How is social security law impacted by the smallness of the jurisdiction? First, the author examines the key concepts 'small jurisdiction' and 'social security' as he understands them in the present research. He then pays some attention to the relation between social security and social security law and subsequently makes an excursion to explore the notion of legal transplants. In the second part, the author first examines the main features characterizing small states according to the general literature on small states, focusing on features which may be relevant to social security. He also includes an overview of the (limited) literature dealing with the specific social security issues small jurisdictions have to deal with. In other words, the second part provides the reader with the status quaestionis. In the third part, the author takes a look at the social security systems of 20 selected small jurisdictions. He does so according to a uniform scheme, in order to facilitate their comparison. These 20 case studies allow him in a next part to test the correctness of the statements made in Part 2. In the fourth part, he compares the social security systems of the 20 small jurisdictions. He draws conclusions as to the main question, but also to test the validity of the current literature on the topic as described in Part 2. Special attention goes to the use of legal transplants for the definition of the personal scope of social security arrangements. In the concluding part of the book, the author formulates some suggestions for the benefit of the social security systems of the small jurisdictions, based on his research.

It is not a comprehensive guide on the substantive law or on case management and does not attempt to provide citations from every circuit. The U.S. Code provides for federal court review of Social Security agency decisions. In practice, that review differs widely from district to district. Judges are therefore encouraged to consult the law in their circuit and their local procedural rules. Focus and Scope of District Court Review: Social Security disability cases are baffling to many judges and lawyers. Disability claimants typically initiate review by filing a civil complaint. Procedurally, a Social Security disability case is more akin to an appeal. This is because, except in limited circumstances, 42 U.S.C. § 405(g) requires the court to enter judgment upon the pleadings and transcript of the administrative record. Exactly what is before the court when a disability case is filed is worth considering. Under § 405(g), federal courts are authorized to review the final decision of the commissioner of Social Security. In most cases, the commissioner's final decision is the administrative law judge's (ALJ's) written decision. What is usually before the district court is whether the decision of the ALJ should be affirmed or should be remanded for further administrative proceedings or for an award of benefits. Federal courts review the commissioner's decision under the substantial evidence standard.1 So Social Security opinions invariably begin with an explanation of the standard.2 It is imperative for judges to remember that they are not reweighing evidence but determining whether substantial evidence supports the commissioner's opinion.

To illustrate this argument, Agency Under Stress analyzes two much-publicized cases of poor performance by one of the biggest and best established of U.S. government agencies, the Social Security Administration. The first case is that of the supplemental security income program to support needy blind, aged and disabled persons. Given responsibility of administering the program in 1974, the Social Security Administration was unequal to the task: many payments were made in error; many eligible persons were not paid; computer systems were not ready; field employees worked millions of hours of overtime; and other agency programs suffered. The second case is that of an eligibility review that Congress ordered the Social Security Administration to conduct for disability insurance recipients in the 1980s. The results were similarly traumatic: of over 1.2 million cases examined, 495,000 had benefits terminated, and, flooded with appeals, the courts ruled overwhelmingly against the agency. Derthick's analysis and conclusions have far-reaching implications for how the government can effectively serve its clients.
