Dehmers, S. 36) Mit diesen Worten leitete Gerold Becker, früherer Schulleiter der Odenwaldschule im hessischen Ober-Hambach, eine seiner Begrüßungsreden zu Beginn des Schuljahres ein. Über dreißig Jahre später machten mehrere Altschüler in der Frankfurter Rundschau deutlich, was der damalige Schulleiter und weitere Lehrer der Schule unter dem Erlaubten verstanden: Ein System der Regellosigkeit, das jahrelange sexuelle Übergriffe gegenüber Schülern zuließ und anscheinend von einem Großteil der Lehrerschaft geduldet wurde. Das Publik werden der Missbrauchsfälle an der bekanntesten deutschen Reformschule im Jahr 2010 erschütterte die Gesellschaft zutiefst. Die Thematik des sexuellen Kindesmissbrauchs war fortan in aller Munde. Sowohl im medialen als auch im politischen und reformpädagogischen Diskurs löste es eine Welle weiterer Enthüllungen und juristischer Ermittlungen aus. Bei keiner anderen Schule, deren Name mit Missbrauchsfällen in Verbindung kam, reagierte die Öffentlichkeit mit derartigem Interesse und Empörung; nicht zuletzt bedingt durch das jahrelange Verschweigen und der einhergehenden Verschleppung der Aufklärung. Auch in den Folgejahren gelang es der ehemaligen UNESCO-Modellschule nicht, sich aus der selbst verantworteten Krise zu befreien. Im Jahr 2014 waren die Augen erneut auf das hessische Landerziehungsheim gerichtet, als ein Lehrer unter dem Verdacht des Besitzes von Kinderpornografie stand und sich grenzverletzend verhalten haben soll. Obwohl es den Anschein erweckt, dass mit der Veröffentlichung der Schlagzeilen im Jahr 2010 die Thematik des sexuellen Kindesmissbrauchs in Institutionen erst geboren wurde, ist die sexuelle Gewalt gegen Mädchen und Jungen kein neuartiges Phänomen. Als Reaktion auf den Missbrauchsskandal richtete die Bundesregierung die Stelle einer Missbrauchsbeauftragten ein und besetzte sie mit Christine Bergmann als unabhängige Beauftragte zur Aufarbeitung des sexuellen Missbrauchs bis ins Jahr 2011. Innerhalb eines Jahres meldeten sich Frauen und Männer in über 2000 Briefen und 11.000 Anrufen und berichteten von, teilweise schon Jahre zurückliegender, erlebter sexueller Gewalt. Eine Analyse der Angaben offenbarte, dass ein Drittel der Kinder und Jugendlichen vornehmlich in Institutionen sexuellen Übergriffen ausgesetzt waren (vgl. Bergmann 2011, S. 46)...

Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.
