Book excerpt: Drawing on various disciplinary perspectives, this book re-focuses the debate on what makes a good health system, with a view to clarifying the uses of social science research in thinking about health care issues in Africa. The explosion of the HIV/AIDS pandemic, the persistence of malaria as a major killer, and the resurgence of diseases like tuberculosis which were previously under control, have brought about changes in the health system, with implications for its governance, especially in view of the diminished capacity of the public health facilities to cope with a complex range of expanded needs. Government responsibilities and objectives in the health sector have been redefined, with private sector entities (both for profit and not-for profit) playing an increasingly visible role in health care provisions. The reasons for collaborative patterns vary, but chronic under-funding of publicly financed health services is often an important factor. Processes of decentralisation and health sector reforms have had mixed effects on health care system performance; while private health insurance markets and private clinics are pointers to a growing stratification of the health market, in line with the intensified income and social differentiation that has occurred over the last two decades.These developments call for health sector reforms.

Le rapport Améliorer la couverture effective en matière de santé examine une approche particulière visant à améliorer la couverture effective : les incitations financières sous la forme d’un financement basé sur la performance (FBP), une réforme globale qui comprend généralement la rémunération liée à la performance pour les agents de santé de première ligne ainsi que l’autonomie des établissements, la transparence et l’engagement communautaire. Ce rapport de recherche s’appuie sur un vaste ensemble d’études rigoureuses et de nouvelles analyses. Par rapport au statu quo, dans les pays à faible revenu dotés de systèmes de santé centralisés, le FBP peut entraîner des gains substantiels en matière de couverture effective. Toutefois, les avantages relatifs du FBP — la composante rémunération liée à la performance en particulier — sont moins clairs lorsqu’il est comparé à deux autres approches, à savoir : le financement direct des établissements, qui permet d’octroyer des budgets de fonctionnement aux services de santé de première ligne en accordant aux établissements l’autonomie en matière d’allocations budgétaires, mais sans rémunération liée à la performance ; et le soutien financier lié à la demande pour les services de santé (c’est-à -dire les transferts monétaires conditionnels et les vouchers). Bien que le FBP se traduise souvent par des améliorations marginales, combler les lacunes importantes de la couverture sanitaire effective n’est pas encore à la portée de nombreux pays. Néanmoins, d’importantes leçons et expériences tirées de la mise en oeuvre du FBP au cours de la dernière décennie peuvent orienter le financement de la santé à l’avenir. En particulier, pour réussir, la réforme du financement de la santé devra sans doute moins se focaliser sur la rémunération à la performance tout en conservant les éléments de financement direct des établissements, l’autonomie, la transparence et l’engagement communautaire.

The Conference, which got the hospitality of the Dutch Social Security Council in Zoetermeer, was very well organised and financed by the Dutch social security institutions and the Ministry of Social Affairs and Employment. Book excerpt: This book explores various approaches around the world regarding price term control, and particularly discusses the effectiveness of two major paths: ex ante regulatory and ex post judicial intervention. Price control and its limits are issues that affect all liberal market economies, as well as more regulated markets. For the past several years, courts in many different countries have been confronted with the issue of whether, and to what extent, they should intervene regarding price-related terms in standard form contracts – especially in the area of consumer contracts. Open price clauses, flat remunerations, price adjustment clauses, clauses giving the seller/supplier the right to ask for additional payments, bundling or partitioning practices, etc.: a variety of price related terms are used to manipulate customers’ choices, often also by exploiting their behavioral biases. The result is an unfavorable contract that is later challenged in court. However, invalidating a given price term in standard forms e.g. of a banking or utilities contract only has an inter partes effect, which means that in thousands if not millions of similar contracts, the same clauses continue to be used. Effective procedural rules are often lacking. Therefore, pricing patterns that serve to hide rather than to reveal the real cost of goods and services require special attention on the part of regulators. The aim of this book is to determine the various approaches in the world regarding price term control, and particularly to discuss the efficiency of both paths, ex ante regulatory and ex post judicial intervention. Thanks to its broad comparative analysis, this book offers a thorough overview of the methods employed in several countries. It gathers twenty-eight contributions from national rapporteurs and one supra-national rapporteur (EU) to the 2018 IACL Congress held in Fukuoka. These are supplemented by a general report presented at the same IACL Congress, which includes a comparative analysis of the national and supranational reports. The national contributors hail from around the globe, including Africa (1), Asia (5), Europe (17), the European Union (1) and the Americas (5).
