Son ya varios años que he tenido la fortuna de viajar en Sudamérica, desarrollando ponencias en diversas universidades, incluso en ocasión de numerosos congresos, y, por ende, iniciar a conocer parte del inmenso territorio o de apreciar su dimensión humana y social, no obstante, los conocidos problemas existenciales que inciden en muchas zonas de América del Sur. Por ello, cuando recibí la propuesta del colega y amigo Carlos Antonio Agurto Gonzáles de publicar un libro mío en la prestigiosa Ediciones Olejnik, que recoge los escritos que en los últimos años he ido publicando en idioma español, he aceptado con entusiasmo. Los ensayos han sido compendiados con el título «Constitución, democracia y estado de Derecho». Son los temas y problemas que afronto en diversos capítulos y que contemplo desde la perspectiva, que me es muy apreciada y estimada, del constitucionalismo como liberalismo. Lo que no se refiere a un concepto neutro de la Constitución, sino más bien a un preciso orden de valores constitucionales: es una técnica de la libertad, en cuanto establece el conjunto de reglas que en cualquier forma de convivencia política aseguran a los ciudadanos el ejercicio de sus derechos inviolables y el goce de las libertades fundamentales, así como el conjunto de normas que han limitado y limitan el poder estatal. Existe un concepto hoy que es utilizado en el debate constitucional europeo, que expresa bien una cierta idea de constitucionalismo: el de “patriotismo constitucional”, que manifiesta una adhesión a los valores y principios constitucionales como sentimiento agregativo de una renovada patria. Derechos de libertad, principio de igualdad, separación de los poderes, garantías y control de constitucionalidad son hoy patrimonio común de los constitucionalismos de matriz liberal y democrática".

Transconstitutionalism does not exist because a multitude of new constitutions have appeared, but because other legal orders are now implicated in resolving basic constitutional problems. A transconstitutional problem entails a constitutional issue whose solution may involve national, international, supranational and transnational courts or arbitral tribunals, as well as native local legal institutions. Transconstitutionalism does not take any single legal order or type of order as a starting-point or ultima ratio. It rejects both nation-statism and internationalism, supranationalism, transnationalism and localism as privileged spaces for solving constitutional problems. The transconstitutional model avoids the dilemma of 'monism versus pluralism'. From the standpoint of transconstitutionalism, a plurality of legal orders entails a complementary and conflicting relationship between identity and alterity: constitutional identity is rearticulated on the basis of alterity. Rather than seeking a 'Herculean Constitution', transconstitutionalism tackles the many-headed Hydra of constitutionalism, always looking for the blind spot in one legal system and reflecting it back against the many others found in the world's legal orders.
