It is remarkable that, though the Lloyd's policy has existed since 1795--possibly longer-.-and though the statutory liability to pay life salvage has been created by different statutes from the year 1846 onwards, there should be no case in the books in which it has been suggested that such a claim can be recovered under an ordinary Lloyd's policy. Mr. Walton has contended that life salvage is a loss by sea perils, that it is a statutory charge upon the ship which the owner has to pay, and that, therefore, it is covered by a Lloyd's policy. But by rule 13 the defendants expressly undertook this liability, and the argument of.Ir. Walton is that they really did nothing of the sort. In my judgment there is _no analogy between salvage in respect of services to the ship and life salvage which is the creation of statute; and I can see no answer to the reasoning of the judgment of Mathew J. It is not necessary in this case to discuss Aitchison v. Lohre (1) over again. RluBY L.J. It seems to me that if the defendants' contention were supported it would be like turning an insurance on ship into an insmance on the master and crew.
