Book excerpt: This Synthesis Report aims to contribute to a better understanding of the access of people with disabilities to social protection support, by describing and analysing the provision of disability-specific income support and of selected support services for people with disabilities. It does not provide an overall assessment of all social protection schemes and services available to people with disabilities across the 35 countries covered by the ESPN. First, it only considers people aged 18 years and above. Second, it concentrates exclusively on five schemes: disability-specific income support for working age people with disabilities, social protection measures for older people with disabilities, provision of cash benefits to cover specific disability-related expenses in the fields of healthcare and housing, social protection benefits for risks other than disability (with a focus on access to mainstream unemployment benefits and to minimum income schemes and other social assistance support), and provision of assistive technology (including devices) and personal assistance. The report also maps recent or announced social protection reforms (and their respective impact on people with disabilities), provides an overview of national debates on the social protection of people with disabilities, and identifies good practices enhancing the effective access of people with disabilities to social protection benefits and services.

Book excerpt: Abstract: This paper examines different models of disability policy in European welfare regimes on the basis of secondary data. OECD data measuring social protection and labour-market integration is complemented with an index which measures the outcomes of disability civil rights. Eurobarometer data is used to construct the index. The country modelling by cluster analysis indicates that an encompassing model of disability policy is mainly prevalent in Nordic countries. An activating and rehabilitating disability-policy model is predominant mainly in Central European countries, and there is evidence for a distinct Eastern European model characterized by relatively few guaranteed civil rights for disabled people. Furthermore, the Southern European model, which indicates a preference for social protection rather than activation and rehabilitation, includes countries which normally have diverse welfare traditions

They are firmly embedded in the Treaties of the European Union, the Charter of Fundamental Rights of the European Union, and secondary legislation. Combatting discrimination in the labour market and protecting the rights of persons with disabilities are core obligations of the European Union. Not many are aware that more than 15 per cent of the total potential workforce of the European Union has some form of disability - of which over 50 per cent are unemployed. This is all the more reason for the EU to maintain its commitment to include these indivuduals in the labour force and to guarantee their fair treatment and protection of their particularly sensitive data. It is precisely in this light that The Crossroads: Privacy, Disability and Employment must be seen: a sort of driving manual for disability organizations. It will be important to collect, process and handle personal data and to embrace new technologies without compromising privacy in the process. This manual also provides the various stakeholders with relevant articles of the GDPR and other legislative texts to equip them with sufficient knowledge and useful tools to ensure and to successfully navigate the crossroads between privacy and employment for persons with disabilities. Enrique Opi Tufet is an “actibilist”, a term he coined some time ago to describe an activist on disability issues. He has an LL.M. in International Law from Vrije Universiteit Brussel and he is a certified Data Protection Officer (DPO) by Maastricht University. Currently, Enrique acts as a Regional Director of Inserta/Fundación ONCE in Spain, an employment and disability program funded by the European Social Fund. He himself has a visual disability and is therefore intimately familiar with the challenges persons with disabilities face. Before Inserta, Enrique was the Corporate Vice President and General Counsel of Epson Europe. Previously, he led the Brussels operations of two major worldwide public relations agencies. He has written a number of articles and contributions addressing environmental policy, sustainability and communications. Enrique lives in Barcelona with his wife and son.

A precondition for anyone to enjoy all their human rights, this right is taken for granted by the majority of the population, but is often denied to persons with disabilities, who are instead placed in segregated institutions or in settings which isolate them from the rest of the community. This Issue Paper describes the challenges faced by Council of Europe member states in complying with this right. It traces the right of people with disabilities to live independently and be included in the community to its origins in the most fundamental human rights standards both within the Council of Europe and United Nations systems. The paper draws on Article 19 of the UN Convention on the Rights of Persons with Disabilities to identify the various forms that violations of this right can take, and provides guidance for community-based responses governed by choice, in order to achieve inclusion and participation. The paper shows the link between the right to live in the community and other rights, notably the rightto equal recognition before the law (legal capacity). The Issue Paper ends with a sample of indicators and guidance questions to assess the transition from violationto implementation of the right to live in the community.
