auprès de MG de la région Lilloise. L’analyse thématique et la triangulation des données ont été réalisées à l’aide du logiciel NVivo12â. Résultats : Les dix MG interrogés étaient intéressés par ce sujet. En revanche, ils le trouvaient complexe pour plusieurs raisons. Tout d’abord, ils n’étaient que très rarement confrontés à ces situations, et n’avaient donc pas l’habitude de mettre en place des mesures de SSC. De plus, ils n’étaient pas tous au fait des dernières évolutions de la législation. Les différents types de mesures de SSC n’étaient pas parfaitement connus de l’ensemble des MG. Ils ne savaient pas toujours quel certificat médical initial utiliser, ni comment le rédiger. Les MG rapportaient l’aspect chronophage de la mise en place de SSC, difficilement compatible avec leur activité libérale. Les MG suggéraient la mise en place d’une permanence téléphonique psychiatrique d’une part pour valider ou non l’indication du SSC et d’autre part pour connaitre la marche à suivre et s’assurer de la conformité médicolégale. Conclusion : La collaboration entre MG et psychiatres est cruciale. Une permanence téléphonique psychiatrique pourrait renforcer cette collaboration et permettre de pallier une partie des difficultés rencontrées par les MG. Connaitre les attentes des psychiatres pourrait améliorer la mise en place des SSC par les MG, et donc améliorer la prise en charge du patient.
